A. A performance
bonus shall be paid to the following City Officials and employees:
City Administrator, City Clerk, City Collector, Assistant (Deputy)
Collector/Clerk, full-time office clerks, Chief of Police, Sergeant
and/or Lieutenant of the Police Department, Patrolmen, Police Department
dispatchers, Communications Director, Public Works Administrator,
public works employees including Street and Water Departments and
solid waste employees. The bonus shall be paid on or before the twenty-fifth
(25th) day of December each year.
B. The bonus
shall be paid to those employees and officials who are full-time employees
or officials and who were serving in their respective capacity as
of November first (1st) of the year in which the bonus is paid, and
provided that the employee or official has continued and is employed
at the time said bonus is paid (except as provided hereinbelow for
part-time employees).
C. The bonus
shall be the sum of three hundred dollars ($300.00) for such qualified,
full-time employees and officials and from which said amount the City
shall withhold appropriate employment taxes and income taxes as required
by the State and Federal Government. There shall be no proration of
bonuses and the bonus shall not be a reimbursable item upon the employee's
retirement or severance from employment.
D. Those
persons who are non-seasonal part-time employees and who work for
the City of Chaffee (exclusive of officials) shall be entitled to
a bonus of fifty dollars ($50.00) for the year for which they are
employed on a part-time basis, which said bonus shall be paid at the
time and in the manner as set forth above.

A. All employees
of the City of Chaffee, except department heads and supervisors and
officials of the City, shall be paid overtime compensation for hours
worked in excess of forty (40) hours worked in a workweek at the rate
of one and one-half (1½) times their hourly rate of pay subject
to the provisions set forth herein.
B. Overtime
compensation will be paid only to those persons indicated above after
approval by the City Council and after the overtime request has been
presented to the City Council by the supervisor of the respective
department of the employee.
C. For purposes of determining overtime compensation, the workweek shall be considered 12:01 A.M. Monday through Sunday. The hourly rate of each employee subject to the provisions of this Section shall be determined by the tier of compensation as set forth in Section
115.510 of this Code.
D. For purposes of construing the payment of overtime compensation, the normal working hours of a Tier level paid holiday under Section
115.600, and the normal working hours of a paid vacation under Section
115.550, and the normal working hours for a sick day under Section
115.580, and the normal working hours of a personal leave day under Section
115.560, and the normal working hours of a paid emergency leave under Section
115.570 shall be considered as though those hours were physically worked by the employee for the workweek within which the paid absence occurred.
E. Notwithstanding
the above provisions, employees of the Chaffee Police Department shall
be paid overtime compensation in accordance with the applicable policy
of the Chaffee Police Department Personnel Manual.

The City hereby accepts the various provisions of the Worker's
Compensation Act according to Sections 287.010 et seq., RSMo., as
amended.
[CC 1978 §110.080; Ord. No. 110.040 §§H — I, 4-19-2010]
A. The mandatory
retirement age for the City employees is hereby set at seventy (70).
B. The mandatory
retirement age can, by vote of the City Council, be extended one (1)
year at a time for an individual who wishes to remain in the employment
of the City after reaching seventy (70). This provision shall not
be applicable to elected City Officials covered under this Chapter.

A. Employees
of the City shall receive vacation with pay on the following schedule:
1. After
completion of one (1) continuous year of employment, one (1) week
vacation.
2. After
completion of two (2) continuous years of employment, two (2) weeks
vacation.
3. All
employees who have worked ten (10) consecutive years with the City
shall receive one (1) extra day vacation for each year worked over
ten (10) years, but not to exceed one (1) workweek.
4. Upon
request by the employee to the City Council and approval by the City
Council, compensation may be paid in lieu of actually taking vacation
subject to an annual maximum of one (1) week of the employee's annual
vacation.
5. Notwithstanding
the above provisions, under no circumstances shall the vacation provisions
herein entitle an employee to payment or be considered a reimbursable
item upon termination of employment for any reason whatsoever.

A. Notwithstanding
and in addition to the other provisions herein relating to vacation,
sick leave, holidays, and emergency leave, each full-time employee
of the City after six (6) full months of full- time employment shall
be entitled to select one (1) paid personal leave day annually, subject
to the following restrictions and limitations:
1. Prior
to utilizing a personal leave day, approval of the date for the personal
leave must be given in writing by the employee's supervisor; if approval
is not given, then an alternative personal leave day may be selected
by the employee, but the alternative day is subject to all conditions
and requirements herein.
2. Personal
leave days may not be accumulated and may not be carried over to a
subsequent year.
3. No employee
shall be entitled to receive compensation for any non-used personal
leave day.
4. Under
no circumstances shall an employee be entitled to payment or reimbursement
for any non-used personal leave day upon termination of employment
for any reason whatsoever.

