No person shall willfully injure or intentionally deface, destroy, or unlawfully remove, take or meddle with any property belonging to the Village or its departments or to any private person without the consent of the owner of the property or proper authority. Whoever violates this section is subject to a penalty as set forth in § 1-2 of the Code.

Whoever intentionally marks, draws or writes with paint, ink or another substance on or intentionally etches into the physical property of another without the other person's consent is guilty of a violation of this section. Whoever violates this section is subject to a penalty as set forth in § 1-2 of the Code.

No person shall throw any glass, rubbish, waste, or filth upon the streets, alleys, highways, public parks, or other property of the Village or upon any private property not owned by him or upon the surface of any body of water within the Village. Whoever violates this section is subject to a penalty as set forth in § 1-2 of the Code.
A. 
It shall be unlawful to be within the confines of any Village park between the hours of 11:00 p.m. and 6:00 a.m., except that this subsection shall not apply to any persons engaged in activities sanctioned by the Village of Mishicot. It shall moreover be unlawful for a person to be in the immediate area of the Wooden Wonderland and Mishicot Skate Park during the hours except during open hours which are 8:00 a.m. to dusk. Whoever violates this section is subject to a penalty as set forth in § 1-2 of the Code.

B. 
No person shall operate any snowmobile, all-terrain vehicle, go cart, scooter, or similar motorized vehicle anywhere in the Village park without written permission from the Village of Mishicot.
C. 
No fires shall be built except in fireplaces or grills designed for that purpose. All embers shall be disposed of in a proper manner.
D. 
All animals on Village park property must be properly leashed. Leash may not exceed six feet in length. All animal waste must be picked up by pet owner.
E. 
Amusement devices, tents, trailers, or similar structures shall not be permitted without authorization from the Mishicot Village Board.
F. 
The Chief of Police may ban from the Village park any person who, in the opinion of the Chief, is disorderly, harassing others, or otherwise may cause a disturbance. The ban shall not be for more than 90 days. Each violation constitutes a separate offense.
G. 
There shall be no smoking of tobacco products, use of alcohol products, possession or use of tobacco products or glass containers used within 200 feet of the Mishicot Skate Park or Wooden Wonderland.
H. 
No person may bring structures, obstacles, or other materials, such as ramps or jumps, into the skate park.
I. 
The skate park and Wooden Wonderland are closed during wet, snowy or icy conditions or during park maintenance periods.
J. 
No person shall be within 200 feet of the skate park or Wooden Wonderland who is under the influence of alcohol beverages or illegal drugs.
A. 
Whoever does any of the following is subject to a penalty as set forth in § 1-2 of the Code.

(1) 
Enters any enclosed, cultivated or undeveloped land of another without the express or implied consent of the owner or occupant;
(2) 
Enters any enclosed or cultivated land of another with intent to catch or kill any birds, animals, or fish on such land or gather any products of the soil without the express or implied consent of the owner or occupant to engage in any of those activities;
(3) 
Enters or remains on any land of another after having been notified by the owner or occupant not to enter or remain on said premises; or
(4) 
Hunts, shoots, fishes, or gathers any product of the soil on the premises of another, or enters said premises with intent to do any of the foregoing after having been notified by the owner or occupant not to do so.
B. 
A person has received notice from the owner or occupant within the meaning of this section if he has been notified personally, either orally or in writing, or if the land is posted. For land to be posted, a sign at least 11 inches square must be placed in at least two conspicuous places for every 40 acres to be protected. The sign must carry an appropriate notice and the name of the person giving the notice followed by the word "owner" if the person giving the notice is the holder of legal title to the land and by the word "occupant" if the person giving the notice is not the holder of legal title but is a lawful occupant of the land. Proof that appropriate signs as herein provided were erected or in existence upon the premises to be protected within six months prior to the event complained of shall be prima facie proof that the premises to be protected were posted as herein provided.

No person shall intentionally enter any building or dwelling of another without the consent of some person lawfully on the premises, under circumstances tending to create or provoke a breach of the peace. Whoever violates this section is subject to a penalty as set forth in § 1-2 of the Code.
A. 
In this section the following terms shall have the meanings indicated:
MERCHANT
Includes any merchant as defined in § 402.104(3), Wis. Stats., or any innkeeper, motel keeper or hotel keeper.
VALUE OF MERCHANDISE
(1) 
For property of the merchant, the value of the property; or
(2) 
For merchandise held for resale, the merchant's stated price of the merchandise or, in the event of altering, transferring or removing a price marking or causing a cash register or other sales device to reflect less than the merchant's stated price, the difference between the merchant's stated price of the merchandise and the altered price.
B. 
Whoever intentionally alters indicia of price or value of merchandise or who takes and carries away, transfers, conceals, or retains possession of merchandise held for resale by a merchant or property of the merchant without his or her consent and with intent to permanently deprived the merchant of possession, or the full purchase price, of the merchandise is guilty of retail theft. Whoever violates this section is subject to a penalty as set forth in § 1-2 of the Code.

