A. Definitions. As used in this Section, the following
terms shall have the meanings indicated:
ESTATE SALE
The sale of household goods, jewelry, furniture, clothing,
or other personal property at the premises of a resident to dispose
of the majority of the property owned by a person who is deceased
or who has or will be moving.
B. License Required.
1.
No person shall conduct an estate sale without having first
obtained a license from the City Clerk not less than twenty (20) business
days prior to the scheduled sale.
2.
The license application shall include the name, address, phone
number, and e-mail address of the person conducting the estate sale;
a description of the proposed method of traffic control to be used
during the sale; and an acknowledgement that the applicant shall be
responsible for any damage to City or personal property caused by
the estate sale.
3.
If a traffic control plan is absent or ineffective, as determined
by the Mayor, the person shall submit a deposit of five hundred dollars
($500.00) per each day of the sale for use by the Mayor for traffic
control measures.
C. Restrictions.
1.
Licenses shall be issued only for Saturdays, Sundays, and holidays
recognized by the State of Missouri.
2.
No personal property of any type belonging to anyone other than
the resident, whether deceased or who has moved or will be moving,
shall be brought upon the premises for sale at an estate sale.
3.
The estate sale shall be conducted in an orderly and safe fashion,
and the City reserves the right to revoke the license and halt the
sale on any threat to the public health, safety, and welfare, as determined
by the City's Chief of Police or his or her assignee.
4.
The person conducting the sale shall be responsible for ensuring
free movement of traffic on the street abutting the place of sale.
The person conducting the estate sale shall post signs reading 'No
Parking This Side of Street' wherever applicable on streets adjacent
to the estate sale. No Parking signs are available at the Frontenac
City Hall.
D. Penalty. The violation of any provision of this Section shall be punishable upon conviction as provided in Section
100.220 of the Municipal Code.
