It is the purpose of this article to protect the public interest, welfare, health and safety within the Village of Akron by prohibiting dangerous, offensive and disorderly conduct, and to provide local penalties for violation of the same.
As used in this article, the following terms shall have the meanings indicated:
PUBLIC PLACE
Any place to which the public or substantial group of persons has access, including, but not limited to, any highway, street, alley, sidewalk, parking area or lot, park or playground, public building, transportation facility, school, place of amusement, and hallways, lobbies, or other portions of apartment houses or hotels not constituting rooms or apartments designed for actual residence or any other public facility or ground, whether vacant or improved, within the geographical boundaries of the Village of Akron.
A person is guilty of disorderly conduct as follows:
A. 
He engages in, facilitates, or participates in conduct in a public place which tends to disturb the peace in the Village or tends to disrupt or disturb any meeting or lawful assemblage therein as follows: by creating unreasonable loud or disturbing noises; by fighting or engaging in riotous, violent or threatening behavior; by using obscene or abusive language or gestures in public; by congregating with other persons in a public place and refusing to comply with a lawful order of the police to disperse; by obstructing vehicular or pedestrian traffic; or by creating a hazardous or physically offensive condition by any act that serves no legitimate purpose.
B. 
He trespasses or enters upon any private property without the consent or invitation, express or implied, of the property owner, or damages any Village property or enters upon any grass plot or garden in any park or playground, which shall be posted with suitable signs, or picks any flowers or shrubs or does damage to any such shrubs or trees upon any Village property along any street; or injures, mars, or does damage to any tree or shrubs upon any private or public property in said Village; or mars or defaces any buildings.
C. 
He mutilates or destroys any building, equipment, fire hydrant, street or traffic sign, electric light fixture or lamp, or wires connected thereto, or any other property of any kind, owned, rented or used by the Village of Akron.
D. 
He urinates or defecates upon or in any public place within the Village of Akron.
A. 
Each and every violation of any provision of § 110-14 of this article shall be deemed an offense and shall be punishable by a fine in an amount not to exceed $250 and/or 15 days in jail.
B. 
These violations shall be prosecuted in the same manner as a violation pursuant to the New York State Penal Law.
