For the purposes of this Chapter, the word "person" shall include an individual person or any firm, association, company,
corporation or any other group of persons operating together or any
other legal entity.

If a violation of this Chapter shall be discovered, the Chief
of Police is hereby authorized to cause the immediate abatement of
said violation and to prosecute the proper person for operating or
permitting to be operated a sale in violation of this Chapter.

No person shall operate or permit to be operated within the
City any rummage sale, garage sale or private auction sale without
first having obtained a permit from the City.

A. No
permit for a rummage, garage or private auction sale shall be issued
unless the applicant shall upon his/her application clearly show that
the sale shall be conducted in an orderly fashion; the application
shall more particularly show that:
1. The sale will be conducted in an enclosed portion of an existing
structure.
2. The exterior of the premises where the sale is to be conducted is
to be kept free of any debris, litter or items offered for sale.
3. The on-premises advertising for said sale shall be limited to one
(1) double- or single-faced sign not more than twelve (12) square
feet in size.
4. Each applicant issued a permit hereunder shall be responsible for
the pickup of all on-premises and off-premises signs used to advertise
said rummage sale or garage sale.

Each residential household within the City shall be entitled
to receive not more than two (2) permits per year for either a rummage
sale or garage sale, all of which shall be issued by the City Clerk
upon proper application at no cost to the applicant resident.

Each permit under this Chapter issued to an applicant for a
sale to be held within the City shall be for a term not to exceed
two (2) consecutive days and no such sales shall be granted or permitted
for any period which includes a Sunday.
