There is hereby created the office of City Counselor.

The City Counselor shall be appointed by the Mayor, with the approval of the City Council, and shall be subject to removal by the same terms and conditions as set out in Section
115.090. The term of office for the City Counselor shall be indefinite.

The City Counselor shall be a person duly licensed to practice
law in the State, shall be a qualified voter under the laws and Constitution
of this State, this Code, and other ordinances of the City, and shall
be a resident of the City of Farmington.

A. It
shall be the duty of the City Counselor to:
1. Draft all ordinances, contracts and legal forms of every kind which
may be requested on behalf of the City by the Mayor or the City Council;
2. Give legal advice to the Council and other officers of the City on
matters relating to the City;
3. Represent the City in all suits in the Circuit and Appellate Courts
of this State and before all boards, bureaus and commissions of the
State, except in such cases as may arise in the Circuit or Appellate
Courts of this State on appeal from the Municipal Court;
4. Assist the City Attorney in the trial of any appeal from the Municipal
Court to the Circuit or Appellate Court where the legality or validity
of any Section of this Code or any other ordinance of the City is
an issue; and
5. Review in the first (1st) instance all violations of the Sections
of this Code and any other ordinances pertaining to planning and zoning,
and subdivisions.
