As used in this article, the following terms shall have the meanings indicated:
LOITER
To sit, stand, lie, pace or otherwise remaining essentially in the same place, and shall include the colloquial expression "hanging around."
PUBLIC PLACE
Any area that is used or held out for use by the public, whether owned or operated by public or private interests.
It shall be unlawful for any person or group of persons to loiter:
A. 
On the streets, sidewalks, crosswalks, walks in public parks or any other public area so as to obstruct, impede or interfere with the use of the street, sidewalk, crosswalk, walk in a public park or other area by any other person;
B. 
On the grounds or within any building of a school within the Town so as in any way to obstruct, impede or interfere with or interrupt the operation of any school or class within such school; or
C. 
On private property within the Town if ordered to quit the private property by the owner, his agent, a tenant or lawful occupant thereof, or if said private property is posted with a sign or signs stating that loitering thereon is prohibited.
A. 
Whenever any police officer in the exercise of reasonable judgment decides that the presence of any person in any place constitutes loitering as defined herein, he or she may, if deemed necessary for the preservation of the public peace and safety, advise the person of the prohibited conduct and order that person(s) to leave that place, thereby giving the person an opportunity to comply with this article.
B. 
Any person who shall refuse to leave after being so advised of the prohibited conduct and ordered to do so by a police officer shall be guilty of violating this chapter and shall be subject to a fine not exceeding $99.
