There is hereby established the Department
of Police of the City of Wildwood which shall consist of the Marshal,
who shall serve as the Chief of Police, and such other officers and
members as may be provided from time to time by the City Council.

The officers of the Police Department
shall be conservators of the peace, and shall be active and vigilant
in the preservation of good order within the City. Every member of
the Police Department shall have power at all times to make or order
an arrest with proper process for any offense against the laws of
the City or the State, and to keep the offender in the City Prison
or other proper place to prevent his/her escape until a trial can
be had before the proper officer, unless such offender shall give
a good and sufficient bond for his/her appearance for trial, and shall
also have power to make arrests without process in all cases in which
any offense against the laws of the City or the State shall be committed
in his/her presence. Every member of the Police Department is also
empowered to serve and execute all warrants, subpoenas, writs or other
process issued by the judge hearing and determining municipal ordinance
violation cases of the City at any place within the limits of the
County or Counties within which the City is located. Every member
of the Police Department shall have the power to make or order an
arrest in areas leased or owned by the municipality outside of the
boundaries of such municipality.

Police Officers shall also have the
power to issue such writs, notices, and orders as may be issued by
the City, and to collect fines assessed for ordinance violations and
pay the same to the City Treasury.

The City may contract with another
governmental entity to provide Police protection, and in such event,
the Police Officers of such entity shall be the Police Officers of
the City who shall have all such powers as may be authorized to Police
Officers of the City. The entity contracted with shall establish such
divisions, officers, or take other actions as is required of a Municipal
Police Department by law. The powers and duties of the Chief of Police
relating to the enforcement of laws shall be executed by the officer
responsible for such duties in the contracted entity, and the City
Marshal shall have such duties as are prescribed by ordinance.

Before entering upon his/her duty,
all officers in the Police Department shall take the following oath:
"I do solemnly swear that I shall uphold the Constitutions of the
United States and of the State of Missouri, the laws of the United
States and the State of Missouri, and the ordinances of the City of
Wildwood, Missouri; and that I shall faithfully demean myself in office."

There is hereby established a Board
of Public Safety which shall have and exercise oversight authority
over the Police Department, its equipment, operation, personnel and
any other aspect of the Department whether the same is in existence
now, or shall come into existence in the future, or shall exist by
contract with another governmental entity. In the event that Police
services are contracted for by the City, the Board shall exercise
its authority consistent with such contractual provisions. The Board
shall be responsible for making recommendations to the Council regarding
public safety issues and shall oversee emergency preparedness plans,
review development plans for public safety concerns, and coordinate
public safety among various agencies and governmental entities.

A. The Board of Public Safety shall consist
of three (3) resident members of the City, the City Marshal, and a
Council Member, each of whom shall be appointed by the Mayor with
approval of the City Council. The members of the Board of Public Safety
shall serve at the pleasure of the Mayor and the City Council.
B. The terms of office for the three (3) resident
members of the Board of Public Safety shall be for a period of three
(3) years commencing on July 1 of the year of their appointment and
ending on June 30 of the year in which they complete their tenure
as a Board member, unless otherwise appointed. The three (3) citizen
members serving on the Board of Public Safety, as of the effective
date hereof, shall, no later than August 4, 2006, choose the respective
length of term for each member by a method determined by a majority
of the Board. If the Board does not so choose, the Mayor will determine
the length of term for each member. One (1) citizen member shall serve
for a one (1) year period, one (1) for two (2) years and one (1) for
a three (3) year period.
All subsequent terms shall be for
three (3) years. Anyone filling a vacancy shall be appointed for the
remainder of the unexpired term of the citizen member leaving the
Board of Public Safety.

The members of the Board of Public
Safety shall elect a secretary of the Board and shall establish its
own rules which shall be published and filed with the City Clerk and
shall keep a record of all meetings for the transaction of business,
which record shall be open to the public.
