A.
The
Mayor with the approval of a majority of the members of the Board
of Aldermen shall appoint a Chief of Police, who shall perform all
duties required of the Marshal by law and any other Police Officers
found by the Board of Aldermen to be necessary for the good government
of the City. The Chief of Police shall be twenty-one (21) years of
age or older. The Chief of Police shall be certified as a Peace Officer
by the Director of the Department of Public Safety of the State of
Missouri within one (1) year from his/her appointment as Chief in
accordance with Sections 590.100 — 590.150, RSMo.
B.
General Authority. Whenever, the word "Chief" is used in this Chapter, it shall refer to and mean the Chief of
Police. The Chief shall supervise, direct and manage the Foristell
Police Department.
C.
Powers And Duties.
1.
The Chief of Police is empowered to exert supervisory and management
control over Police personnel who are individually charged by the
Chief to carry out the statutory duties mandated by Federal, State
and local ordinances. The Chief of Police shall complete all pre-employment
requirements for new departmental employees prior to submitting a
recommendation to hire for the City Administrator's approval.

The Chief of Police is responsible for the suggestion and proposal
of Board of Aldermen policies related to department conduct, procedures
and operations and the formulation of programs which provide the citizens
of the City with Police protection. Such policies and programs shall
provide the latitude for Police personnel to respond rapidly and effectively
during emergencies, within the scope of Federal, State and local regulations.
The Chief of Police shall be responsible for the preparation and administration
of the department work program and budget to ensure that all statutory
and subsidiary programs are implemented by the appropriate personnel.
All purchases initiated by the Police Department for any operation
or program shall be approved by the Chief of Police prior to submission
to the Board of Aldermen for payment.

It shall be the duty of the Chief of Police to cause the enforcement
of the laws of the State and the ordinances of the City of which the
Police Department takes cognizance. The Chief shall also be responsible
for the control, direction, efficiency, and internal affairs of the
Police Department and shall have the power and authority to establish
and assign programs within the Department as is deemed necessary to
carry out the functions, objectives and goals mandated by the Board
of Aldermen or the State or Federal Government for the Department
and to prescribe rules, regulations, policies and procedures for the
conduct and management of the Department deemed necessary to implement
such programs. The Chief, in conformance with applicable law, may
peremptorily suspend, demote or discharge any subordinate appointed
by the Chief for neglect of duty, disobedience of orders, misconduct
or failure to properly perform the subordinate's duties.

The Chief of Police shall manage and direct uniform patrol, investigation
and Police support service functions to cause the enforcement of all
the laws of this State and all ordinances of this City of which the
Police Department must take cognizance or within the purview of the
Department's responsibilities.
5.
The Chief of Police shall promulgate orders, rules and regulations
for the conduct and guidance of the members of the Police operations
division within the parameters of that Department's policy.
6.
The Chief of Police shall make an annual report of the activities
of the Police Department, which shall be filed with the City Clerk
for distribution to the Mayor and Board of Aldermen.
7.
The Chief of Police shall assign the personnel of the Police Department
as deemed necessary to carry out the functions of the Department and
to prescribe rules and regulations for the conduct and management
of the Department consistent with the policies.
8.
The Chief of Police shall provide and coordinate training programs
for the Police Department related to its specialized functions.
9.
The Chief of Police shall maintain accurate and complete records
for the Police Department in accordance with Federal, State and local
ordinances.
10.
The Chief of Police shall provide a coordinated community relations
program which educates the general public with regard to crime prevention.
11.
The Chief of Police shall prepare a Police Department budget for
the City Administrator's/Clerk's review and approval for consideration
by the Mayor and Board of Aldermen.
12.
The Chief of Police shall provide for enforcement of ordinances.
13.
The Chief of Police shall perform or cause to be performed any other
duties as directed by the Mayor and Board of Aldermen.
15.
The Chief of Police shall perform all other duties assigned by the
Mayor and Board of Aldermen and shall be under the supervision of
the City Administrator.

There is hereby established a Department of Police for the City.
The administration of the Department shall be integrated into and
made a part of the regular City administration and shall be coordinated
with all other City departments.

It shall be the duty of the Police Department to provide the
citizens of the City with Police protection by preserving the public
peace and protecting life and property.
The Police of the City may be appointed in such numbers, for
such times and in such manner as may be prescribed by ordinance. They
shall have power to serve and execute all warrants, subpoenas, writs
or other process and to make arrests in the same manner as the Chief
of Police. They may exercise such powers in areas leased or owned
by the municipality outside of the boundaries of such municipality.
The Chief of Police and Policemen shall be conservators of the peace
and shall be active and vigilant in the preservation of good order
within the City.

All Police Department employees shall devote their whole time
and attention while on duty to the business of the Police Department
and shall, at all times, be subject to the rules and regulations made
by the Chief concerning their conduct and duties within the parameters
of departmental policy.

The members of the Police Department shall receive such compensation
as the Board of Aldermen may fix by ordinance, as compensation in
full for all services rendered.

A.
It
shall be the duty of the Police Department to serve the public peace
and enforce all State laws, City ordinances and orders of the Mayor,
the execution of which devolves upon the Police Department.
B.
The
officers of the Police Department shall have the power to arrest all
persons in the City found to be in the act of violating any State
law or City ordinances; or aiding or abetting in any violation or
where a public offense has in fact been committed and the Police Officer
has reasonable grounds to believe that the person to be arrested has
committed such public offense.

A.
The
chain of command for the Police Department shall be as follows: Chief
of Police reports to the City Administrator and is answerable to the
Mayor and Board of Aldermen for the actions and conduct of all officers
of the Police Department while on duty in this City.
B.
All
Police Officers are directly under the Chief of Police and will take
their orders from him/her and be answerable to him/her.
C.
All
Police Officers shall be at-will employees of the City of Foristell
and shall have their pay determined by the Board of Aldermen at its
annual budget hearing.
D.
All
Reserve Officers shall serve as volunteers of the Police Department
and shall be an employee for insurance benefits and shall be paid
one dollar ($1.00) annually.
E.
Reserve
Officers shall not be required to work more than nineteen (19) hours
a week, except in an emergency condition.
The Board of Aldermen of the City may by ordinance enter into
a contract or agreement with any other political subdivision, for
the provision of Police services by one political subdivision to another
on request, as provided for in Section 70.815, RSMo. The terms "Police", "Policemen" and "Police
Department" as used herein shall refer to Law Enforcement
Officers of the contracting entity.

A.
The
City hereby adopts and will enforce this policy prohibiting the use
of excessive force by law enforcement agencies within its jurisdiction
against any individual engaged in non-violent civil rights demonstrations.
The City also prohibits the physical barring of any entrance or exit
of any facility and will enforce all applicable State laws regarding
same.
B.
Any
person guilty of this Sections shall be guilty of a misdemeanor, and
on conviction thereof, shall be fined in the amount not exceeding
one hundred dollars ($100.00) for each violation. Each day in which
any such violation shall continue shall be deemed a separate offense.
C.
Any
person violating any of the provisions of this Section shall become
liable to the City for any expense, loss, or damage occasioned the
City by reason of such violation.
