The intent of this chapter is to protect the citizens of and visitors to the Village of Whitesboro by restricting the sale of firearms, possession of firearms by minors, and prohibiting the discharge of weapons within the Village by any person.
Article 2 of the Municipal Home Rule Law.
A. 
No person shall sell within the Village of Whitesboro to any person under 18 years of age any of the following weapons:
(1) 
Air guns, spring guns or other instruments or weapons in which the propelling force consists of spring or air.
(2) 
Sling shots or similar instruments from which a pellet, stone or other object can be propelled with such force as to cause injury to person or damage to property.
B. 
No parent, guardian or other person in charge of a minor (person under 18) shall permit any minor to possess or use any such weapon or instrument within the Village of Whitesboro.
No person shall discharge any firearms, air gun, spring gun, sling shot or other instrument or weapon within the Village of Whitesboro, except in self-defense, or in the discharge of official duty, or during a memorial service or veteran's funeral, or at an indoor rifle range operated under the supervision, guidance and instruction of a duly commissioned officer of one of the armed forces, including the National Guard and Reserve Forces, or a duly qualified adult citizen of the United States who has been granted a certificate as an instructor of small arms practice issued by one of the Armed Forces of the United States, the adjutant General of the State, or by the National Rifle Association of America.
A violation of this chapter shall be punishable by a fine up to $250 or by imprisonment for not exceeding 15 days, or by both such fine and imprisonment.
