Borough of Leonia, NJ Improper Disposal of Waste

As used in this article, the following terms shall have the meanings indicated:

The district sewer system into which the Borough sewer system shall connect.

BOD (denoting "biochemical oxygen demand")

The quantity of oxygen utilized in the biochemical oxidation of organic matter under standard laboratory procedure in five days at 20° C., expressed in milligrams per liter (mg/l).

BUILDING DRAIN

That part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste and other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning five feet outside the inner face of the building wall.

BUILDING SEWER

The extension from the building drain to the public sewer or other place of disposal.

COMBINED SEWER

A sewer receiving both surface runoff and sewage.

DOMESTIC SEWAGE

Waste and wastewater from humans or household operations.

GARBAGE

Solid wastes from the domestic and commercial preparation, cooking and dispensing of food and from the handling, storage and sale of produce.

ILLICIT CONNECTION

Any physical or nonphysical connection that discharges domestic sewage, noncontract cooling water, process wastewater, or other industrial waste (other than stormwater) to the municipal separate storm sewer system operated by the Borough of Leonia, unless that discharge is authorized under an NJPDES permit other than the Tier A Municipal Stormwater General Permit (NJPDES Permit Number NJ0141852). Nonphysical connections may include, but are not limited to, leaks, flows or overflows into the municipal separate storm sewer system.

INDUSTRIAL WASTE

Nondomestic waste, including but not limited to those pollutants regulated under Section 307(a), (b) or (c) of the Federal Clean water Act [33 U.S.C. § 1317(a), (b) or (c)].

MUNICIPAL SEPARATE STORM SEWER SYSTEMS (MS4)

A conveyance or system of conveyances (including roads with drainage systems, municipal streets, catch basins, curbs, gutters, ditches, man-made channels, or storm drains) that is owned or operated by the Borough of Leonia or other public body, and is designed and used for collecting and conveying stormwater.

NATURAL OUTLET

Any outlet into a watercourse, pond, ditch, lake or other body of surface or groundwater.

NJPDES PERMIT

A permit issued by the New Jersey Department of Environmental Protection to implement the New Jersey Pollutant Discharge Elimination System (NJPDES) rules at N.J.A.C. 7:14A.

NONCONTACT COOLING WATER

Water used to reduce temperature for the purpose of cooling. Such waters do not come into direct contact with any raw materials, intermediate product (other than heat) or finished product. Noncontact cooling water may, however, contain algaecides, or biocides to control fouling of equipment such as heat exchangers, and/or corrosion inhibitors.

PERSON

Any individual, corporation, company, partnership, firm, association, or political subdivision of this state subject to municipal jurisdiction.

The logarithm of the reciprocal of the weight of hydrogen ions in grams per liter of solution.

PRIVATE SEWER LATERAL

A pipe or conduit for carrying sewage that runs from the toilet facilities in any building to the public sewer.

PROCESS WASTEWATER

Any water which, during manufacturing or processing, comes into direct contact with or results from the production or use of any raw material, intermediate product, finished product, by-product, or waste product. Process wastewater includes, but is not limited to, leachate and cooling water other than noncontact cooling water.

PROPERLY SHREDDED GARBAGE

The wastes from the preparation, cooking and dispensing of food that have been shredded to such a degree that all particles will be carried freely under the flow conditions normally prevailing in public sewers, with no particle greater than 1/2 inch in any dimension.

PUBLIC SEWER

A sewer in which all owners of abutting properties have equal rights and which is controlled by public authority.

SANITARY SEWER

A sewer which carries sewage and to which stormwaters, surface waters and ground waters are not intentionally admitted.

SEWAGE

A combination of the water-carried wastes from residences, business buildings, institutions and industrial establishments, together with such ground waters, surface waters and stormwaters as may be present.

SEWAGE TREATMENT PLANT

Any arrangement of devices and structures used for treating sewage.

SEWAGE WORKS

All facilities for collecting, pumping, treating and disposing of sewage.

SEWER

A pipe or conduit for carrying sewage.

SLUG

Any discharge of water, sewage or industrial waste which, in concentration of any given constituent or in quantity of flow, exceeds, for any period of duration longer than 15 minutes, more than five times the average twenty-four-hour concentration or flow during normal operation.

STORM DRAIN (SOMETIMES TERMED "STORM SEWER")

A sewer which carries stormwaters and surface waters and drainage but excludes sewage and industrial wastes other than unpolluted cooling water.

STORMWATER

Water resulting from precipitation (including rain and snow) that runs off the land's surface, is transmitted to the subsurface, is captured by separate storm sewers or other sewerage or drainage facilities, or is conveyed by snow removal equipment.

SUPERINTENDENT

The Superintendent of Public Works of the Borough or his authorized deputy, agent or representative.

SUSPENDED SOLIDS

Solids that either float on the surface of or are in suspension in water, sewage or other liquids and which are removable by laboratory filtering.

WATERCOURSE

A channel in which a flow of water occurs either continuously or intermittently.

Word usage. "Shall" is mandatory; "may" is permissive.

Waterline flushing and discharges from potable sources.

Uncontaminated ground water (e.g., infiltration, crawl space or basement sump pumps, foundation or footing drains, rising groundwaters).

Air-conditioning condensate (excluding contact and noncontact cooling water).

Irrigation water (including landscape and lawn watering runoff).

Flows from springs, riparian habitats and wetlands, water reservoir discharges and diverted stream flows.

Residential car washing water and residential swimming pool discharges.

Sidewalk, driveway and street wash water.

Flows from fire-fighting activities.

Flows from rinsing of the following equipment with clean water:

(1)

Beach maintenance equipment immediately following their use for their intended purposes; and

(2)

Equipment used in the application of salt and de-icing materials immediately following salt and de-icing applications. Prior to rinsing with clean water, all residual salt and de-icing materials must be removed from equipment and vehicles to the maximum extent practicable using dry cleaning methods (e.g., shoveling and sweeping). Recovered materials are to returned to storage for reuse or properly discarded.

Rinsing of equipment, as noted in the above situation, is limited to exterior, undercarriage and exposed parts and does not apply to engines or other enclosed machinery.
