There is hereby adopted by the Township of Upper Providence
certain documents marked and designated as the International Property
Maintenance Code, 2021 Edition, as published by the International
Code Council, Inc., as the Property Maintenance Code of the Township
of Upper Providence; for regulating and governing the conditions and
maintenance of all property, buildings and structures; by providing
the standards for supplied utilities and facilities and other physical
things and conditions essential to ensure that structures are safe,
sanitary and fit for occupation and use; and the condemnation of buildings
and structures unfit for human occupancy and use; and the demolition
of such existing structures as herein provided; providing for the
issuance of permits and collection of fees therefore; and each and
all of the regulations, provisions, penalties, conditions and terms
of said Property Maintenance Code on file in the office of the Township
of Upper Providence are hereby referred to, adopted, and made a part
hereof, as if fully set out in this chapter, with the additions, insertions,
deletions and changes, if any, prescribed in this chapter.

Nothing in this chapter or in the Property Maintenance Code
hereby adopted shall be construed to affect any suit or proceeding
impending in any court, or any rights acquired, or liability incurred,
or any cause or causes of action acquired or existing, under any act
or ordinance repealed as cited in Section 3 of Ordinance 445; nor
shall any just or legal right or remedy of any character be lost,
impaired or affected by this chapter.

The International Property Maintenance Code, as adopted in Section
1460.01, is hereby amended as follows:
(a) Section 101.1. Insert: "Township of Upper Providence."
(b) Section 103.1. Insert: "Code Administration Department"
(c) Section 104.1. Add the following at the end of the existing text:
"The fees shall be in amounts as established, from time to time, by
resolution of the Township Council of the Township of Upper Providence."
(d) Section 110.4. Add the following at the end of the existing text: "Any person, partnership or corporation who shall violate a provision of this Code or shall fail to comply with any of the requirements thereof, upon being found liable therefor in an enforcement proceeding commenced by the municipality, pay a judgment as provided in Section
202.99(a) of the Administrative Code, including reasonable attorney fees incurred by the Township as result thereof, and, in default of payment of any such fines and costs, imprisonment as provided in Section
202.99(c) of the Administrative Code."
(e) Section 302.4. Insert: "Eight inches." Add the following at the end
of the existing text: "No grass or weed clippings shall be deposited
into the street."
(f) Section 304.2. Protective treatment. Add the following at the end
of the existing text: "All products such as building wrap, vapor barrier,
weatherization barrier, house wrap or other similar products (known,
for example, by such trade name as Tyvek), shall not remain uncovered
on exterior surfaces for a period in excess of three months. All building
wrap, vapor barrier, weatherization barrier, house wrap or other similar
products shall be covered within the three-month period with an exterior
building cover product such as siding, stucco, stone, brick."
(g) Section 507.1 Storm drainage, general. Amend to read: "Drainage of
roofs and paved areas, yards and courts, and other open areas on the
premises, and the discharge from sump pumps, shall not be discharged
in a manner that creates a public nuisance."
(h) Section 304.14. Shall be amended to require screens for the entire
year.
(i) Section 602.3. Insert: "October 1 to April 30."
(j) Section 602.4. Insert: "October 1 to April 30."
