A. Any
person who sells, gives, or otherwise transfers or makes available
cigarettes or cigarette wrappers to a person under the age of eighteen
(18) years of age shall be guilty of furnishing cigarettes to minors.
B. Any
person who violates any provision of this Section shall be fined for
every offense not less than twenty-five dollars ($25.00) nor more
than five hundred dollars ($500.00) or imprisoned not more than ninety
(90) days, or both.

A. It
shall be unlawful for anyone under the age of eighteen (18) years
of age to have in their possession cigarettes or cigarette wrappers
(if found with tobacco or other illegal substance).
B. Conviction
upon a first (1st) offense will be an infraction with a fine of no
less than twenty-five dollars ($25.00) or more than one hundred fifty
dollars ($150.00). Charges for a first (1st) offense may be referred
to the juvenile authorities for disposition.
C. Conviction
of a second (2nd) or subsequent offenses will result in a misdemeanor
charge with a fine of no less than twenty-five dollars ($25.00) or
more than five hundred dollars ($500.00) or imprisonment for not more
than ninety (90) days, or both.
D. Charges
against anyone under the age of seventeen (17) must be filed with
the juvenile authorities for disposition.
