As used in this chapter, the following terms shall have the
meanings indicated:
NUISANCE
Any condition, structure, use or improvement located on a
property which shall constitute a threat or potential threat to the
health, safety or welfare of the Borough or its citizens.
PERSON
Any natural person, partnership, firm, association, corporation
or other legal entity.
It shall be unlawful for any person to create or maintain a
nuisance in the Borough.
Any person who creates, causes, maintains or permits any nuisance
to exist within the Borough shall, within 10 days after notice from
Borough Council or Council's designee, remove or abate the nuisance.
If the person fails, neglects or refuses to timely remove or abate
the nuisance, the Borough or its agents shall have the authority to
enter upon a property to remove or abate the nuisance. If the Borough
removes or abates the nuisance, the Borough shall collect the costs
related thereto, including an additional penalty of 10% and reasonable
attorneys' fees, from the person or owner of the property upon
which the nuisance was located in the manner provided by law for the
collection of municipal claims or by assumpsit action.
Any person who violates any provision of this chapter shall, upon conviction thereof, be subject to fines, penalties and potential imprisonment as detailed in Chapter
53A of the Code of Ordinances for the Borough.
Nothing contained in this chapter shall be construed to be the
sole means for citing, removing or abating nuisances within the Borough.
