City of Wildwood, MO Chapter 515 Procedures For Establishing and Changing Street Names

Section 515.010 Definitions.

As used in this Chapter, the following terms shall have the meanings indicated:

STREETS

Includes any privately or publicly owned vehicular access to property recorded by right-of-way or easement, or acquired by common law dedication.

Section 515.015 Street Name Required.

All streets providing direct access to two or more houses or other residential dwelling units shall have an official street name recorded and made available to public service providers as provided by this Section.

Section 515.020 Procedure For Establishing Names Of New Streets.

A. Except where the street names are established pursuant to an approved subdivision plat or other plat approved by the City, petitions for official naming of street(s) shall be filed with the Department of Public Works/Division of Streets on forms as provided by the Director of Public Works. Each petition shall identify by address all properties to be addressed with the new street name and shall contain the signatures of all the owners of property to be addressed with the new street name and indicating whether they agree, disagree or have no preference to the proposed street name. Each petition shall be accompanied by a filing fee of seventy-five dollars ($75.00) and shall identify the proposed name of customary type and length for adoption.

B. Determination Of Director.

1. The Director shall determine:

a. Whether, from a review of the number of signatures of property owners submitted by the petitioner, all property owners favor the adoption of the name set forth in the petition;

b. Whether the name will cause confusion in the provision of emergency, mail and other services; and

c. The cost of signage.

2. Upon receipt of the petitioner's payment of the cost of signage, the Director shall advise the Administration/Public Works Committee of the City Council of his/her recommendation which, in turn, shall advise the full City Council of the Committee's recommendation.

C. Upon receipt of the Committee's recommendation, the City Council may at its sole discretion adopt the street name requested in the petition, or may adopt such other name as may be in the public interest. If the City Council adopts a street name, the City Clerk will record the ordinance approving such street name with the Recorder of Deeds. The Director shall upon petitioner's request refund the payment for signage if legislation effecting the petitioned change(s) has not been passed within sixty (60) days of receipt of the Director's recommendation.

Section 515.030 Procedure For Change Of Street Name.

A. Petitions for change of official street name(s) shall be filed with the Department of Public Works on forms as provided by the Director of Public Works. Each petition shall identify by address all properties to be addressed with the new street name and shall contain the signatures of all the owners of property to be addressed with the new street name and indicating whether they agree, disagree or have no preference to the proposed change. Each petition shall be accompanied by a filing fee of seventy-five dollars ($75.00) and shall identify the proposed name of customary type and length for adoption.

B. Determination Of Director.

1. The Director shall determine:

a. Whether, from a review of the number of signatures of property owners submitted by the petitioner, all property owners favor the petitioned change;

b. Whether the change could be made without undue confusion in the provision of emergency, mail and other services; and

c. The cost of signage for the proposed change.

2. Upon receipt of the petitioner's payment of the cost of signage, the Director shall advise the Administration/Public Works Committee of the City Council of his/her recommendation which, in turn, shall advise the full City Council of the Committee's recommendation.

3. If the Director of Planning determines that the petitioned street name has historical significance, a review by the Historic Preservation Commission shall occur to determine whether the Historic Preservation Commission supports the street name change and, thereafter, submit its non-binding recommendation(s) for the Administration/Public Works Committee to consider in making its recommendation.

C. Upon receipt of the Committee's recommendation, the City Council may at its sole discretion effectuate the petitioned change of street name(s). If the City Council approves the petitioned street name change(s), the City Clerk shall record the ordinance approving the change(s) with the Recorder of Deeds. The petitioner shall notify all service providers of the change(s). Copies of all notices shall be provided to the Director. The Director shall upon petitioner's request refund the payment for signage if legislation effecting the petitioned change(s) has not been passed within sixty (60) days of receipt of the Director's recommendation.

D. For all petitions for street name change involving platted street names, within thirty (30) days of the City Council's approval of a petitioned street name change, the petitioner shall effectuate the filing of an amendment to the record plat with the Recorder of Deeds. The petitioner will then provide the Director with proof of filing of the amended record plat with the Recorder of Deeds.

E. Nothing in this Chapter shall prevent the City Council from establishing or changing the name of any street by enactment of an ordinance to that effect in the public interest irrespective of the procedures established herein.
