The Town of Lewiston, pursuant to § 244-d of the General
Municipal Law, hereby establishes the Lewiston-Porter Joint Recreation
Commission with the Village of Lewiston, the Town of Porter and the
Village of Youngstown.
The Joint Recreation Commission shall be comprised of each of
the Recreation Commissions of the Town of Lewiston, the Village of
Lewiston, the Town of Porter and the Village of Youngstown as said
Commissions now exist and as their membership may from time to time
be appointed by the respective legislative bodies of such municipalities.
Each such Recreation Commission shall designate from time to time
one of its members to serve on an executive committee of such Lewiston-Porter
Joint Recreation Commission, which such executive committee may exercise
all of the authority of the Joint Recreation Commission, except that
any executive committee member, on demand, may require an issue to
be submitted to the Joint Recreation Commission.
Such Joint Recreation Commission may negotiate with the Board
of Education of Central School District No. 1 of the Town of Lewiston
and the Town of Porter for the use of equipment and facilities of
said School District, and the operation and maintenance thereof, pursuant
to revocable license, during nonschool hours; and, within the limits
of available budgetary appropriations, provide additional equipment
and supplies for the conduct of the programs adopted by such Joint
Recreation Commission. In the event of termination by said School
District of such license to use the facilities and equipment of such
School District, the Joint Recreation Commission shall have the right
to remove such equipment and supplies as it may have furnished in
carrying out its programs.
The personnel required for the proper supervision of the various
recreation programs shall be employed by the Joint Recreation Commission
to the extent that appropriations are made available for that purpose.
The Supervisor of the Town of Lewiston shall be the custodian
of moneys made available for expenditures made by the Joint Recreation
Commission, and each participating municipality shall pay its share
at such times and in such installments as may from time to time be
agreed upon by the respective legislative bodies.
Adoption of this article shall not constitute repeal of the
ordinance adopted by the Town Board of the Town of Lewiston July 9,
1962, as amended, establishing a Joint Recreation Commission with
the Village of Lewiston, and the programs adopted by such Recreation
Commission shall be continued.
In the event that the legislative body of any participating
municipality shall not appropriate an amount sufficient to meet its
proportionate share of the cost of operation and maintenance, including
capital expenditures, the Joint Recreation Commission may terminate
the participation of such municipality at the close of the fiscal
year, and any municipality may withdraw from such Joint Recreation
Commission at the close of any fiscal year by repeal of its adopting
ordinance and the filing of a copy thereof with the other participating
municipalities.
The Joint Recreation Commission may adopt and from time to time
amend rules and regulations with respect to its programs, financing
and administration, not inconsistent with the provisions of this article.
This article shall take effect immediately upon adoption of similar local laws or ordinances by each of the participating municipalities named in §
67-7 hereof.
