A. The
following is hereby adopted as the Water Conservation Plan (hereinafter
referred to as the plan).
1. The use of water from the City's water supply system for the purposes
of sprinkling or watering lawns, the filling of swimming pools and
the non-commercial washing of cars is non-essential to the health,
safety and welfare of the residents of the City of Kearney, Missouri.
For the purposes of this Section, "lawns" shall be
that portion of any land under cultivation with grass, trees, shrubs,
bushes or any type of vegetation.
2. When the Superintendent of Water certifies in writing that the static
ground water level at City Well No. 4 is twenty (20) feet or less
or that water pressure as measured at the high point of the City's
water system is twenty-five (25) pounds or less, then:
a. All properties of the City which have a street address which ends
in an odd number shall water the lawn, shrubs and gardens located
on such property only on odd-numbered calendar days at anytime during
that twenty-four (24) hour period.
b. All properties in the City which have a street address which ends
in an even number shall water the lawn, shrubs and gardens located
on such property only on even-numbered calendar days at anytime during
that twenty-four (24) hour period.
3. If the Superintendent of Water certifies in writing to the City that
either the static ground water level at City Well No. 4 is sixteen
(16) feet or lower or that the pressure as measured at the high point
of the City's system is twenty (20) pounds or less, then there shall
be, in addition to the watering of lawns as above set out, no filling
of swimming pools or non-commercial washing of cars and the Superintendent
of Water shall restrict the sale of bulk water to purchasers for their
personal household use only.
4. If the water level or water pressure of the City continues to worsen
after the above measures are imposed, the Mayor may declare a state
of emergency exists and impose such reasonable rules and regulations
as are necessary which shall be communicated to the public.
5. Any person who shall violate any of the provisions of this plan shall
be subject to a fine of not more than five hundred dollars ($500.00).
Each day that a violation exists or continues or each time a violation
continues after delivery of an order to terminate such violation to
the owner/occupant of such property shall be a separate ordinance
violation hereunder. The City may terminate the water supply to any
property on which a violation hereof continues after delivery of an
order to terminate such violation is made to the owner/occupant of
such property.
