A. Regulations, Fees And Specifications.
1. All new services shall be metered including private fire service
connections of the so called "dry" type and the Water Department shall
have the right to place a meter on any existing service pipe and charge
for water service by meter measurement.
2. Application for new street service connection or application for
water service through an existing street service connection may be
made in person at the City Hall or by letter from the prospective
customer.
3. All fees for street service connections shall be paid in advance
of work to be ordered.
4. Each premise shall be supplied through a separate connection to the
main.
5. The meters used by the Water Department shall remain its property
and the owners of premises wherein they are located shall be held
responsible for their safekeeping and liable for any damage thereto
resulting from the carelessness of said owner, his/her agent or tenant
and for failure to protect same against freezing and/or damage by
excessive heat. The Water Department may refuse to supply water until
such damage is paid.
6. All meters, including private fire service meters, shall be purchased
from, installed, maintained and removed by the Water Department and
shall remain its property.
7. When a meter is installed between the curb line and sidewalk, it
shall be placed in a meter box or vault in accordance with specification
of the Water Department.
8. All street service connection shall be laid to provide a minimum
cover of forty-two (42) inches and shall conform to future grade of
any street where such grade has been established by City ordinance.
9. The Water Department shall not permit a street service connection
until the customer's service pipe is installed in accordance with
existing Plumbing Codes and Water Department specifications.
10. The customer's service pipe between the property line and the structure
on the premise to be supplied shall be furnished and installed by
the customer at his expense and risk. The pipe shall be of a size
not smaller than the street service pipe and the minimum size shall
be three-quarter (¾) inch. The pipe shall be of ample strength
to withstand water pressure at the point where located and shall be
of type "K" copper.
11. Customer service pipe shall include the connection to the street
service pipe and all liability after construction for such connection
shall be that of the customer.
12. There shall be a charge for any new service connection to a main

13. Excavation for meter set, boring under road and location of other
utilities shall be the liability of the customer. Any necessary road
boring shall conform to the size of service needed and specifications
of that particular right-of-way used. All settings of the meter setter
and connections to the meter setter and tapping saddle and setting
of the meter box will be the responsibility of the customer and/or
his contractor.
14. City of Kearney Water Department right-of-way specifications shall
be:
a. Requirement of a two hundred fifty dollar ($250.00) bond until right-of-way
is put back to original condition or better at the expense of customer.
b. Inspection of right-of-way will occur within two (2) weeks of excavation.
Inspection will be made by Water Superintendent or his agent.
c. After inspection, bond will be returned or forfeited, if work is
unacceptable, by use of a signed inspector's card returned to the
City Clerk.
d. When bond is returned or forfeited, customer is released of further
liability for right-of-way excavation.
e. Additional bond may be required by the Street Department if street cut is needed according to Sections
510.020 to
510.070 of this Code.
15. All customer service pipes hereafter shall be laid to provide a minimum
cover of not less than thirty-six (36) inches. The service pipe shall
be placed on firm and continuous earth so as to give unyielding and
permanent support and shall be installed in a trench at least four
(4) feet in a horizontal direction from any other trench wherein are
laid gas pipes and ten (10) feet from any sewer pipes or other facilities,
public or private, unless otherwise specifically authorized and approved
by the Water Department.
16. In the interest of public health, the Water Department cannot allow
its mains or services to be connected on any premise with any service
pipe or piping which is connected with any other source of water supply.
It also cannot allow its mains or service pipes to be in any way connected
to any tank, vat or any other apparatus which contains or may contain
liquid which may back feed therefrom. The Water Department may refuse
to provide service to any premise having such connections until any
and all such conditions are terminated.
17. If customer causes change requiring relocation of main and/or meter
box and/or service connection, he shall bear expense with installation
to be approved by Water Department.
18. No attachment to the customer's service pipe shall be made between
the meter and the street main.
19. Meter box or vault shall not be placed in driveway without consent
of Water Department.
20. Service shall not commence until necessary deposit is made to City
Clerk.
21. Customer or subcontractor shall give forty-eight (48) hour notice
to Water Superintendent prior to any excavation being started and
water or sewer line being exposed. The Water Superintendent will schedule
a mutually agreed time for the water tap and/or sewer inspection to
be performed by City personnel. Customer shall be responsible for
exposing and preparing the work site prior to scheduled time of water
tap. Additional wait over fifteen (15) minutes shall be billed at
an hourly rate of forty-five dollars ($45.00) per hour, in addition
to any other stated fees and charges.
22. "Customer", as used in this policy, shall mean the
builder and/or plumber who authorizes the Water Department to perform
said work.
23. The term "right-of-way", as used this policy, will refer to the area
between the back of curb and the front of the sidewalk which is the
area where the water meter set will be installed.
24. The customer and/or subcontractor shall be responsible for any damages
to the water meter pit or meter set or water meter during construction
and shall be responsible for repairs or costs of repairs at the discretion
of the Water and Sewer Superintendent.
B. Water Department Suggested Procedure To Obtain Meter Set And Service.
1. Application made in person or in writing at City Hall.
2. Application approved or denied by Water Department with necessary
fees to be set by same according to preceding rules.
3. When all fees are paid in advance of work required, work order will
be issued to the Water Department.
4. Upon receipt of forty-eight (48) hours' notice, work will be scheduled.
5. Right-of-way inspection to follow completion of meter set.
6. Be sure grade of yard is shown before meter set installation. City of Kearney Water Department will not be responsible for changes in meter lid set pursuant to Subsection
(A)(11) and Subsection
(A)(17).
