All swimming pools hereinafter erected or now in existence capable
of containing a depth of water exceeding 24 inches at one point shall
be completely surrounded by a fence or wall not less than three feet
in height. The intent and purpose of such enclosure shall be to prevent
the accidental drowning of or injury to small children and to secure
the safety of all pool users.
All gates and openings through such enclosure shall be not less
than the same height as the fence or wall and shall be equipped with
a self-enclosing and self-latching device placed three feet above
the ground or otherwise made inaccessible from the outside to small
children.
Permits for the erection of said swimming pool must be obtained
from the Building Inspector.
For the purpose of this bylaw, a swimming pool shall be considered
a structure and must meet public health and safety standards while
being consistent with the requirements of zoning and building regulations
approved and adopted by the Town of Mansfield and approved by the
Commonwealth of Massachusetts.
A. Existing pools must have fence installation completed prior to use
for 1973 summer swimming or completed by June 30, whichever occurs
sooner.
B. This bylaw shall not apply to aboveground swimming pools.
