There is hereby created a Fire Department in the City of Bowling
Green, Missouri, for general fire protection and for safeguarding
the lives and property of the citizens in case of fire, to be officered
and managed by a Fire Chief and Deputies as hereinafter provided.

The Mayor, with consent and approval of a majority of the members
elected to the Board of Aldermen, shall appoint some suitable person
to the office of Chief of the Fire Department; said appointment to
be made at the same time and in the same manner as other appointive
officers of the City and, unless sooner removed, shall hold his/her
office for the term of two (2) years or until his/her successor is
appointed and qualified. No person shall be appointed to the office
of Chief of the Fire Department who shall not, at the time of his/her
appointment, be a qualified voter under the laws of the State of Missouri.
Before entering upon the duties of his/her office, he/she shall take
and subscribe to the oath or affirmation required of other City Officers.

A.
The
Chief of the Fire Department shall be the legal custodian of the fire
truck, hose, ladders and any other apparatus or equipment belonging
to the City and it shall be his/her duty to constantly keep all such
equipment clean, in thorough repair and at all times be ready for
action.
B.
He/she
shall prepare and update needed fire plans for emergencies. It shall
be the responsibility of the Chief of the Fire Department to prepare
or have prepared all reports, training schedules, attendance logs
or other records and to have them filed with the City Clerk.

A.
The
Chief of the Fire Department, upon entering upon the duties of his/her
office, shall, by and with the consent of the Mayor and Board of Aldermen,
appoint up to five (5) officers, Assistant Chief, 1st Captain, 2nd
Captain, 1st Lieutenant and 2nd Lieutenant who shall assist him/her
in the performance of his/her duties at fires, who shall rank in order
of appointment as assistants, one (1) being the Assistant Chief, then
Captains and then Lieutenants who shall whenever necessary in the
absence of the Chief perform all the duties of the Chief of the Fire
Department.
B.
Responsibilities
of the Officers shall be as follows:
Assistant Chief shall be capable of filling the role of any
officer of the department. When the Assistant Chief is the highest-ranking
officer on the scene of an incident, he/she shall be responsible to
complete the Incident Report immediately following the mitigation
of any incident. The Assistant Chief shall be the public liaison for
the Knox Box™ program in the City. This officer will be registered
with Knox Company and capable of assisting the public in purchasing
and locking/unlocking of the Knox Box™. The Assistant Chief
shall serve as the representative to the Fire Department for any meetings,
events or tasks that the Chief delegates to the Assistant Chief or
that the Chief is unable to attend. The Assistant Chief shall be responsible
for assisting in the research, writing, and implementation of Standard
Operating Guidelines (SOG's). The Assistant Chief shall be responsible
to complete any and all other tasks assigned to him/her by the Chief.
1st Captain shall be capable of filling the role of any officer
of equal or lesser rank and shall be capable of filling the role of
the Chief in his/her absence. When the 1st Captain is the highest-ranking
officer on the scene of an incident, he/she shall be responsible to
complete the Incident Report immediately following the mitigation
of any incident. The 1st Captain shall be responsible for all apparatus
and equipment inspections and maintenance, scheduling apparatus for
service when requited, completing any service that is requited on
his/her own to the satisfaction and standard of the Chief and the
department. The 1st Captain shall be responsible to log all maintenance
and repairs in the apparatus logs. 1st Captain shall be responsible
for assisting in the research, writing, and implementation of Standard
Operating Guidelines (SOG's). The 1st Captain shall be responsible
to complete any and all other tasks assigned to him/her by the Chief
or Assistant Chief.
2nd Captain shall be capable of filling the role of any officer
of equal or lesser rank and shall be capable of filling the role of
the Chief in his/her absence. When the 2nd Captain is the highest-ranking
officer on the scene of an incident, he/she shall be responsible to
complete the Incident Report immediately following the mitigation
of any incident. The 2nd Captain shall be responsible for all Public
Relations (PR) events. Duties, include, but are not limited to, scheduling
PR, recruiting firefighters to complete PR, and ensuring PR is carried
out in a manner that positively promotes and represents the Fire Department
· The 2nd Captain shall be responsible for assisting in the
research, writing, and implementation of Standard Operating Guidelines
(SOG's). The 2nd Captain shall be responsible to complete any and
all other tasks assigned to him/her by the Chief or Assistant Chief.
Despite being assigned a title of "1st Captain"; and "2nd Captain,"
both Captains shall be of equal rank.
1st Lieutenant shall be capable of filling the role of equal
or lesser rank and shall be capable of filling the role of the Chief
in his/her absence. When the 1st Lieutenant is the highest-ranking
officer on the scene of an incident, he/she shall be responsible to
complete the Incident Report immediately following the mitigation
of any incident. The 1st Lieutenant shall be responsible for department
training and safety. Duties include but are not limited to; planning,
scheduling, and ensuring that monthly training is carried out in an
appropriate manner that ensures safe and effective training of all
members of the department on a regular basis. All training events
shall be documented by the 1st Lieutenant The 1st Lieutenant shall
be responsible for assisting in the research, writing; and implementation
of Standard Operating Guidelines (SOG's). The 1st Lieutenant shall
be responsible to complete any and all other tasks assigned to him/her
by the Chief, Assistant Chief, or Captains.
2nd Lieutenant shall be capable of filling the role of equal
or lesser rank and shall be capable of filling the role of the Chief
in his/her absence. When the 2nd Lieutenant is the highest-ranking
officer on the scene of an incident, he/she shall be responsible to
complete the Incident Report immediately following the mitigation
of arty incident. The 2nd Lieutenant shall be responsible for Department
training and safety. Duties include but are not limited to; planning,
scheduling and ensuring that monthly training is carried out in an
appropriate manner that ensures safe and effective training of all
members of the department on a regular basis. All training events
shall be documented by the 2nd Lieutenant. The 2nd Lieutenant shall
be responsible for assisting in the research, writing, and implementation
of Standard Operating Guidelines (SOG's). The 2nd Lieutenant shall
be responsible to complete any and all other tasks assigned to him/her
by the Chief, Assistant Chief, or Captains.
Despite being assigned a title of "1st Lieutenant" and "2nd
Lieutenant," both Lieutenants shall be of equal rank.
C.
The
Chief is not required to appoint all of the officer positions within
the department. The appointments are at the discretion of the Chief
and the consent of the Mayor and Board of Aldermen.

