There is hereby created within and for the City of Greenfield an emergency management organization to be known as the Greenfield Emergency Management Organization, which is responsible for the preparation and implementation of emergency functions required to prevent injury and minimize and repair damage due to disasters, to include emergency management of resources and administration of such economic controls as may be needed to provide for the welfare of the people, and emergency activities (excluding functions for which military forces are primarily responsible) in accordance with Chapter 44, RSMo., and supplements thereto, and the Missouri Emergency Operations Plan adopted thereunder.

For the purposes of this Chapter, the following terms shall be deemed to have the meaning indicated below:
DIRECTOR
The person appointed by the Mayor to perform the duties set forth in Section 220.040. The Mayor shall have authority to appoint the Dade County Emergency Manager Director or any other person having emergency management skills as Acting Director of the Greenfield Emergency Management Organization. In the event the position of Director is vacant, "director", as used in this Chapter, shall mean the Mayor.
DISASTER
An occurrence such as a tornado, storm, flood, high water, wind-driven water, earthquake, drought, blizzard, pestilence, famine, fire, explosion, building collapse, vehicle wreck, act of terrorism, enemy attack, sabotage or any other natural or manmade situation that causes human suffering or creates human needs that the victims cannot alleviate without assistance and that requires an extraordinary commitment of government resources. This definition shall not be applied rigidly to exclude situations not enumerated but which put citizens of the community at risk.
This agency shall consist of a Director and other members appointed by the Greenfield Emergency Management Organization to conform to the State organization and procedures for the conduct of emergency operations as outlined in the Missouri Emergency Operations Plan.
The organization shall perform emergency management functions within the City of Greenfield and may conduct these functions outside the territorial limits as directed by the Governor during the time of emergency pursuant to the provisions of Chapter 44, RSMo., and supplements thereto.
A. 
The Director will be appointed by the Mayor and shall serve at the pleasure of the Mayor.
B. 
The Director shall have direct responsibility for the organization, administration and operations of local emergency management operations, subject to the direction and control of the Mayor or Board of Aldermen.
C. 
The Director shall be responsible for maintaining records and accounting for the use and disposal of all items of equipment placed under the jurisdiction of the Greenfield Emergency Management Organization.

A. 
Executive Officer. The Mayor of the City of Greenfield, Missouri, and the Director, in accordance with Chapter 44, RSMo., as amended, and supplements thereto, may:
1. 
Appropriate and expend funds, make contracts, obtain and distribute equipment, materials, and supplies for emergency management purposes; provide for the health and safety of persons, including emergency assistance to the victims of natural and man-made disasters, or national emergency; the safety of property; and direct and coordinate the development of disaster plans and programs in accordance with the policies and plans of the Federal and State emergency management agencies;
2. 
In the event of a national emergency or severe local emergency endangering public health, welfare, life or public property, waive the normal purchasing/supply requisition procedures, upon approval of the Mayor and in accordance with State statutes and any local emergency procurement procedures formally adopted by the City of Greenfield, Missouri;
3. 
Appoint, provide, or remove rescue teams, auxiliary fire and police personnel and other emergency operations, teams, units, or personnel who may serve without compensation;
4. 
With the approval of the Governor and consistent with the Missouri Emergency Operations Plan, enter into mutual aid agreements with other public and private agencies within and without the State for reciprocal emergency aid;
5. 
Accept donated goods/services to benefit disaster victims, and services, materials, equipment, supplies, or funds granted or loaned by the Federal government for disaster mitigation, preparedness, response and recovery purposes.
The Mayor may enter into mutual-aid arrangements or agreements with other public and private agencies within and without the State for reciprocal emergency aid as authorized in Section 44.090, RSMo.
The Mayor of the City may, with the consent of the Governor, accept services, materials, equipment, supplies or funds gifted, granted or loaned by the Federal Government or an officer or agency thereof for emergency management purposes, subject to the terms of the offer.
No person shall be employed or associated in any capacity in the Greenfield Emergency Management Organization who advocates or has advocated a change by force or violence in the constitutional form of the Government of the United States or in this State or the overthrow of any Government in the United States by force or violence, or has been convicted of or is under indictment or information charging any subversive act against the United States. Each person who is appointed to serve in the Greenfield Emergency Management Organization shall, before entering upon his/her duties, take an oath, in writing, before a person authorized to administer oaths in this State, which oath shall be substantially as follows:
"I, __________, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States and the Constitution of the State of Missouri against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties upon which I am about to enter. And I do further swear (or affirm) that I do not advocate, nor am I a member of any political party or organization that advocates the overthrow of the Government of the United States or of this State by force or violence; and that during such a time as I am a member of the Greenfield Emergency Management Organization, I will not advocate nor become a member of any political party or organization that advocates the overthrow of the Government of the United States or of this State by force or violence."
The Mayor is authorized to designate space in any City-owned or leased building for the Greenfield Emergency Management Organization.

A. 
The Mayor may declare an emergency whenever a disaster is imminent or actually occurs within the City and the safety and welfare of the inhabitants is jeopardized.
B. 
The Mayor shall as soon as possible report to the emergency operations center and assume control over the City's emergency response.
C. 
Upon declaration of an emergency, the Mayor may exercise all emergency powers granted to the executive officer of the City by Chapter 44, RSMo., and shall take all steps necessary to ensure the health, safety and welfare of all persons within the City limits.
D. 
Line Of Succession In Absence Of The Mayor.
1. 
If the Mayor is absent or disabled, the President of the Board of Aldermen shall assume the duties of Mayor and assume control over the City's emergency response.
2. 
If the Mayor and President of the Board of Aldermen are both absent or disabled, the remaining members of the Board of Aldermen shall designate one (1) of their number to serve as Acting Mayor.

