A.
The making and creation of excessive, unnecessary or unusually loud
noises within the limits of the Village of Manchester is a condition
which has existed for some time, and the extent and volume of such
noises is increasing.
B.
The making, creation or maintenance of such excessive unnecessary,
unnatural or unusually loud noises which are prolonged, unusual and
unnatural in their time, place and use affect and are a detriment
to public health, comfort, convenience, safety, welfare and prosperity
of the residents of the Village of Manchester.
C.
The necessity in the public interest for the provisions and prohibitions
hereinafter contained and enacted is declared as a matter of legislative
determination and public policy, and it is further declared that the
provisions and prohibitions hereinafter contained and enacted are
in pursuance of and for the purpose of securing and promoting the
public health, comfort, convenience, safety, welfare and prosperity
and the peace and quiet of the Village of Manchester and its inhabitants.
A.
It shall be unlawful for any person to make, continue or cause to
be made or continued any excessive, unnecessary or unusually loud
noise or any noise which either annoys, disturbs, injures or endangers
the comfort, health, peace or safety of others within the limits of
the Village, whether in the operation of any machine or vehicle or
the exercise of any trade or calling or otherwise, unless the making
and continuing of the same is necessary for the protection or preservation
of property or of the health, safety, life of limb of some person.
B.
No persons shall make, aid, countenance or assist in making any improper
noise, riot or disturbance or operate a motor vehicle in such a manner
as to cause excessive squealing or other excessive noise of the tires
or motor of said vehicle on the streets of the Village of Manchester.

C.
No person shall operate a motor vehicle without causing the noise
from the exhaust thereof to be properly muffled, in the streets or
elsewhere in the Village of Manchester.
D.
Excessive squealing and other noise from the tires or motor of said
vehicle may be defined as any excessive noise of the motor or squealing
of the tires of a vehicle caused by an unwarranted or unusual acceleration
or deceleration of the motor vehicle.
E.
No person shall make, use, operate or employ in connection with a
motor vehicle operated or driven upon the public highway a horn other
than as a reasonable warning, or to be unnecessarily loud or harsh
in the use of said horn.
F.
No person shall keep any animal or bird which shall cause a frequent
or long, continued noise which disturbs the comfort or repose of any
persons in the vicinity.
G.
No person
shall permit nor take part in an unreasonably noisy or tumultuous
party or gathering, nor yell, shout, hoot, whistle or sing on the
public streets or any public place, particularly between the hours
of 11:00 p.m. and 7:00 a.m. or at any time or place so as to annoy
or disturb the quiet, comfort or repose of persons in the vicinity.
