This City hereby covenants and agrees to cooperate with each and every City, Town or Village which is a member of the Ferguson Police Department Radio System, St. Louis County, Missouri, for certain mutual-aid Police services under the terms and conditions herein contained.

This Article for mutual cooperation Police services shall become effective with respect to each municipality that is a member of the Ferguson Police Department Radio System upon passage of a like ordinance by each municipality that is either a member of the Ferguson Police Department Radio System or which is protected by Police of a municipality which is a member of the Ferguson Police Department Radio System.

The members of the Police force of this municipality shall respond to requests for assistance within the boundary limits of any other municipality who is a member of the Ferguson Police Department Radio System or who is protected by Police of a City or Village which is a member of the Ferguson Police Department Radio System, pursuant to the directions and approval of the office of the Chief of Police of the City or Village or by direct dispatch of the Ferguson Police Department Radio System.

It shall be the duty of the members of the Police force of this municipality to perform Police services in any municipality which is a party to the Ferguson Police Department Radio System when requested to do so by the Ferguson Police Department Radio System or authorized to do so by the office of the Chief of Police of the City.

Each Police Officer performing services in any other municipality which is a member of the Ferguson Police Department Radio System, or in a municipality which is protected by Police of a municipality which is a member of the Ferguson Police Department Radio System, shall have all of the powers, rights, privileges, duties and immunities as the members of a Police force of the municipalities requesting assistance but shall remain in the employment of their own respective municipalities, but shall be under the direction, supervision and control of the municipality requesting assistance.

There shall be no compensation paid to any participating municipality but services shall be rendered based upon the mutual agreement of the municipalities to render assistance to each other.

Equipment and property utilized in the carrying out of the common Police services provided for by this Article shall be at the risk of the municipality owning the same and any loss or damage thereto shall be borne by such municipality; provided, nothing herein contained shall be construed to limit the liability of any municipality or its agents, servants or employees arising out of tortious conduct.

Nothing herein contained shall be construed to mean that any Police Officer of another municipality who is injured, killed or who dies from injuries sustained while performing services in this municipality shall be covered under Workers' Compensation insurance of this municipality or under any injury or death benefit from this municipality. Nothing contained herein shall be construed to mean that Police Officers of this municipality who may be injured or killed or die as a result of injury while serving another municipality which is a member of the Ferguson Police Department Radio System, or who is protected by the Police of a municipality which is a member of the Ferguson Police Department Radio System or with the approval of the Chief of Police of the municipality, shall not be covered by Workers' Compensation insurance provided by this City and shall not be entitled to other injury or death benefits provided by this municipality.

Any member of the Cool Valley Police Department shall have authority to respond to an emergency situation outside the boundaries of the City of Cool Valley into any venue or jurisdiction which has duly authorized such response. "Emergency situation" means any situation in which the Law Enforcement Officer has a reasonable belief that a crime is about to be committed, is being committed, or has been committed involving injury or threat of injury to any person, property, or governmental interest and such officer's response is reasonably necessary to prevent or end such emergency situation or mitigate the likelihood of injury involved in such emergency situation. The determination of the existence of any emergency situation shall be in the discretion of the officer making the response or in the discretion of an officer or governmental officer of the political subdivision in which the emergency situation is alleged to be occurring. "Response" shall mean to take any and all action which the officer may lawfully take as if exercising his/her powers within his/her own jurisdiction.

The City of Cool Valley hereby agrees to cooperate with political subdivisions concerning a major case squad. The Chief of Police may appoint a member of this department to participate as a member of such major case squad, with such powers and authority as may be provided by law.
