The following words, terms and phrases, when used in this Article,
shall have the meanings ascribed to them in this Section, except where
the context clearly indicates a different meaning:
JUNK
Old or scrap copper, brass, rope, rags, batteries, paper,
trash, rubber debris, waste, or junked, dismantled, or wrecked automobiles,
or parts thereof, iron, steel, and other old or scrap ferrous or non-ferrous
material.
SECONDHAND AUTOMOBILE DEALER
Any establishment, area, or place of business maintained,
used, or operated for storing, keeping, buying, or selling wrecked,
scrapped, ruined, or dismantled motor vehicles or parts thereof.

It shall be unlawful for any person to operate a business for
the buying and selling of used automobiles or other vehicles, machinery,
equipment or apparatus or, of maintaining any place for storage in
quantities of used automobiles or other vehicles, machinery, equipment
or apparatus within this City, without first acquiring a license from
the City to do so and paying the license fee as provided in this Division.

It shall be unlawful to operate, within this City, the business
of junk dealer or, the business of buying and selling junk or, the
business of maintaining yards or storage places for the purpose of
storing and keeping within this City any junk, without first obtaining
a license to do so from the City and paying a license fee as provided
in this Division.

Any person desiring to engage in the business of buying and
selling junk or, operating the business of a junk dealer or, the business
of storing junk or, the business of used car dealer or, the storage
of used cars, shall first apply to the City Clerk/Administrator for
a license to do so and such application shall be in writing. The City
Clerk/Administrator shall submit the same to the Board of Aldermen
and, upon the approval of such Board and the payment of the sum of
one hundred dollars ($100.00) by the applicant, which sum is hereby
fixed and imposed as a license fee for such businesses, the City Clerk/Administrator
shall issue the license which shall also describe the business authorized
thereunder. The license so issued shall extend to and terminate on
June thirtieth (30th) following the date of its issue. If such application
for license is made after January first (1st) and before June thirtieth
(30th) of any year, then the applicant of such license may pay one-half
(½) of the annual fee, the sum of fifty dollars ($50.00), and
such license shall expire on June thirtieth (30th) following, provided
that any person may engage in the business of used car dealer or of
junk dealer, or both, at the same time and place under one (1) license
issued in pursuance to the provisions of this Article.

Any person who shall seek and procure a license under the provisions
of this Article shall be deemed to have contracted and agreed with
the City to comply with the provisions of this Article and that the
place of business conducted under any such license and any junk kept
at such place of business, shall be handled in such manner as to prevent,
as far as is reasonable, breeding places for rodents, mosquitoes,
flies and bugs and to prevent the development and continuance of stagnant
pools of water or receptacles containing water and in general to prevent
the existence of any condition that may constitute a hazard to public
health and safety. If the person to whom any such license has been
issued fails to comply with any of the provisions of this Article,
the Board of Aldermen shall have the right to forfeit and revoke such
license and in case of any such forfeiture or revocation, fees paid
for the issuance of such license shall not be returnable to the former
licensee.

It shall be the duty of the Chief of Police and all regular
and special Police Officers of this City to make monthly inspections
within the City to determine whether any person is carrying on or
conducting any of the businesses mentioned in this Article and whether
any of the provisions of this Article are being violated and to report
and complain to the Municipal Judge when any such violations are found
to exist.
