This article is adopted pursuant to the authority of the Municipal
Home Rule Law.
It is the intention of the Board of Trustees of the Village
of Canajoharie to establish and impose sanctions upon owners of vehicles
if two or more delinquent parking violation tickets issued by the
Village of Canajoharie Police Department remain unpaid.
A.
Should a vehicle have two or more delinquent parking violation tickets
issued by the Village of Canajoharie Police Department and said vehicle
is found located on a Village street or roadway, a device commonly
called a "boot" may be attached, immobilizing said vehicle until such
time as all delinquent parking violation tickets are paid, together
with an administrative fee of $50 to cover the cost of booting and
removing the boot.
B.
It shall be a violation of this article to tamper with or attempt
to remove said boot. Any person who tampers with or attempts to remove
a boot shall be subject to a fine not exceeding $250. Upon proof of
payment of all delinquent parking ticket violation tickets and the
administrative fee, the boot shall be removed from said vehicle.
C.
Any local police officer who locates a vehicle parked or standing
upon or within a Village of Canajoharie public street or roadway,
which is known to have two or more delinquent parking violation tickets,
may attach a boot to a wheel of the vehicle. Thereafter, said officer
shall attach a dated and time-recorded notice to the windshield of
said vehicle that states:

THIS VEHICLE HAS BEEN IMMOBILIZED BY THE VILLAGE OF CANAJOHARIE
FOR TWO OR MORE DELINQUENT PARKING VIOLATION TICKETS PURSUANT TO THE
AUTHORITY OF LOCAL LAW NO. 1 OF 2011.

DO NOT ATTEMPT TO REMOVE OR TAMPER WITH THE ATTACHED BOOT. THIS
MAY CAUSE DAMAGE TO THE BOOT AND/OR THE VEHICLE. TAMPERING WITH THE
BOOT IS AN OFFENSE PUNISHABLE BY A MAXIMUM FINE OF $250. DAMAGE TO
THE BOOT WILL BE PROSECUTED AS A CRIMINAL MISCHIEF. TO HAVE THE BOOT
REMOVED, CONTACT THE CANAJOHARIE VILLAGE COURT DURING BUSINESS HOURS
AND ARRANGE TO PAY ALL DELINQUENT PARKING VIOLATION TICKETS AND AN
ADMINISTRATIVE FEE OF $50. AFTER PROOF OF PAYMENT IS PROVIDED TO THE
POLICE DEPARTMENT, THE BOOT WILL BE REMOVED.

IF THE DELINQUENT PARKING TICKETS ARE NOT PAID WITHIN 48 HOURS
OF APPLICATION OF THE BOOT, THE VEHICLE MAY BE TOWED AS AN ABANDONED
VEHICLE IN VIOLATION OF THE NEW YORK STATE VEHICLE AND TRAFFIC LAW.

D.
After all delinquent parking violation tickets and the administrative
fee have been paid, any available officer of the Village of Canajoharie
Police Department shall remove the boot from the vehicle.
The provisions of this article are severable and the invalidity
of a particular provision shall not invalidate any other provisions.