During the progress of a fire, the Chief of the Fire Department
and his/her officers shall have sole control of the fire scene, fire
truck and other fire apparatus of the City and shall have the power
to call to his/her aid and assistance in fighting and controlling
any fire every able-bodied citizen of the City present between the
ages of eighteen (18) and fifty (50) years of age.

Able-bodied citizens having all the qualifications heretofore
prescribed for the Chief of the Fire Department to the number of not
to exceed twenty (20) may be enlisted by the Chief as members of the
Fire Department and shall, after enlistment, regularly attend regularly
scheduled training sessions and sign roll of attendance at fire calls,
a duplicate of which shall be filed with the Clerk of the City and
shall be revised and corrected each month, hold their positions during
the term of said Chief unless sooner discharged by him/her; provided,
however, that every able-bodied citizen between the age of eighteen
(18) and fifty (50) years of age present at any fire in the City limits
shall be subject and obedient to the orders of the Chief of the Fire
Department and his/her regular Deputies in crowd control and in the
removal and protection of property, and in case any such person shall
refuse to obey such orders, he/she shall, on conviction thereof, be
punished by a fine of not less than five dollars ($5.00) nor more
than twenty-five dollars ($25.00). An employee of the City of Bowling
Green, Missouri, may be a member of the Fire Department upon approval
of the City Administrator, in writing, in consultation with the employee's
department head and Fire Chief. City employees who are called away
from their regular City service to respond to duty as a volunteer
firefighter shall be paid at their regular rate of compensation for
such absence.

Applicants shall submit an application to become a member of
the Fire Department to the Fire Chief, which shall be submitted to
and reviewed by the City Administrator for approval. Applicants shall
be approved based on applicants meeting the required qualifications.
Eligible applicants shall be eighteen (18) years of age and older,
available to attend fire calls and training sessions and shall have
a valid Missouri driver's license as required.

A.
Any
member resigning from the Fire Department shall notify the Chief in
writing and shall return all equipment of the City to the Chief or
his/her designee.
B.
Members
may be dismissed by the Mayor, City Administrator or Fire Chief for
the following:
1.
Violation of City ordinances and absenteeism from regular or training
session of twenty-five percent (25%) or more during a calendar year
unless excused by the Chief or being absent from emergency calls of
more than fifty percent (50%) for the calendar year without being
excused by the Chief or other just cause. If being dismissed, member
shall be notified in writing of dismissal and shall return all City-owned
equipment and property in their possession immediately.

