As used in this article, the following terms shall have the meanings indicated:
EXTRA DUTY ASSIGNMENT
Police services such as traffic or crowd control or other services which Mount Ephraim is not obligated or expected to provide or does not usually provide as part of its regular plan of police services within the Borough through the office of the Chief of Police.
The office of the Chief of Police shall administer all activities relating to this article, except those set out herein to be administered by the Finance Department or Borough Clerk. Any person or entity wishing to obtain extra duty police services shall, at least 10 days before the services are required, apply in writing to the Chief of Police setting forth the specific nature of the services desired, the length of time required to perform such services, the location where such services are to be rendered, and any other special circumstances or specific requirements. All such requests will be subject to the availability of personnel as shall be determined by the Chief of Police.
The office of the Chief of Police shall estimate the number of police hours required and the cost of said services to be provided and provide said estimate to the person or entity requesting the service and to the Mount Ephraim Finance Department.
The Finance Department shall establish a separate escrow account to be known as the "Police Extra Duty Escrow Account" in a Borough-approved depository bank. All payments to off-duty officers must be made from this account and may not be made from payroll or other Borough accounts or sources.
Any person or entity requesting the services of an off-duty Mount Ephraim police officer must pay over to the Finance Department for deposit in the Police Extra Duty Escrow Account a deposit based upon the Chief of Police's estimate of time required of $500 per officer per day. The deposit must be made prior to any officer providing services, and in the event the person's or entity's escrow account becomes depleted, services will be immediately terminated.

A. 
Borough police officers shall be permitted to provide additional services to Borough organizations over and above normal police functions. These organizations will be billed for such services at a rate to include the Borough’s costs associated with employment. Police officers shall be compensated for such work based upon a negotiated agreement between the Borough and the collective bargaining unit for the Police Department. The Police Chief or his designee will be responsible for approving, billing, and accounting for such hours provided.
B. 
If the Borough of Mount Ephraim should be granted funds through the State of New Jersey, Division of Motor Vehicles Drunk Driving Enforcement Fund, police officers performing services for such program over and above customary police services shall be compensated at the officers’ annual overtime rate. If the Borough of Mount Ephraim should be granted funds through the State of New Jersey, Seat Belt Enforcement Grant, police officers performing services for such program over and above customary police services shall be compensated at the amount specified in the aforementioned grant. The Police Chief or his designee will be responsible for approving and accounting for such hours provided.
C. 
For any additional outside vendor side work provided by police officers, officers shall be paid at a rate of $75 per hour, and the vendor shall be billed an additional $20 per hour for each police vehicle if needed, as well as $10 per hour administrative fees, and an additional 1.45% matching Medicare. These payments shall be made through the Police Extra-Duty or Off-Duty Escrow Account.
All funds remaining in the escrow account after the services are completed and paid for will be returned to the payee or payee entity, unless a decision is made and communicated to the Finance Department that the payee elects to leave the escrowed amount in the account for future jobs.
A. 
Members of the Police Department may be permitted to accept police-related employment for private employees only during off-duty hours and at such times as will not interfere with the efficient performance of regularly scheduled or emergency duty for the Borough.
B. 
All police officers providing extra-duty services pursuant to this article shall do so only with the permission of the Chief of Police and shall function under his control and supervision.
C. 
Officers providing extra-duty services shall receive payment for extra duty assignments in accordance with the current practice of receiving overtime payments and shall receive payments only from the Police Extra Duty Escrow Account.