C. 
The intentional concealment of unpurchased merchandise which continues beyond the aisle it was presented for sale or beyond the last station for receiving payments in the merchant's store is evidence of intent to deprive the merchant permanently of possession of such merchandise without paying the purchase price thereof. The discovery of unpurchased merchandise concealed upon the person or among belongings of another is evidence of intentional concealment on the part of the person so concealing such goods. Whoever violates this section is subject to a penalty as set forth in § 1-2 of the Code.

D. 
In any action or proceeding for violation of this section, duly identified and authenticated photographs of merchandise which was the subject of the violation may be used as evidence in lieu of producing the merchandise.
E. 
A merchant or adult merchant's employee is privileged to defend property as prescribed in § 939.49, Wis. Stats.

A. 
No person shall intentionally take and carry away, use, transfer, conceal, or retain possession of movable property of another, having a value not in excess of $500, without the consent of the owner and with intent to deprive the owner permanently of possession of such property. Whoever violates this section is subject to a penalty as set forth in § 1-2 of the Code.
B. 
Attempted theft. Whoever intentionally attempts to permanently deprive an owner of his or her property by carrying it away, concealing it, or retaining possession of it without the consent of the owner is guilty of a violation of this section. Whoever violates this section is subject to a penalty as set forth in § 1-2 of the Code.

Whoever intentionally and knowingly possesses or conceals property that has been stolen is guilty of a violation of this section. Whoever violates this section is subject to a penalty as set forth in § 1-2 of the Code.
A. 
For the purposes of this section, "camping" shall be defined as overnight lodging in tents, huts, or other shelters of a temporary and/or portable nature and shall include motor homes, travel trailers, and automobiles.
B. 
No person shall camp overnight on any public property, street, alley, school grounds, cemetery, or park within the Village of Mishicot, except that motor homes or travel trailers containing cooking, sleeping, and restroom facilities, including sewage holding tanks and provisions for self-contained fresh water, may be granted permission to park overnight in designated areas only under circumstances that would be otherwise denominated camping, from September 1 through November 30, under the following terms and conditions:
(1) 
The owner or occupant of each such vehicle or trailer must obtain an overnight parking permit in advance.
(2) 
An application for said vehicle or trailer for an overnight parking permit may be obtained at the Village Hall during normal business hours or from the Village Police Department.
(3) 
Each application for said overnight parking permit shall require the owner and/or occupant of the vehicle to list the names, addresses, and telephone numbers of the owner and all occupants, the owner or drivers, the driver's license number, and vehicle license registration numbers.
(4) 
Failure to obtain said permit in advance of camping shall result in the ineligibility of the owner, driver, or occupants of such vehicle or trailer for overnight camping in the Village of Mishicot for 30 days.
(5) 
The owner or occupants of such vehicle or trailer shall post such overnight parking permit in the front or rear of said vehicle or trailer so as to be clearly visible from the outside of said vehicle.
(6) 
The fee for said parking permit shall be set by the Village Board, and the permit shall expire at the end of 24 hours from issuance and shall be nontransferable. Said parking permit fee shall not be prorated for a period of time less than 24 hours.

(7) 
Overnight camping for the purposes of this section shall be deemed a parking of a vehicle or trailer in the areas designated above while said vehicle is occupied by one or more persons, for a period of two hours, between the hours of 10:00 p.m. and 6:00 a.m.
(8) 
Said vehicle or trailer shall only park or camp in the area designated upon the issuance of the permit.
(9) 
The number of permits available for any given day shall be limited, from time to time, by the Village Board or its designee.
(10) 
Said permits are nontransferable and may be revoked by the Village police officers or Village Clerk-Treasurer, for cause, including but not necessarily limited to the violation of this section, the violation of any of the ordinances of the Village of Mishicot, the violation of any of the ordinances of Manitowoc County, or the violation of any rules, regulations, statutes or administrative rules of the State of Wisconsin, including any fish or game violations. In addition, said permit may be revoked by any law enforcement officer if any of the campers under such permit engages in activities constituting a nuisance as the same is defined in § 254.59, Wis. Stats.
(11) 
These permits shall be subject to such additional regulation as may be from time to time promulgated by the Village Board or its designee.
It shall be unlawful to be within the confines of any cemetery, either public or private in ownership, within the Village from 1/2 hour after sunset to 1/2 hour before sunrise.