A. 
If a disaster occurs which requires implementation of the City emergency operations plan or if an emergency occurs which does not require the immediate implementation of the City emergency operations plan but which requires the extraordinary management of City resources, the Mayor is authorized to declare an emergency and establish temporary emergency regulations to ensure the health, safety and welfare of the persons within the City.
1. 
Regulations established by the Mayor pursuant to this Section shall contain a brief statement of the facts constituting the emergency and shall be narrowly drawn to address the stated emergency.
2. 
Immediately after establishing regulations pursuant to this Section, the Mayor shall cause a copy of the regulations to be posted in a conspicuous place at the City Hall viewable by the public and shall cause copies to be delivered to all members of the Board of Aldermen and distributed to local news media.
3. 
Regulations established by the Mayor pursuant to this Section shall remain in effect for twenty-one (21) days unless sooner revoked by the Mayor or by a majority vote of the Board of Aldermen.
4. 
At the next regular meeting of the Board of Aldermen after establishing emergency regulations or at a special meeting of the Board of Aldermen called for that purpose, the Mayor shall give a complete report on the emergency to the Board of Aldermen. If the Mayor determines that the emergency regulations shall remain in effect, an ordinance shall be prepared and presented to the Board of Aldermen which would establish the regulations by ordinance.
B. 
Regulations established under this Section shall have the force of law. A person who violates the regulation established under this Section after receiving notice of the regulation shall be guilty of an offense punishable by a fine not to exceed five hundred dollars ($500.00) or by imprisonment not to exceed ninety (90) days, or by both such fine and imprisonment. A person who fails to cease and desist from violation of the regulation after receiving notice of the regulation shall be subject to immediate arrest.

A. 
The Mayor is authorized to declare a water use emergency under any of the following conditions:
1. 
An equipment failure, large fire or water main break has caused or, unless emergency water conservation measures are taken, will cause inadequate water pressure and flows for fire protection.
2. 
An equipment failure, large fire or water main break has caused or, unless emergency water conservation measures are taken, will cause an inadequate supply of potable water for use by the inhabitants of the City.
B. 
After declaring a water use emergency, the Mayor may establish temporary emergency regulations that restrict or regulate the use of water and may prohibit non-essential water use. If necessary, the Mayor shall have the authority to temporarily suspend water service to non-essential customers until adequate water supply has been restored.

In the event of a disaster, the Mayor shall have the authority to order a curfew prohibiting any persons within the City from being on the street, in a public area or on private property not owned or leased by the person between designated hours set forth in the curfew. A curfew imposed pursuant to this Section shall not remain in effect for a period in excess of five (5) days following the disaster. Violation of a curfew shall be a violation punishable under Section 220.110 of this Chapter.

A. 
The Emergency Management Director, in accordance with Chapter 44, RSMo., may:
1. 
With the approval of the Board of Aldermen and consistent with Missouri Emergency Operations Plan, enter into mutual-aid agreements with other public and private agencies within and without the State for reciprocal emergency aid.
2. 
Accept services, materials, equipment, supplies or funds granted or loaned by the Federal or State Government or private emergency aid organizations for disaster planning and operations purposes.
B. 
In the event of a disaster the Emergency Management Director may exercise the following additional powers:
1. 
Designate emergency command centers and to transfer such City equipment and property to the command center as the Administrator deems necessary.
2. 
Allow use of City trucks, tractors, backhoes, etc., by other agencies or persons engaged in the emergency disaster response.
3. 
Require City personnel to report for duty and to assign or reassign the personnel to such emergency response tasks as the Administrator deems appropriate.
4. 
Place City employees under the temporary supervision and control of County, State or Federal emergency administrators.
5. 
Appoint and remove emergency operation teams, units or personnel.
6. 
Assume control of volunteers and assign such volunteers to operation teams and units.
7. 
Assign emergency missions to non-governmental groups such as physicians and news media as necessary to develop a capability to augment government disaster response.
8. 
Appoint an emergency communications spokesperson to relay information to the public and the media and to respond to inquiries from the media or the public regarding the status of the emergency and the actions being taken in response.
9. 
Authorize the emergency communications spokesperson to act as spokesman for all Federal, State and local agencies involved in the emergency response.
10. 
Require all oral or written statements made by City personnel be released only through the designated emergency communications spokesperson and prohibit City personnel from making unauthorized release of information to the media or the public.
11. 
Designate an area of City property as area on which debris can be temporarily placed. Allow placement of disaster debris on the designated property.
12. 
To enter into binding agreements or contracts with independent contractors for the removal of debris that may be blocking public streets or which endangers the health and safety of the inhabitants of the City without requiring the solicitation of bids before entering into contracts. No contract or agreement entered into under this provision without prior approval of the Board of Aldermen shall contract for services from the independent contractor for a period in excess of seven (7) days.

A. 
The Director shall maintain a comprehensive emergency management basic plan.
B. 
The Director shall from time to time recommend to the Board of Aldermen such additions or amendments to the emergency management plan as the Administrator deems appropriate.
C. 
The Director shall review the emergency operations plan annually.

A. 
The Mayor may authorize the Police Department, Fire Department, Public Works Department, Water and Light Department, other City personnel and the Office of Emergency Management to provide assistance to any governmental agency in Missouri or in bordering State at the time of a significant emergency such as fire, earthquake, flood, tornado, storm, hazardous material incident, terrorism, sabotage or civil disturbance.
B. 
Requests for emergency assistance shall be promptly communicated to the Mayor or the Emergency Management Administrator.
C. 
Emergency assistance shall not be authorized if, in the opinion of the Mayor or the Emergency Management Administrator, the safety of the inhabitants of the City of Greenfield would be jeopardized if such assistance were provided.
D. 
This Section does not supersede any existing mutual-aid agreement, ordinance or resolution.
