Nothing contained in this plan shall give any employee the right
to be retained in the employment of the employer or any of its subsidiaries
or any affiliated or associated corporation or affect the right of
any such employer to dismiss any employee. The adoption and maintenance
of the plan shall not constitute a contract between the employer and
any employee or consideration for, or an inducement to or condition
of, the employment of any employee.

The trust shall be the sole source of benefits under the plan,
and the employer and the trustee assume no liability or responsibility
for payment of such benefits. Each member, beneficiary or other person
who shall claim the right to any payment under the plan shall be entitled
to look only to the trust for such payment and shall not have any
right, claim or demand therefor against the employer, the trustee
or any member thereof, or any employee of the employer.

In the event that any provision, section, sentence, clause or
part of this chapter shall be held to be invalid, such invalidity
shall not affect or impair any remaining provision, section, sentence,
clause or part of this chapter, it being the intent of the employer
that such remainder shall be and shall remain in full force and effect.

The passage or amendment of this chapter and the repeal by it
of any prior enabling ordinance or resolution relating to the establishment
and regulation of a Nonuniformed Employees' Pension Plan (previously
the Municipal Employees' Pension Plan) of the Township of Upper
Providence, Delaware County, Pennsylvania, shall not invalidate the
trustee created under such ordinance or resolution, nor shall it invalidate
any actions of said trustee taken under such ordinance or resolution.
This chapter, in such respect, shall be deemed a continuation and
codification of such prior enabling ordinances and resolutions.

This chapter represents a codification of the ordinances of
the employer relating to the Nonuniformed Employees' Pension
Plan (previously the Municipal Employees' Pension Plan) and may
be advertised as such.
