As used in this Chapter, the following words have the meanings
indicated:
VACATION RENTAL
Vacation Rental mean a lodging use of a furnished dwelling
unit, or portion thereof, for less than thirty (30) consecutive days
per rental. Meals are not provided, although guests may have full
access to kitchen facilities. Hotel, motel, or lodge rooms and bed-and-breakfasts
and inns are not considered a vacation rental. Offering the use of
one's property where no fee is charged or collected is not considered
a vacation rental.

It shall be unlawful for any person to operate a vacation rental
in the City, whether personally, by agents or employees, singly, or
along with some other business or enterprise, without first having
obtained a license therefor from the City Clerk in accordance with
the provisions of this Chapter.

A. An applicant for license under this Chapter shall file with the City
Clerk a written application upon forms provided by the City Clerk
and pay a fee as hereinafter prescribed.
B. Said application shall include the applicant/owner's name, mailing
address, and telephone number of applicant; the exact address or location
of the place where the business is or is proposed to be carried on;
and such other information as the City Clerk may reasonably require.

The fees for licenses required under this Chapter shall be as
established from time to time by ordinance of the Board of Aldermen
and on file in the office of the City Clerk.

A. Upon receipt of an application for vacation rental license as provided
for herein, the Building Inspector shall cause an inspection to be
made of the applicant's proposed dwelling.
B. If the findings of said inspection are favorable to the applicant,
the City Clerk shall within thirty (30) days after the filing of the
application and payment of the fee issue a vacation rental license
to the applicant.
C. If the findings of said inspection are not favorable to the applicant,
the Building Inspector shall, within seven (7) days after the initial
inspection, notify the owner/applicant of the deficiencies, and the
owner/applicant will have up to thirty (30) days to correct deficiencies
and have property reinspected.

No license issued under this Chapter shall be transferred or
assigned or used in any way by any person other than the one (1) to
whom it was issued.

All licenses issued under the provisions of this Chapter shall
expire on the 31st day of December following the issuance thereof.
No license fee shall be returned to the holder upon sale, transfer
or dissolution of the business for which the license was issued.

A. The following general operating requirements shall apply to all vacation
rentals licensed in accordance with the provisions of this Chapter:
1.
The license issued pursuant to this Chapter shall be plainly
displayed on the business premises;
2.
Parking shall be maintained to accommodate occupant vehicles
and shall provide one (1) off-street parking space not located within
the front setback area for each guest room;
3.
The number of guests at any given time shall not exceed two
(2) adults per bedroom plus two (2) additional adults.
4.
On-site snow removal shall be maintained;
5.
Regular trash collection is required;
6.
Any/all signs proposed shall comply with the City's sign
code requirements and require submittal of a sign permit application;
7.
Monthly Dent County tourism tax reporting and remittance is
required and must be in good standing;
8.
All existing and future exterior lighting shall comply with
the City building codes;
9.
The applicant is required to provide and maintain all required
carbon monoxide (CO) and smoke detectors and fire extinguishers in
good working order;
10.
The applicant is required to post in a prominent location or
at the beginning of a guest registry book emergency contacts for fire,
police and an emergency contact for the property within thirty (30)
minutes;
11.
Maintain approved address numbers on all buildings plainly visible
from the street or road fronting the property.