A. Emergency
leave for the full-time employees of the City shall be as follows:
1. Emergency
leave not to exceed three (3) working days with full pay may be granted
to all full-time employees in the event of a death in the immediate
family.
2. "Immediate family" shall be defined as mother, father, husband,
wife, son, daughter, sister, brother, mother-in-law, father-in-law,
brother-in-law, sister-in-law, grandparent and grandchild.
3. Emergency leave with full-time pay may be granted to permanent full-time employees in the event of serious illness to such employee's mother, father, husband, wife, son and daughter. The emergency leave provided for in this Subsection
(3) shall not exceed three (3) working days in each calendar year plus any unused emergency leave days from the immediate previous year, provided the total emergency leave days granted pursuant to this Subsection
(3) shall in no event exceed six (6) working days in any calendar year.
4. Emergency
leave not to exceed four (4) hours with full pay may be granted to
all City employees who attend a funeral of a City employee, retired
City employee or an in-town relative.
5. Emergency
leave may be granted with full pay to all permanent, full-time employees
for jury duty, provided that the jury duty pay will be deducted from
the regular pay of the employee and the employee will receive the
difference between the jury duty pay and his/her regular salary.
6. In all
cases, employees shall first obtain permission from the employee's
immediate supervisor, if any, and the Mayor prior to any type of emergency
leave. For purposes of this Section, the employee's supervisor may,
in behalf of the employee, seek the permission of the Mayor.

A. All full-time
City employees shall earn sick leave with full pay at the rate of
ten (10) days (a day consisting of eight (8) hours) of paid sick leave
per year. Sick leave shall accrue from the date of employment, but
shall not be taken until the successful completion of one (1) year
of service.
B. Sick
leave may not be taken in advance of earning the sick leave time.
Sick leave may be accumulated up to sixty (60) days.
C. An employee
may be eligible for sick leave for the following reasons:
1. Personal
illness or physical incapacity.
2. Quarantine
of the employee by a physician.
3. Illness
in the immediate family requiring the employee to remain at home.

An employee who is unable to report for work because of the
above reasons shall report the reason for the employee's absence to
the employee's supervisor within four (4) hours from the time the
employee is expected to report for work. Sick leave with pay will
not be allowed unless such report has been made. Sick leave with pay
in excess of three (3) working days shall be allowed only after presenting
a written statement by a physician certifying that the employee's
condition prevented the employee from appearing for work.

D. An employee
terminating from City service shall not be allowed the use of sick
leave in the last two (2) calendar weeks of employment. Unused sick
leave will not be compensated for in any way at the time of resignation
or dismissal of an employee.
E. Notwithstanding
the above:
1. If sick
leave is required because of an injury or disability which is covered
by Worker's Compensation, then the employee may request sick leave
compensation for one hundred percent (100%) of the amount of the employee's
regular rate of pay less the amount of compensation payments paid
to the employee under the Missouri Worker's Compensation Act.
2. The
employee's sick leave days will be reduced/used proportionately based
upon the amounts paid by the City to supplement the compensation paid
to the employee under the Missouri Worker's Compensation Act.
3. To determine
the reduction and use of sick days, the employee's hourly rate shall
be determined by dividing the employee's regular annual pay amount
by two thousand eighty (2,080). The amount paid by the City to supplement
the Missouri Worker's Compensation Act payments shall be divided by
the hourly rate to determine the number of hours of sick leave used.
The hours of sick leave used will be subtracted from the employee's
available sick days. For purposes of these calculations, one (1) sick
day shall consist of eight (8) hours.
4. Use
of sick days under this paragraph shall be subject to all other limitations
and requirements set forth in this Section which are not in conflict
herewith.
F. Abuse
of the sick leave privilege can result in dismissal.
G. "Illness", as used in this Section, shall mean any form
of physical disability which, by the doctor's certification, renders
an employee unable to property attend his/her duties.

It is the policy and purpose of the City, to extend, at the
earliest date, to all eligible employees and officials of the City
who are not excluded by law or by this Code, and whether employed
in connection with a governmental or proprietary function of the City,
the benefits of the system of Federal Old Age and Survivors Insurance
as authorized by the Social Security Act amendments of 1950 and Sections
105.300 et seq., RSMo., and amendments thereof as the same may be
now and hereafter in effect.

A. All regular
full-time employees of the City shall receive compensation for the
ten (10) holidays listed below. The holidays to be observed are:

B. It shall
be the policy of the City to insure that all regular employees enjoy
the same number of holidays each year. The standard shall be the number
of holidays in a particular year that will be celebrated by regular
employees working a forty (40) hour week. For this group of holidays,
when a holiday falls on a Sunday, the following Monday shall be observed
as the holiday and when a holiday falls on a Saturday, the preceding
Friday shall be observed as the holiday.
C. Any regular
employee in the City service who shall be required to perform work
or render services on a regularly scheduled holiday shall receive
a day off during that workweek at the regular pay rate in lieu of
the holiday missed, or the employee will be compensated at the City's
approved rate if the circumstances so dictate. The department head
and City Administrator shall make this determination.
D. For purposes
of construing the payment of overtime compensation for employees other
than department head (or supervisor), the normal working hours of
a paid holiday shall be considered as though those hours were physically
worked by the employee for the workweek within which the holiday occurred.