A.
There
shall he established two (2) regular meetings per month for the purpose
of training, business and equipment maintenance. Meetings shall start
at 7:00 P.M. unless otherwise arranged by the Fire Chief. Attendees
shall sign an attendance record to be presented to the City for payment
of attendance. Meetings shall not be held to a minimum or maximum
period, rather will continue until all training, business, or equipment
maintenance is complete to the satisfaction of the Fire Chief or highest-ranking
officer present.
B.
There
shall be established a maximum of twelve (12) work sessions per fiscal
year for the purpose of training, business, equipment maintenance,
business/facility pre-plans and inspections, or any other tasks deemed
necessary by the Fire Chief. Work sessions will be scheduled as needed
by the Fire Chief and communicated to the other members of the Fire
Department. Work sessions shall be limited to two (2) hours minimum
and three (3) hours maximum per work session. Members must be present
for the entire duration of the work session to receive compensation.

Every member of the Fire Department responding to a fire call
shall respond with proper bunker gear before engaging in fire fighting
activities or emergency situations, failure to do so will not be considered
as attendance.

A.
Compensation of members shall be established for meetings, work sessions,
response to incidents, and officer's salaries. Compensation shall
be paid on attendance by members for meetings, work sessions, and
response to incidents. Members must be present for the entire duration
of any meeting, work session or response to incident to receive compensation,
unless otherwise approved by the Chief or Assistant Chief. If a member
must leave a meeting, work session, or incident response early for
extenuating circumstances, the member shall be compensated at a pro-rated
rate for the time they were present as deemed appropriate by the Chief
or Assistant Chief.
1.
The Chief of the Fire Department shall receive a monthly salary
of four hundred dollars ($400.00).
2.
The Assistant Chief of the Fire Department shall receive a monthly
salary of one hundred dollars ($100.00).
3.
The Captains of the Fire Department shall receive a monthly
salary of seventy-five dollars ($75.00).
4.
The Lieutenants of the Fire Department shall receive a monthly
salary of seventy-five dollars ($75.00).
5.
Members that attend regular meetings of the Fire Department
shall be compensated twenty dollars ($20.00) for each meeting attended.
6.
Members that attend work sessions of the Fire Department shall
be compensated forty dollars ($40.00) for each work session attended.
7.
Members that respond to incidents shall receive for the first
hour twenty dollars ($20.00) and for every hour thereafter shall receive
fifteen dollars ($15.00) per hour.

It shall be unlawful for any person in any manner to willfully
destroy or deface any fire truck, hose, equipment or any other property
belonging to the Fire Department.

A.
In
accordance with Section 67.318, RSMo., the City of Bowling Green,
Missouri, does hereby require all residence and commercial businesses
within the City limits of the City of Bowling Green, Missouri, to
conspicuously post upon their premises their "911" addresses so that
providers of fire protection and other emergency services may better
find the proper location when responding to an emergency call.
B.
The
Bowling Green Fire Department, pursuant to State Statute, is empowered
to enforce the provisions of this Section. All persons in violation
thereof, except a grace period for a first (1st) time violator of
the Section, shall be allowed granting any such violator fifteen (15)
days to comply with this Section after being notified, either in writing
or orally, by any City Official or Fire Department personnel before
any fine shall be imposed.

A.
It
shall be unlawful for any member of the Fire Department to be found
in a state of intoxication at any fire or to be in possession of or
consume any intoxicating liquor in the fire station, on City owned
fire equipment or while on any fire call.
1.
"State of Intoxication", for purposes of this Section,
shall mean a blood alcohol content in excess of one-tenth percent
(.1%) or more by weight of alcohol in his/her blood or is determined
by the Fire Chief or assistant Fire Chief to be intoxicated to the
extent of being impaired from fully and capably being able to perform
the duties of a fireman with safety to himself/herself and others.
2.
All violations of this Section shall be reported by the Fire Chief
or Assistant Fire Chief to the Mayor within seventy-two (72) hours
of its occurrence.
3.
Any member of the Fire Department found to be in violation of this
Section shall be subject to termination as a member of the Bowling
Green Fire Department by the Mayor.
4.
Any member terminated from being a member of the Bowling Green Fire
Department for violation of the provisions of this Section shall be
ineligible to be a member of the Bowling Green Fire Department for
a period of five (5) years.

The Standard Operating Guidelines (SOG's) of the Bowling Green
Fire Department shall be available, known and utilized by all members
of the Fire Department.

The Mayor, City Clerk, Fire Chief or other appropriate City
Officials are hereby authorized, permitted and directed to enter into
reciprocal agreements with neighboring Cities to include Clarksville,
Louisiana, Vandalia and Frankford which have organized Fire Departments
and such other Cities from time to time as they may deem advisable
and beneficial to the City for purposes of reciprocal first responder
duties whenever aid and assistance may be required to combat the danger
of loss of life or property by fire or other cause in the discretion
of the Fire Chief of the City of Bowling Green.
