It is hereby determined that it is in the best interest of the Township and its residents that stormwater management facilities be properly maintained.

The Township shall have the duty, obligation and responsibility to keep in good order and repair and free from all obstruction and impediments all stormwater management facilities, including, but not limited to, inlets, pipes, detention and retention basins and headwalls, on Township property, under Township roads or in any Township right-of-way.

The owners and/or occupiers and/or homeowner's association of all lots or parcels of land on which there are constructed and/or located stormwater management facilities, including, but not limited to, inlets, pipes, detention and retention basins and headwalls, shall have the duty, obligation and responsibility to keep in good order and repair and free from all obstructions and impediments all such stormwater management facilities.

The provisions of Section 1230.19(h)(2), (3) and (4) of Title Four - the Subdivision and Land Development Regulations of Part Twelve - the Planning and Zoning Code are hereby incorporated herein by reference and made a part thereof.
