As used in this Chapter, the following terms shall mean:
BICYCLE
Every vehicle propelled solely by human power upon which any person may ride, having two (2) tandem wheels, and one (1) or two (2) forward rear wheels, all of which are more than fourteen (14) inches in diameter, except scooters and similar devices.
ELECTRIC BICYCLE
A bicycle equipped with fully operable pedals, a saddle or seat for the rider, and an electric motor of less than seven hundred fifty (750) watts that meets the requirements of one (1) of the following three (3) classes:
1. 
CLASS 1 ELECTRIC BICYCLEAn electric bicycle equipped with a motor that provides assistance only when the rider is pedaling and that ceases to provide assistance when the bicycle reaches the speed of twenty (20) miles per hour;
2. 
CLASS 2 ELECTRIC BICYCLEAn electric bicycle equipped with a motor that may be used exclusively to propel the bicycle and that is not capable of providing assistance when the bicycle reaches the speed of twenty (20) miles per hour; or
3. 
CLASS 3 ELECTRIC BICYCLEAn electric bicycle equipped with a motor that provides assistance only when the rider is pedaling and that ceases to provide assistance when the bicycle reaches the speed of twenty-eight (28) miles per hour.
JOGGING
Running, trotting or alternately running and walking.
MOTORIZED BICYCLE
Any two- or three-wheeled device having an automatic transmission and a motor with a cylinder capacity of not more than fifty (50) cubic centimeters, which produces less than three (3) gross brake horsepower and is capable of propelling the device at a maximum speed of not more than thirty (30) miles per hour on level ground, but excluding an electric bicycle, as defined in Section 380.010 of this Code. A motorized bicycle shall be considered a motor vehicle for purposes of any homeowners' or renters' insurance policy.
MOTORIZED PLAY VEHICLES
Any device that is not a motorcycle, motorized bicycle, electric bicycle or motor vehicle, as defined in Chapter 300 therein, with two (2) or more wheels which is designed to be ridden in or upon and is powered by a power source that is capable of propelling the device with or without human propulsion. This Section shall not apply to legitimate devices used by physically disabled persons, such as electric wheelchairs or scooters, when operated by a physically disabled person.
STREET
The part of any public road, street, highway or other public way that is open to traffic by motor vehicles.
VEHICLE
Any conveyance including motor vehicles, trailers of all types, campers, motorcycles, sleighs, pushcarts, horse-drawn conveyances or conveyances propelled by other than muscular power.

A person propelling a bicycle, motorized bicycle, or electric bicycle shall not ride other than astride a permanent and regular seat attached thereto. No bicycle, motorized bicycle, or electric bicycle shall be used to carry any person under the age of five (5) years unless equipped with a child's seat designed and manufactured for the purpose and properly attached. The use of tricycles shall not apply to this Section.

No person shall park a bicycle, motorized bicycle, or electric bicycle in such a manner as to constitute a hazard to pedestrians, traffic, or property.

Every bicycle, motorized bicycle, or electric bicycle shall be equipped with a brake or brakes which will enable its driver to stop the bicycle, motorized bicycle, or electric bicycle within twenty-five (25) feet from a speed ten (10) miles per hour on dry, level, clean pavement.

A. 
Every bicycle, motorized bicycle, or electric bicycle when in use on a street or highway during the period from one-half (½) hour after sunset to one-half (½) hour before sunrise shall be equipped with the following:
1. 
A front-facing lamp on the front or carried by the rider which shall emit a white light visible at night under normal atmospheric conditions on a straight, level, unlighted roadway at five hundred (500) feet;
2. 
A rear-facing red reflector, at least two (2) square inches in reflective surface area, or a rear-facing red lamp on the rear which shall be visible at night under normal atmospheric conditions on a straight, level, unlighted roadway when viewed by a vehicle driver under the lower beams of vehicle headlights at six hundred (600) feet;
3. 
Reflective material and/or lights on any part of the bicyclist's pedals, crank arms, shoes or lower leg visible from the front and the rear at night under normal atmospheric conditions on a straight, level, unlighted roadway when viewed by a vehicle driver under the lawful lower beams of vehicle headlights at two hundred (200) feet; and
4. 
Reflective material and/or lights visible on each side of the bicycle or bicyclist and visible at night under normal atmospheric conditions on a straight, level, unlighted roadway when viewed by a vehicle driver under the lawful lower beams of vehicle headlights at three hundred (300) feet. The provisions of this Subdivision shall not apply to motorized bicycles which comply with National Highway Traffic and Safety Administration regulations relating to reflectors on motorized bicycles.

Every person riding a bicycle, motorized bicycle, or electric bicycle upon a street or highway shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle as provided by Chapter 304, RSMo., and this Title, except as to special regulations in this Chapter, and except as to those provisions of Chapter 304, RSMo., and this Title, which by their nature can have no application.

Every person operating a bicycle, motorized bicycle, or electric bicycle at less than the posted speed or slower than the flow of traffic upon a street or highway shall ride as near to the right side of the roadway as safe, exercising due care when passing a standing vehicle or one proceeding in the same direction, except when making a left turn, when avoiding hazardous conditions, when the lane is too narrow to share with another vehicle, or when on a one-way street. Bicyclists may ride abreast when not impeding other vehicles.

