In any instance of a request for a conditional use or special
exception, the appropriate authorities of the Township must determine
that the following express standards and specific criteria are met
before granting the request:
A. Traffic congestion. The proposal is suitable with respect to traffic
and highways in the area and provides for adequate access and off-street
parking arrangements in order to protect existing or proposed streets
and highways from undue congestion and hazard.
B. Fire and safety. The proposal will not increase the danger of fire
or otherwise endanger the public safety.
C. Overcrowding. The nature of the proposed activity will be suitably
related to the population served, the numbers of participating population,
the frequency of use, adequacy of space, potential generation and
impact of congestion and will not cause overcrowding or concentration
of population.
D. Light and air. The proposal will not substantially impair light and
air to adjacent property, injure or detract from the use of neighboring
property or from the character of the neighborhood, and the use of
property adjacent to the area included in the proposed change or plan
will be adequately safeguarded.
E. Public facilities. The proposal will not adversely affect transportation
or unduly burden water, sewer or other public facilities.
F. General. The proposal shall not impair the best interests of the
Township, the convenience of the community and the public health,
safety, morals and welfare.
G. Health or comfort. The proposal must not be harmful to the health
or comfort of the public or to the neighborhood because of odor, dust,
noise, vibration, glare, presence of vermin or rodents, or any other
feature and shall comply with the requirements of this chapter as
to such matters.
H. Objectives of Zoning Ordinance. The proposal is not in conflict with
the purpose and objectives of this chapter.
I. Other conditions. The proposal complies with all other conditions
imposed by provisions of this chapter applicable to the particular
proposal, including the performance standards provided in this chapter.
J. Applicable regulations. The proposal complies with any other applicable
regulations, including environmental regulations, whether in this
chapter or any other Shaler Township ordinance.
K. Violations of laws or regulations. The proposal is not in violation
of any applicable county, state or federal laws or regulations.
