There is hereby created the office of Fire Chief of the Fire
Department of the City.

A.
The
Fire Chief shall have command of the Fire Department and shall exercise
a constant supervision over the same, taking care that each member
of the department is properly trained and drilled in the manner of
discharging the duties that may be assigned to him/her.
B.
The
Fire Chief shall make inspections of all the fire hydrants within
the City and see that they are, at all times, in good repair and ready
for use. He/she shall, in like manner, inspect all engines, pumps,
hose carriages, hose, hook and ladder apparatus and trucks and every
description of fire apparatus used by the City and see that the same
are carefully preserved and kept in good condition for use in case
of fire.
C.
The
Fire Chief shall have general charge and custody of all fire stations
and of all property of the City in the possession of the Fire Department
and shall take care that all such property is always kept in good
condition and repair and ready for immediate use. All such equipment
shall at all times remain the property of the City.
D.
The
Fire Chief, Assistant Chief and Captain shall attend all fires in
the City as far as practicable, and all orders given by him/her to
the Fire Department or any member thereof shall be promptly obeyed
by the department or member. He/she may prescribe the limits in the
vicinity of a fire within which no person, except those who reside
therein, members of the Fire Department and those admitted by order
of an officer of the department, shall be permitted; and it shall
be the duty of the Chief of Police and of every Policeman of the City
to aid him/her in carrying into effect the provisions of this Subsection.
E.
The
Fire Chief shall at all fires have the same Police authority that
is vested with the Chief of Police and may command such assistance
from the inhabitants of the City as may be required for the suppression
and extinguishment of fires.
F.
The
Fire Chief shall summarily decide all questions, disputes or controversies
arising in the Fire Department among either officers or men when the
department is on duty.

A.
The
Farmington Fire Department shall have a paid Fire Chief, Assistant
Fire Chief and Captain. These persons will serve as shift supervisors
for the three (3) shifts of fire personnel. These positions will be
paid a set salary which will be determined by the City Council. Their
duties shall include responding to all calls during their shift and
supervision for personnel, full-time and volunteer, during that shift.
They will complete required daily administrative duties and assist
fire personnel in daily duties set forth by the Fire Chief or his/her
designee. They will respond to all calls for assistance by the Farmington
Fire Department or other departments requiring assistance, call outs,
meetings and training during scheduled days off, when available. In
the absence of any full-time personnel during a scheduled shift, an
off-duty supervisor as named above will be required to fill that position
until volunteer personnel is found as a replacement or that shift
ends.
In addition to the aforementioned shift supervisors, the Farmington
Fire Department shall have personnel who will serve with the title
of firefighter. The duties of these personnel will be to respond to
all calls during their scheduled shift and perform all daily duties
set forth by the Fire Chief or his/her designee. They will respond
to all structure fires within the City of Farmington during their
scheduled days off, when available, with compensation. They will attend
all training and meetings during their scheduled days off, when available,
without compensation.
B.
The
Fire Chief and City Administrator will consult and appoint a number
of discreet, competent and able-bodied persons to form a good and
sufficient full-time Fire Department. If there are personnel meeting
this criteria within the staff of the volunteer personnel, they will
be promoted from part-time status to full-time status. If there are
no personnel meeting this criteria, applications will be accepted
from non-volunteer members and the Fire Chief and City Administrator
will consult and appoint a discreet, competent and able-bodied person
to the available position(s). The persons so appointed, together with
the Fire Chief and volunteer personnel, shall constitute the Farmington
Fire Department.
C.
The
Farmington Fire Department shall have an adequate number of paid personnel
to maintain a minimum of three (3) personnel per shift with a total
of three (3) shifts. A minimum of six (6) firefighters and three (3)
shift supervisors will be maintained at all times. The Farmington
Fire Department shall additionally have a volunteer staff of fire
personnel not to exceed thirty (30) persons.
D.
All
full-time fire personnel shall be required to work twenty-four (24)
hour shifts. These shifts shall follow a rotation set forth by the
Fire Chief or his/her designee and will allow for continuous coverage
of the City of Farmington. While on shift these personnel will be
required to remain in station or with their assigned apparatus at
all times. The Farmington Fire Department Operating Guidelines will
set forth a daily routine that will be followed by all personnel on
shift.

Chief of the Fire Department shall, in the discharge of his/her
duties, be subject to the orders of the Mayor and the City Administrator,
in his/her capacity as the designee of Mayor, only; all other members
of the Fire Department shall be subject to the orders of their superiors
in the Fire Department and the Mayor only.

After his/her appointment to the Fire Department, a fireman
shall serve an eighteen (18) month probationary period. This probationary
period, or working test period, shall be regarded as an integral part
of the examination process and the probationary fireman shall not
be deemed to be a member of the Fire Department or permanent employee
of the City. A review of the fireman's work shall be made before expiration
of the probationary period.

All members of the Farmington Fire Department will obey the
chain of command set forth by the Farmington Fire Department. The
chain of command will be as follows: Fire Chief, Assistant Fire Chief,
Captain, senior firefighter and firefighter. In the absence of a shift
supervisor, a senior firefighter will act as shift supervisor until
replaced or relieved by a superior officer. A senior firefighter will
be appointed on each shift by the Fire Chief or his/her designee.
In the event of the absence of a superior officer and senior firefighter,
the firefighter with the most seniority will act as supervisor. Volunteer
fire personnel who have been assigned as Fire Department officers
may assume the role of shift supervisor, in the supervisor's absence,
if they are assigned to work that shift. All fire personnel, paid
and volunteer, must follow the operating guidelines set fort by the
Farmington Fire Department. These guidelines are prepared by the Fire
Chief or his/her designee and will be updated as the situation requires.
Failure to follow these guidelines or directives from a superior officer
may result in disciplinary action or termination.

The Farmington Fire Department supervisors, Fire Chief, Assistant
Fire Chief and Captain shall work the required amount of hours to
complete their duties as set forth by ordinance without any additional
compensation above their set salary. Personnel in the position of
firefighters will receive a set hourly wage determined by the City
Council. They may work one hundred six (106) hours biweekly without
overtime compensation, any hours worked above one hundred six (106)
bi-weekly will be paid at time and a half. These personnel will be
compensated at the rate of time and a half for responding to structure
fires within the City of Farmington during scheduled days off. All
personnel will be compensated accordingly by the City of Farmington
for working on City holidays as set forth by the City Council. Volunteer
fire personnel will be paid hourly at the rate of pay set forth by
the City Council for responding to calls for assistance or working
a shift for an absent full-time employee. No overtime pay or holiday
compensation shall be given to volunteer fire personnel.

In the absence of the Fire Chief, or if for any cause he/she
is unable to discharge the duties of his/her office, the assistant
Fire Chief shall become the Fire Chief, subject to the approval of
the City Council. He/she shall perform all the duties and have all
powers of the office, pending such absence or other disability of
the regularly appointed Fire Chief.

Compensation of Fire Chief, Assistant Fire Chief, and all other
members of the Fire Department, including those reserve volunteers,
shall be determined each year by ordinance by the City Council.

A.
The
coverage for said voluntary members shall be:
1.
Payment of four hundred fifty dollars ($450.00) per week for four
(4) weeks and up to four hundred fifty dollars ($450.00) per week
starting with week five (5).
2.
As an additional rider to the proposed coverage, the employee shall be paid three hundred dollars ($300.00) week if hospitalized in addition to benefits set out in Subsection (1) of this Section.
3.
Annual first (1st) year premium three thousand four hundred seven
dollars ($3,407.00).
