Title: A local law to establish the residency requirements for the appointed offices of Maintenance Mechanic, Maintenance Helper, Seasonal and Temporary Workers, Assessor, Comptroller, Bookkeeper, Building Inspector, Deputy Building Inspector, Fire Inspector, Legislative Aide, Code Enforcement Officer, Secretary to the Highway, Secretary to the Supervisor, Deputy Town Clerk(s), Deputy Receiver of Taxes, Justice Court Clerk(s), Dog Control Officer and Assistant Recreation Director for the Town of Beekman.
This article is adopted pursuant to Municipal Home Rule Law § 10, Subdivision 1(ii)a(1), that grants to local governments the authority to enact local laws regarding the qualifications of local officers. Furthermore, this article recognizes that the State Legislature amended Public Officers Law, § 3, adding a new subdivision (24) expanding the residency requirements for any appointed public office in the Town of Beekman, Dutchess County, New York, thereby rendering Public Officers Law a special law with respect to any appointed Town officer. This article shall supersede Town Law § 23, Subdivision 1, in its application to the offices of maintenance mechanic, maintenance helper, seasonal and temporary workers, Assessor, Comptroller, Bookkeeper, Building Inspector, Deputy Building Inspector, Fire Inspector, Legislative Aide, Code Enforcement Officer, Secretary to the Highway, Secretary to the Supervisor, Deputy Town Clerk(s), Deputy Receiver of Taxes, Justice Court Clerk(s), Dog Control Officer and Assistant Recreation Director for the Town of Beekman.

Residency requirements for the positions of maintenance mechanic, maintenance helper, seasonal and temporary workers, Assessor, Comptroller, Bookkeeper, Building Inspector, Deputy Building Inspector, Fire Inspector, Legislative Aide, Code Enforcement Officer, Secretary to the Highway, Secretary to the Supervisor, Deputy Town Clerk(s), Deputy Receiver of Taxes, Justice Court Clerk(s), Dog Control Officer and Assistant Recreation Director for the Town of Beekman. The persons holding the offices of maintenance mechanic, maintenance helper, seasonal and temporary workers, Assessor, Comptroller, Bookkeeper, Building Inspector, Deputy Building Inspector, Fire Inspector, Legislative Aide, Code Enforcement Officer, Secretary to the Highway, Secretary to the Supervisor, Deputy Town Clerk(s), Deputy Receiver of Taxes, Justice Court Clerk(s), Dog Control Officer and Assistant Recreation Director in the Town of Beekman need not be a resident nor an elector of the Town of Beekman; provided, however, that such person shall reside in the county in which such Town is located or an adjoining county within the State of New York.

The Town of Beekman desires to eliminate the Office of the Receiver of Taxes and consolidate the duties of the Receiver of Taxes with the Office of the Town Clerk.
This article is enacted under the authority of Municipal Home Rule Law §§ 10, 22 and 23. The Town hereby expressly stated its intention that this article shall supersede any provision of the Town Law of the State of New York to the contrary, including but not limited to Town Law §§ 20, 30 and 37.
The purpose of this article is to abolish the Office of the Receiver of Taxes in the Town of Beekman, New York.
This article shall be subject to mandatory referendum at the next regularly scheduled General Election on November 7, 2017.[1]

This article shall take effect upon the affirmative vote of a majority of the qualified electors voting therein at such General Election on November 7, 2017, and the filing with the Office of the Secretary of State in accordance with the applicable provisions of law on January 1, 2022.
