Habitual barking. No person shall own any dog which habitually cries or barks in a manner which would annoy or disturb a reasonable person. An "annoyance or disturbance," for the purpose of this section, shall be defined as barking, howling, or crying continuously for a period of 10 minutes or more or intermittently for 30 minutes or more. A violation of this section shall subject the owner of the offending dog to the penalties for a violation of this chapter.
No person who owns, harbors, keeps or possesses a female dog shall suffer or permit her to be in or upon any street, highway or other public place in the Township of Alloway or to trespass upon the property of other persons at any time or times while such female dog may be in heat, and any such female dog running at large in violation of this section shall be impounded by the Dog Warden or by any police officer of the Township, who may destroy it in not less than 72 hours after impoundment. The owner of said dog shall be subject to the penalty or penalties hereinafter set forth.
A. 
The Dog Warden of the Township shall take into custody and impound and thereafter destroy or dispose of as provided in this section:
(1) 
Any dog, licensed or unlicensed, running unattended in any street or public place.
(2) 
Any dog which is permitted by the person owning, keeping or harboring the same to do any damage to any lawn, shrubbery, flowers, grounds or property.
(3) 
Any dog which is permitted by the person owning, keeping or harboring the same to trespass upon the property of others.
B. 
If any dog so seized wears a collar or harness having inscribed thereon or attached thereto the name and address of any person, or registration tag, or the owner of or the person keeping or harboring the dog is known, the Dog Warden shall forthwith serve upon the person so identified a notice, in writing, stating that the dog has been seized and will be liable to be disposed of or destroyed if not claimed within seven days after the service of the notice. If the owner or person keeping or harboring said dog claims it, he shall pay to the Township Dog Warden a charge of $10 to reimburse expenses of the Township in detaining and maintaining said dog; and if the dog is not licensed he shall, in addition, pay the license and registration fee. The ten-dollar charge shall be turned over to the Township Treasurer by the Dog Warden. When any dog so seized has been detained for seven days after notice when notice can be given as above set forth, or has been detained for seven days after seizure when no notice has been given as above set forth, and if the owner or person keeping or harboring said dog has not claimed said dog and paid charges and fees owing, then the Dog Warden may sell the dog to anyone upon payment of the ten-dollar charge aforesaid and upon the registering and licensing of the dog by the purchaser. The ten-dollar charge shall be turned over by the Dog Warden to the Township Treasurer. However, no dog shall be sold or otherwise made available for the purposes of experimentation.
C. 
The Dog Warden shall take into custody and impound and thereafter destroy dogs in accordance with N.J.S.A. 4:19-15.16.
D. 
If the Animal Control Officer takes into custody and/or impounds a dog pursuant to this section, the person owning said animal or responsible for its control shall be subject to a fine not exceeding $500 or to imprisonment not exceeding 90 days, or both.
Any person who shall in any way hinder or interfere with the Dog Warden, police officer or official canvasser, constable or any other peace officer in the performance of his duties under the provisions of this article, or who shall refuse to give information or gives false information to the person or persons making any canvass, or who shall take a dog from the dog pound except upon redeeming such dog as provided by this article, or who shall break or damage such dog pound, shall be deemed to have violated the provisions of this article.
No person owning a dog shall permit it to run at large upon the public streets or in public parks, public buildings or in any other public place within the Township, nor permit a dog to run at large upon private property without permission of the owner. No person owning a dog shall permit it upon the public streets or in any other public place in the Township unless the dog is accompanied and controlled by a person over the age of 10 and is securely fashioned to a leash. Notwithstanding the provisions of this section, it shall be a violation of this chapter for any person owning, keeping or harboring any dog to suffer or permit such dog, whether on a leash or not, to be in any parks or upon any recreation or athletic fields owned, maintained or operated by the Township of Alloway or upon any property owned, maintained or operated by the Board of Education of the Township of Alloway.
Any person found guilty of violating any section of this article shall be subject to a fine not exceeding $500 or to imprisonment not exceeding 90 days, or both.
