A. All
utility statements mailed to utility customers of the City of Salem,
Missouri, shall, among other things, state when all delinquent accounts
in that customer's name shall be disconnected.
B. A utility
customer who has had utility services disconnected shall pay all delinquent
utility charges, plus a service fee, before utility services shall
again be provided. The service fee is to be as follows:
1. Twenty-five dollars ($25.00) if the reconnection is accomplished
during normal working hours.
2. Fifty dollars ($50.00) if the reconnection is performed during other
than normal working hours.

"Normal working hours" are defined as 8:00
A.M. to 5:00 P.M., Monday through Friday except on declared City holidays.

C. A utility
customer who has more than one (1) utility account with the City and
has become delinquent on one (1) or more of the accounts shall be
disconnected on the delinquent accounts only. If the customer fails
to pay the delinquent charges plus service fees on an account within
thirty (30) days after disconnection, then the City may disconnect
utilities on all accounts in that customer's name or control.
D. A utility
customer with CT metering service who has had utility services disconnected
shall pay all delinquent utility charges plus a one hundred dollar
($100.00) service fee before utility services shall again be provided.

A. Termination. The City of Salem, Missouri, may terminate
all utility services it provides any person, business or corporation
conducting business in the City of Salem, Missouri, without a current
business license.
B. Reconnection Fees. In the event utility services are terminated
as provided for herein, no utility services shall again be provided
such person, business or corporation conducting business in the City
of Salem, Missouri, until a current business license has been purchased
and all penalties and utility reconnection fees have been paid in
full.
C. Notice Of Termination. The City of Salem, Missouri, shall
give each person, business or corporation at least five (5) days'
written notice of its intention to terminate utility services by delivering
said notice to the office of the person, business or corporation or
mailing said notice to the last known address of such person, business
or corporation. Actual receipt of said written notice by such person,
business or corporation is not necessary.

A. The
City of Salem shall require a utility deposit for all new utility
accounts and reconnected accounts except as provided in Subsections
(2) and (3) below:

2. A utility customer will not be required to post a utility deposit
if the customer has a credit history with the City of Salem for a
period of twelve (12) consecutive months immediately prior to applying
for utility services and the customer has not had any utility service
disconnected for non-payment on more than one (1) occasion within
the twelve (12) consecutive months immediately prior to application
for services.
3. A customer will not be required to post a utility deposit if the
customer's deceased spouse had a credit history with the City of Salem
for a period of twelve (12) consecutive months immediately prior to
applying for utility services and the deceased spouse did not have
any utility service disconnected for non-payment on more than one
(1) occasion within the twelve (12) consecutive months immediately
prior to application for services.
4. The City will not pay interest on deposits.
5. Deposits will be refunded upon closing of the utility account.
6. Deposits shall be applied to overdue accounts and any remaining amount
shall be refunded to customer upon closing of the account.

A. After
a customer's account with the City of Salem, Missouri is past due
more than ninety (90) days, the account may be sent to a collection
agency for collection purposes authorized by law including, but not
limited to, the pursuit of litigation for collection purposes.
B. The
customer shall be responsible for all collection fees and costs including
attorney fees, expenses of litigation, court costs and interest and
penalties on the past due account.
C. The
Mayor is hereby authorized upon approval of the Board of Aldermen
of the City of Salem to contract with a collection agency to pursue
collection of customer accounts of the City of Salem, Missouri.

A. When the City Clerk shall issue a building permit for a non-residential
new construction or remodeling project, the City Clerk shall notify
the head of the Electrical Department and Water and Sewer Department
of such issuance.
B. The head of the City Electrical Department and/or the head of the
Water and Sewer Department or their designee shall inspect the plans
or premises of the non-residential construction project to determine
if there will need to be upgrades in the electrical or water and sewer
service to be provided to the new or remodeled premises.
C. If the head of the Electrical or Water and Sewer Department shall
determine that there will need to be an upgrade to the electrical
or water and sewer service for which the City of Salem shall incur
an expense, the head of either such department may cause to be sent
to the building permit holder an estimate of the expense to the City
of Salem and direct that payment must be paid to the City of Salem
before any such upgrades to services are commenced by the City of
Salem.

A. No
residential customer connected and receiving electric service from
the City of Salem, Missouri, shall be disconnected from electric service
for non-payment of utility bills, including all residential tenants
of apartment buildings when electricity is used as the source of cooling
or heating, or to operate the only cooling or heating equipment at
the residence during the following weather situations:
1. On any day when the National Weather Service local forecast, between
6:00 A.M. and 9:00 P.M. for the following twenty-four (24) hours,
predicts that the temperature shall rise above ninety-five degrees
Fahrenheit (95° F.) or that the heat index shall rise above
one hundred five degrees Fahrenheit (105° F.).
2. On any day when utility personnel are not available to reconnect
utility service during the immediately succeeding day or days and
the National Weather Service local forecast between 6:00 A.M. and
9:00 P.M. predicts that the temperature during the period of unavailability
shall rise above ninety-five degrees Fahrenheit (95° F.)
or that the heat index shall rise above one hundred five degrees Fahrenheit
(105° F.).
3. On any day when the National Weather Service local forecast predicts
the temperature to drop below thirty-two degrees Fahrenheit (32° F.)
during the following twenty-four (24) hour period; and
4. On any day when utility personnel are not available to reconnect
utility service during the immediately succeeding day or days and
the National Weather Service local forecast predicts the temperature
to drop below thirty-two degrees Fahrenheit (32° F.) during
the following twenty-four (24) hour period.
B. A residential customer previously disconnected from electric service may be reconnected to electric service during the occurrence of a weather situation, as set forth above in Subsection
(A) of this Section, as follows:
1. Upon compliance with Section
700.010 of the Code of Ordinances of the City of Salem, Missouri; or
2. Upon written request and payment of the service fee for reconnection of electric service, as set forth in Section
700.010(B) of the Code of Ordinances of the City of Salem, Missouri, if previous disconnection from electric service occurred within fifteen (15) days prior to the occurrence of a weather situation, as set forth in Subsection
(A) of this Section, and the residential customer is not in default for non-payment of utility bills to the City of Salem, Missouri, in excess of thirty (30) days.
3. No residential customer shall qualify for reconnection of electric service, pursuant to Subsection
(B)(2) of this Section, whom is in default to the City of Salem, Missouri, for non-payment of utility bills and their account has been referred to a third-party for debt collection.
C. This Section shall not require reconnection of any residential customer previously disconnected from electric service that has not complied with Section
700.010 of the Code of Ordinances of the City of Salem, Missouri, or Subsection
(B)(2) of this Section.
D. Only
one (1) service fee for reconnection of electric service, pursuant
to this Section, shall be assessed during a thirty (30) day period.
E. Electricity consumed pursuant to this Section shall be billed to the customer in accordance with Section
700.090 of the Code of Ordinances of the City of Salem, Missouri.
