A. 
The City of Bowling Green is hereby divided into three (3) Wards, the lines and boundaries thereof are as follows:
1. 
Ward I. Beginning at a point on the west corporate City limits where the railroad tracks intersect said west corporate City limits, thence along the center of the railroad tracks in an easterly direction to the center of Business Highway 61, thence south along the centerline of Business Highway 61 to its intersection with the centerline of Champ Clark Drive, thence easterly along the centerline of Champ Clark Drive to its intersection with the west right-of-way line of Hickman Drive, thence north along the west right-of-way line of Hickman Drive to the corporate City limits line, thence westerly following said corporate City limits line at times north, south and west to the point of beginning. Also included in Ward I is all property annexed into the City limits adjoining Ward I which is generally described as the North East Correctional Center property and highway right-of-way thereto and the True Manufacturing property and highway right-of-way thereto.
2. 
Ward II. Beginning at the intersection of the centerlines of Champ Clark Drive and Business Highway 61, thence east along Champ Clark Drive to the west right-of-way line of Hickman Drive, thence north along the west right-of-way line of Hickman Drive to the corporate City limit line and following the corporate City limit line around and encompassing the Wayne Dale Subdivision to the City and continue to follow said corporate City limit line in an easterly and southerly direction to the southeast corner of the corporate City limits, thence west along the corporate City limit line to a point where the corporate City limits turn north, thence north along said City limit line in a straight line as extended to the centerline of Business Highway 61, thence along the centerline of Business Highway 61 to the intersection of the centerline of Champ Clark Drive being the point of beginning.
3. 
Ward III. Beginning at a point on the west corporate City limit line where the railroad tracks intersect same, thence in a southerly direction along the west corporate City limit line to the southwest corner of the corporate City limits being a point on the south right-of-way line of West Adams Street, thence east along the corporate City limit boundary line to a point where the corporate City limit line turns south at the intersection with South 11th Street, thence follow the corporate City limit line in a southerly direction to its point of intersection with the boundaries of Ward II as aforestated, thence north to the centerline of Business Highway 61, thence northerly along the centerline of Business Highway 61 to its point of intersection with the center of the railroad tracks, thence westerly along the center of the railroad tracks to the point of beginning.

The general election for the City of Bowling Green shall be held on the first (1st) Tuesday after the first (1st) Monday in April of each year. The offices of Mayor, Collector and one (1) Alderman from each of the three (3) Wards of said City shall be chosen at the general election to be held in the even-numbered years beginning with the year 1972 and every two (2) years thereafter and shall serve a term of two (2) years or until his/her successor shall be elected and qualify. On the odd-numbered years beginning with the year 1973, one (1) Alderman from each of the three (3) Wards of the said City shall be elected at such general election to be held in the odd-numbered year to serve a term for two (2) years or until their successor shall be duly elected and qualify.

All candidates for elective City offices of the City of Bowling Green, Missouri, are hereby required to complete a declaration of candidacy to be provided at the office of the City Hall in the City of Bowling Green, Missouri, and are to be filed with the City Clerk of said City at City Hall together with a filing fee of five dollars ($5.00) in order for each candidate's name to be placed on the ballot for such election. Said declaration of candidacy shall be in writing on a form provided by the City Clerk and shall contain the name of the candidate, his/her residence, age, occupation, length of time that he/she has been a resident of the City of Bowling Green and the office for which he/she is a candidate and shall be signed by the candidate.

All declarations of candidacy for City offices may be filed with the City Clerk beginning at 8:00 A.M. on the 17th Tuesday prior to the election date and no later than 5:00 P.M. on the 14th Tuesday prior to the election date. The City Clerk shall provide the ballot language to the election authority at least thirteen (13) Tuesdays prior to the election date.

A. 
No person shall qualify as a candidate for elective public office in the state of Missouri who has been found guilty of or pled guilty to a felony or misdemeanor under the Federal laws of the United States of America or to a felony under the laws of this State or an offense committed in another State that would be considered a felony in this State.
B. 
Regarding Delinquent Taxes.
1. 
Any person who files as a candidate for election to a public office shall be disqualified from participation in the election for which the candidate has filed if such person is delinquent in the payment of any State income taxes, personal property taxes, municipal taxes, real property taxes on the place of residence, as stated on the declaration of candidacy, or if the person is a past or present corporate officer of any fee office that owes any taxes to the State.
2. 
Each potential candidate for election to a public office shall file an affidavit with the Department of Revenue and include a copy of the affidavit with the declaration of candidacy required under Section 115.349, RSMo. Such affidavit shall be in substantially the following form:

I hereby declare under penalties of perjury that I am not currently aware of any delinquency in the filing or payment of any State income taxes, personal property taxes, municipal taxes, real property taxes on the place of residence, as stated on the declaration of candidacy, or that I am a past or present corporate officer of any fee office that owes any taxes to the State, other than those taxes which may be in dispute. I declare under penalties of perjury that I am not aware of any information that would prohibit me from fulfilling any bonding requirements for the office for which I am filing.

Upon receipt of a complaint alleging a delinquency of the candidate in the filing or payment of any State income taxes, personal property taxes, municipal taxes, real property taxes on the place of residence, as stated on the declaration of candidacy, or if the person is a past or present corporate officer of any fee office that owes any taxes to the State, the Department of Revenue shall investigate such potential candidate to verify the claim contained in the complaint. If the Department of Revenue finds a positive affirmation to be false, the department shall contact the Secretary of State, or the election official who accepted such candidate's declaration of candidacy, and the potential candidate. The department shall notify the candidate of the outstanding tax owed and give the candidate thirty (30) days to remit any such outstanding taxes owed which are not the subject of dispute between the department and the candidate. If the candidate fails to remit such amounts in full within thirty (30) days, the candidate shall be disqualified from participating in the current election and barred from refiling for an entire election cycle even if the individual pays all of the outstanding taxes that were the subject of the complaint.

The City Clerk shall, on or before the 17th Tuesday prior to any election at which City offices are to be filled by said election, notify the general public of the opening filing date, the office or offices to be filled, the proper place for filing, and the closing filing date of the election. Such notification may be accomplished by legal notice published in at least one (1) newspaper of general circulation in the City.
In City elections, the City Clerk shall notify the County Clerk prior to 5:00 P.M. on the tenth (10th) Tuesday prior to any City election except as noted in Section 115.125.1, RSMo. The notice shall be in writing, shall specify that the Board of Aldermen is calling the election, the purpose of the election, the date of the election, and shall include a certified copy of the legal notice to be published including the sample ballot. The notice and any other information required by this Section may, with the prior notification to the election authority receiving the notice, be accepted by facsimile transmission prior to 5:00 P.M. on the tenth (10th) Tuesday prior to the election, provided that the original copy of the notice and a certified copy of the legal notice to be published shall be received in the office of the election authority within three (3) business days from the date of the facsimile transmission.
