The purpose of this chapter is for the protection and preservation
of the property of the Village of Whitesboro, Oneida County, New York,
consisting of the Flagg Street Playground, the Robert Hooper Memorial
Park, and the Village Park on Main Street; and to establish rules
and regulations for the use, care, maintenance, protection, preservation
and enjoyment thereof for residents and other authorized users.
The parks shall be open to the general public between the hours
of 7:00 a.m. and dusk each day except that the Village Board shall
be entitled to vary the hours at one or more of such parks by resolution.
All vehicles shall be parked only upon clearly marked and designated
parking areas.
There shall be no willful damage or destruction of park property.
Park property shall include, but not be limited to, buildings, structures,
playground equipment, fixtures, trees and shrubs.
Organized groups must obtain permission from the Village Board
for use of the Village Parks System.
No dangerous instrumentality, including firearms, fireworks,
explosives or any dangerous instrument (as defined by New York State
Penal Law), shall be used or possessed within any park at any time.
Littering is specifically prohibited, and all refuse shall be
deposited in receptacles placed at intervals about the parks for that
purpose.
Alcoholic beverages of any type are not allowed within the parks
at any time.
The use of any audio-amplification equipment is prohibited unless
specifically authorized by the Village Board.
Bands, orchestras or other live musical entertainment, whether
performed by an individual or a group of musicians, are prohibited
from performing in the parks without the specific permission of the
Village Board.
The Village Board may from time to time grant temporary exceptions
to the rules provided for herein.
Those persons within the boundaries of the park are subject
to the rules and regulations contained herein and may be ejected from
the park in the event they violate any rule or regulation. In addition
thereto, the Village Board reserves the right to suspend or revoke
the privilege of using one or more Village parks of any person who
violates any rule or regulation set forth herein upon notice and the
right to a hearing.
An offense against the provisions of this chapter, rule, regulation
or specific provision thereof shall constitute a violation and shall
be punishable by a fine not exceeding $250 or imprisonment for a period
not to exceed 15 days, or both said fine and imprisonment. This provision
shall not be deemed to prevent a person from being charged and convicted
with an offense under the New York State Penal Law.