Any person seventeen eighteen (18) years of age or older who violates any provision of this Chapter is guilty of an infraction and, upon conviction thereof, shall be punished by a fine of not less than five dollars ($5.00) nor more than twenty-five dollars ($25.00). If any person under eighteen (18) years of age violates any provision of this Chapter in the presence of a Peace Officer possessing the duty and power of arrest for violation of the general criminal laws of the State or for violation of ordinances of Counties or municipalities of the State, said officer may impound the bicycle, motorized bicycle or electric bicycle involved for a period not to exceed five (5) days upon issuance of a receipt to the child riding it or to its owner.
A. 
No person shall operate a motorized bicycle on any highways, streets or roads in this City unless the person has a valid license to operate a motor vehicle.
B. 
No motorized bicycle may be operated on any public thoroughfare located within this City which has been designated as part of the Federal interstate highway system.
No person shall operate a motorized bicycle on any highways, streets or roads in this City unless it is equipped in accordance with the minimum requirements for construction and equipment of MOPEDS, Regulation VESC-17, approved July, 1977, as promulgated by the Vehicle Equipment Safety Commission.

A. 
Reflective Clothing. No person shall walk or jog on any street in the City of Lake Saint Louis during the nighttime after sunset and before sunrise without wearing or carrying reflective clothing or reflective items. Such reflective clothing shall be adequate to reflect brightly the headlights from a motor vehicle, and the wearer shall have at least one (1) item of reflective clothing visible from in front and one (1) visible from the rear. In lieu of an item of reflective clothing, the wearer may wear or carry any device or decoration that is adequate to reflect or generate such light brightly. These requirements shall not apply to any person entering the street solely for the purpose of crossing the street or for the purpose of direct transport between their home and another location in the City.
B. 
Roadways, Sidewalks And Paths. Wherever possible, persons walking or jogging on any street in the City of Lake Saint Louis shall travel on the left side of the street facing oncoming traffic. Where available, sidewalks or paths are to be used rather than the street.

A. 
No person shall ride or operate a motorized play vehicle on any public street, highway, sidewalk, bike lane, or anywhere within the boundaries of a City park.
B. 
Responsibilities of parents, guardians, legal custodians and those having care, custody and control:
1. 
The parents, guardians, legal custodians or those having care, custody and control of any minor shall not authorize or knowingly permit such minor to violate any of the provisions of this Section.
2. 
If a fine is imposed upon a minor who is found to be in violation of this Section, the parents or legal guardian having custody or control of the minor shall be jointly and severally liable with the minor for payment of the fine, whether or not the parents or guardian knew of, or anticipated, a violation of this Section.

It shall be unlawful for any person to be upon bicycles, roller skates or skateboards or riding in or by means of any coaster, toy, vehicle, motorized scooter, motorized play vehicle, electric bicycle or similar device while in or upon any portion of any park playground or park pavilion unless specifically designated therefore; provided, however, this provision shall not apply to a show, exhibition, demonstration or other activity which is part of a special event being sponsored on park premises, nor shall this provision apply to child carrying devices such as baby strollers, carriages or wagons or to a person living with a disability.

A. 
Except as otherwise provided in this Section, every person riding an electric bicycle shall be granted all of the rights and shall be subject to all of the duties applicable to the operator of a bicycle. An electric bicycle shall be considered a vehicle to the same extent as a bicycle.
B. 
An electric bicycle or a person operating an electric bicycle is not subject to provisions of law that are applicable to motor vehicles, all-terrain vehicles, off-road vehicles, off-highway vehicles, motor vehicle rentals, motor vehicle dealers or franchises, or motorcycle dealers or franchises, including vehicle registration, certificates of title, drivers' licenses, and financial responsibility.
C. 
Beginning August 28, 2021, manufacturers and distributors of electric bicycles shall apply a permanent label to each electric bicycle. The label, which shall be affixed to the electric bicycle in a prominent location, shall contain the classification number, top assisted speed, and motor wattage of the electric bicycle. The text on the label shall be Arial font and in at least nine-point type.
D. 
No person shall tamper with or modify an electric bicycle so as to change the motor-powered speed capability or engagement of an electric bicycle unless he or she replaces the label required under Subsection (C) of this Section with a new label indicating the new classification.
E. 
An electric bicycle shall comply with the equipment and manufacturing requirements for bicycles adopted by the United States Consumer Product Safety Commission, 16 CFR 1512.
F. 
An electric bicycle shall operate in a manner so that the electric motor is disengaged or ceases to function when the rider stops pedaling or when the brakes are applied.
G. 
An electric bicycle may be ridden where bicycles are permitted to travel, subject to the following provisions:
1. 
A Class 1 or Class 2 electric bicycle may be ridden where bicycles are permitted;
2. 
A Class 3 electric bicycle may not be ridden on multi-use or bicycle paths.
H. 
The use of Class 3 electric bicycles shall be subject to the following provisions:
1. 
No person under sixteen (16) years of age shall operate a Class 3 electric bicycle. A person under sixteen (16) years of age may ride as a passenger on a Class 3 electric bicycle that is designed to accommodate passengers; and
2. 
All Class 3 electric bicycles shall be equipped with a speedometer that is capable of displaying the speed an electric bicycle is traveling in miles per hour.
