A. All fences erected in the City shall require a permit. A forty dollar
($40.00) fee is required for said permit. Routine maintenance of a
fence does not require a permit.
B. Applications and Site Plan for fences shall be submitted for review
to the Planning and Building Department.
C. No person shall erect or maintain any fence or screen, in whole or
in part made of cloth, canvas or other like material in any zoning
district without first obtaining a Special Use Permit.
D. The owner of any property shall be responsible for maintaining fences
on their property and to remove any fence if it becomes unsightly
or a menace to public safety, health or welfare as determined by the
nuisance ordinance.
E. Fences are permitted on any lot or private property if they do not cause a hazard by restricting sight distance at intersections of street with street or driveway with street. See the "Vision Obstruction Restrictions" Section
500.310.
F. It shall be the responsibility of the property owners to ensure that
a fence does not block or obstruct the flow of storm water.
G. All fences erected prior to April 1, 1999, shall be considered non-conforming
and as such shall be allowed to remain in place.

A. All fences shall be designed, erected and maintained in accordance
with the following:
1.
The use of electrical charged, barbed wire and affixed spikes,
projecting nails or other dangerous objects of any kind or description
in or on a fence, shall be prohibited.
a.
Chain link fence shall have smooth edge at the top and pointed
edge at the bottom.
2.
Privacy fences shall not exceed six (6) feet above finished
grade. The fence shall not encroach on adjoining properties. Side
fences shall not extend forward of the front corner of the principal
building on any lot.
a.
Privacy fences shall be constructed of a consistent material
such as chain link (rust proof metal), wood, concrete block, brick,
stone, wrought iron or other like material.
b.
All supporting posts, cross members and protruding bolts, screws
and/or hardware of site-obscuring fences and privacy fence shall face
toward the interior of the lot on which the fence is constructed.
3.
Front yard fences shall not exceed four (4) feet above grade.
Chain link fences or other fences shall have at least fifty percent
(50%) of its surface open.
4.
No fence, hedge or wall shall be erected or located in such a manner as to obstruct or hinder traffic flow on streets, alleys or driveways in the vicinity of the property upon which it is located. See the "Vision Obstruction Restrictions" Section

B. Ornamental dividers, such as plastic chains or ropes between posts,
rail fences with not more than two (2) rail and less than four (4)
feet in height and dividers less than two (2) feet in height, shall
not be considered a fence and no permit is required.
C. Fence Required Around Swimming Pools.
1.
No person shall construct a permanent type swimming pool on
his/her premises, nor shall any person allow a permanent type swimming
pool to remain in existence on his/her premises, without enclosing
said swimming pool with a chain link wire fence or vertical board
fence not less than four (4) feet in height with gates of the same
height which shall be padlocked when the same are not in use.
2.
Subsection
(1) shall not apply to any public swimming pools, bathing pools or wading pools, nor shall the foregoing apply to private pools if there be a yard fence with gates of the same height and construction as provided.

A. Fences to a maximum of eight (8) feet in height shall be permitted.

Barbed wire shall be permitted only if the lowest strand is
over six (6) feet above grade and when used for security purposes
in addition to a regular fence. A request stating the reason shall
be made, in writing, by the property owner.

A. Front Yards.
1.
No Obstructions In Front Yards Allowed. On any lot on which
a front yard is required, no wall, fence or other structure shall
be erected and no hedge, tree, shrub or other growth or object of
any kind shall be maintained in such location within such required
front yard so as to obstruct the view, except as permitted by this
Subsection.
2.
Front Yard Fence Restrictions.
a.
Open fences not exceeding fifty percent (50%) screening and
three and one-half (3 1/2) feet in height above yard grade shall
not be deemed to obstruct the view.
b.
The square footage of the open voids shall be measured by taking
the total square footage of an area defined by the length of the fence
and a height of three and one-half (3 1/2) feet above yard grade
and subtracting the total square footage of the screening within the
fence. The percent of open voids shall be derived by dividing the
total square footage of the open voids by the total square footage
of the area calculated above and multiplying this number by one hundred
(100). The fence's framing (the vertical posts supporting the fence
from the ground and no more than two (2) horizontal crossbars between
the posts) shall not be included in the calculated total square footage
of screening, provided the framing posts and crossbars do not exceed
a four-inch width and the posts are spaced at least eight (8) feet
apart. If the fencing is placed between brick or stone pillars, these
pillars shall be included in the calculation of the total square footage
of screening.
B. Sight Triangles.
1.
Street Intersections. Standards for street intersection sight
triangles shall be based on street width. The Planning and Building
Department shall require additional triangle area for clear sight
and safety as determined by conditions. No wall, fence, other structure,
hedge, tree, shrub, flower, other vegetation or landscaping materials
over two (2) feet or under seven (7) feet in height above the lowest
grade of two (2) or more intersecting streets shall be placed within
the street intersection sight triangle, the two (2) sides of which
are defined by measuring twice the pavement width of each intersecting
street along its centerline from the center of the intersection and
a third imaginary line connecting the extremities of the other two
(2).
2.
Street/Driveway Intersections. A street/driveway sight triangle
on the right side (when facing the street) is the triangle formed
by the intersection of a public street and a driveway where the triangle
area is that area encompassed within two (2) intersecting lines formed
by the edge of the pavement, curb, roadway or projection thereof and
extending thirty-five (35) feet down the street from the centerline
of the driveway when standing in the driveway facing the street and
extending twelve (12) feet from the edge of the street up the driveway
and a third imaginary line connecting the extremities of the other
two (2). On the left side of the driveway, the triangle shall be calculated
by measuring sixty (60) feet down the edge of the street pavement
from the centerline of the driveway when standing in the driveway
facing the street and extending twelve (12) feet from the edge of
the street pavement up the driveway and a third imaginary line connecting
the extremities of the other two (2).
3.
No Obstructions Permitted. No wall, fence, other structure,
hedge, tree, shrub, flower, other vegetation or landscaping materials
over two (2) feet shall be placed within a street intersection sight
triangle or a street/driveway sight triangle. However, a single tree
having a single trunk shall be allowed in a sight triangle provided
the tree is pruned to a height of seven (7) feet above yard grade.
Planning and Building Department shall require additional triangle
area for clear sight and safety as determined by conditions.
