No alcoholic beverages shall be sold, transferred or consumed
in any business establishment situated in the Borough of Mount Ephraim
except in an establishment which has been licensed for the sale of
alcoholic beverages by the State of New Jersey.

No person, firm, corporation, other entity owning or operating
any business or business establishment shall permit, allow or suffer
the consumption, sale or service of alcoholic beverages at such business
location except in those establishments which are licensed by the
State of New Jersey for the sale of alcoholic beverages for on-premises
consumption.
As used in this article, the following terms shall have the
meanings indicated:
BUSINESS or BUSINESS ESTABLISHMENT
An investment of capital, labor and management in an undertaking
for profit, or a commercial or industrial enterprise from which profit
is derived, without regard to whether or not the business or business
establishment is profitable.

A. Any person, firm, corporation or other entity violating any of the provisions of this article shall, upon conviction thereof, be subject to the penalty provisions contained in Chapter
305, Penalties.
B. Each individual act of sale, transfer, consumption or service of
alcoholic beverages at such business establishment at any particular
time shall constitute a separate violation of this article.
C. Any person, firm, corporation or other entity who is convicted of
violating any of the provisions of this article within one year of
the date of a previous violation for the same ordinance and who was
fined for the previous violation, shall be sentenced by a court for
an additional fine as a repeat offender. The additional fine imposed
by the court upon a person, firm, corporation or other entity for
a repeat offense shall be not less than $100 but not more than $2,000
for violation of the ordinance, and shall be calculated separately
from the fine imposed for the violation of this article.
