No persons, group of persons, corporations or other entities may operate a kennel in the Town of Johnston without first obtaining a license from the Johnston Town Council.
A. 
A certificate of zoning compliance must be received at the time of application.
B. 
The application shall include the owner's name, location of establishment, maximum number of animals to be kept at any one time, hours of operation, number of staff, the indoor and outdoor square footage per pet, and any other information required by the Town Council.
Each applicant for a kennel license shall, upon filing the application, pay to the Town Clerk the license fee of $25 in accordance with § 125-11 of the within Code of Ordinances.
A. 
Licenses issued under the provisions of this article shall not be transferable.
B. 
All licenses under this article must be approved by the Animal Control Officer prior to issuance of the kennel license.
C. 
Every kennel licensee shall receive a kennel license from the Rhode Island Department of Environmental Management within 60 days of the issuance of the Town of Johnston kennel license and shall maintain a current and valid kennel license from the Rhode Island Department of Environmental Management at all times thereafter.
D. 
Every kennel licensee shall display his or her current license in a conspicuous place within his or her establishment.
E. 
Animal Control Officers shall be allowed to inspect all licensed properties at any time for compliance with state and local laws.
F. 
Every animal in the kennel must have an up-to-date rabies vaccination, DHLPP (or DA2PP) and Bordatella vaccinations, and must be licensed by the city or town where the owner lives and/or the dog is kept, if applicable.
G. 
Prior to the issuance of a license, the applicant must provide a certificate of liability insurance in the amount of at least $1,000,000 per occurrence covering any damage or injury which may be caused during the twelve-month period covered by the license. The policy shall contain a provision requiring the insurance company to provide written notice to the Town Clerk not less than 15 days prior to any termination of the policy and not less than five days subsequent to cancellation or expiration of the policy.
H. 
No kennel shall hold more than 25 animals at any one time during the day and no more than 15 animals at any one time overnight.
I. 
No kennel may hold animals currently prohibited in the Town of Johnston.
J. 
Licensees must notify the Animal Control Officer of any and all animal bite incidents within 24 hours of each occurrence pursuant to the Rhode Island Rabies Control Board's Rules and Regulations governing the suppression of rabies.
K. 
All licensees must comply with all Town ordinances pertaining to animals and noise.
L. 
No licensee shall maintain his or her kennel in such a manner that it creates a public nuisance or creates an unsafe/inhumane environment for the animals or humans.
M. 
Overnight boarding of pets in outdoor areas is prohibited.
N. 
No outside exercising of pets is allowed between the hours of 8:00 p.m. and 8:00 a.m.
O. 
Prior to the renewal of any kennel license, the Animal Control Officer must attest, in writing to the Town Council, that during the previous year, the kennel licensee has, at all times, followed the regulations as set forth in Chapter 98 herein, and further that the kennel licensee has continuously provided proper and humane care of all animals boarded at said kennel.
Every such license shall be valid for a period of one year and shall expire on the first day of April next following the date thereof.
Failure to maintain compliance with the regulations set forth in § 98-33 may, after notice and opportunity to be heard, result in license revocation until the establishment is in full compliance with said regulations and/or penalties as described in § 1-17 of this Code.
