[Adopted 6-1-1981 by L.L.
No. 3-1981 (Ch. 3, Art. I, of the 1981 Code)]
It is the intent of the Town Board of the Town of Alden, as
an exercise of its police power, to promote the general health, safety
and welfare of the residents of the Town by enacting this article,
since it is the finding of the Town Board that the possession of open
containers of alcoholic beverages and/or the consumption of alcoholic
beverages by persons in the Town parks of the Town of Alden, except
under controlled conditions, is detrimental to the health, safety
and welfare of the residents of the Town and contributes to the development
of unsanitary conditions and the creation of nuisances.
This article shall be known and may be cited as the "Town Parks
Alcoholic Beverages Law."
No person shall discard alcoholic or other beverage containers
within the Town parks, except in appropriate Town trash receptacles.
The violation of any of the provisions of this article shall
be punishable by a maximum fine of $250 or by imprisonment for 15
days, or by both such fine and imprisonment. Each day any violation
shall continue shall constitute a separate violation.
