Wellsboro Borough hereby elects to administer and enforce the
provisions of the Pennsylvania Construction Code Act, Act 45 of 1999,
35 P.S. §§ 7210.101 — 7210.1103, as
amended and supplemented from time to time, and its regulations.

The Uniform Construction Code, contained in 34 Pa. Code, Chapters
401 — 405, as amended and supplemented from time to
time, is hereby adopted and incorporated herein by reference as the
municipal building code of Wellsboro Borough.

Administration and enforcement of the Code within this Borough
shall be undertaken by entering into a contract with a code administrator,
or other entity that is certified and qualified to act as such, for
the administration and enforcement of the Act on behalf of the Wellsboro
Borough. Wellsboro Borough, by resolution, shall appoint the code
administrator or administrators as the Borough deems appropriate.

A Board of Appeals shall be established by resolution of the
Wellsboro Borough Council, as is appropriate by law, in conformity
with the requirements of the relevant provisions of the Code, as amended
from time to time, and for the purposes set forth therein. Wellsboro
Borough will appoint the appropriate members for the Board of Appeals
as is necessary by law.

1. All building code ordinances or portions of ordinances, which were
adopted by this Municipality on or before the adoption of this ordinance,
including but not limited to Wellsboro Borough Ord. 615, are hereby
rescinded.
2. All relevant ordinances, regulations and policies of this Municipality
not governed by the Code shall remain in full force and effect.
3. All building code permits issued pursuant to Ord. 615 prior to the
effective date of this Part shall remain valid and continue in full
force and effect.

Fees assessable by the code administrator for the administration
and enforcement undertaken pursuant to this Part and the Code shall
be established by the code administrator, shall be consistent with
law and shall be approved by the Wellsboro Borough.

A certain document, three copies of which are on file in the
Borough Secretary's Office of the Borough of Wellsboro, Tioga
County, Pennsylvania, being marked and designated as the "BOCA National
Property Maintenance Code, Fourth Edition, 1993," as published by
the Building Officials and Code Administrators International, Inc.,
be and is hereby adopted as the property maintenance code of the Borough
of Wellsboro, Tioga County, Pennsylvania; for the control of buildings
and structures as herein provided; and, each and all of the regulations,
provisions, penalties, conditions and terms of said BOCA Property
Maintenance Code are hereby referred to, adopted and made a part hereof
as if fully set out in this Part, with the additions, insertions,
deletions and changes, if any, described in § 5-302 of this
Part.

1. The following sections are hereby revised as follows:
A. Section PM-101.1. (Page 1, Second Line) Insert: "Borough of Wellsboro."
B. Section PM-106.2. Any person who shall violate a provision of this
code shall be, upon conviction, sentenced to a fine of not more than
$1,000 plus costs and, in default of payment of said fine and cost,
to a term of imprisonment not to exceed 30 days. Each day that a violation
continues after due notice has been served shall be deemed a separate
offense.
C. Section PM-106.3. (Page 3, Fourth Line) Insert: "30 days."
D. Section PM-304.12. (Page 11, First Line) Insert: "April 1 to November
1."
E. Section PM-602.2.1. (Page 17, Fifth Line) Insert: "November 1 to
April 1."
F. Section PM-602.3. (Page 17, Third Line) Insert: "November 1 to April
1."

Nothing in this Part or in the property maintenance code hereby
adopted shall be constructed to affect any suit or proceeding impending
in any court, or any rights acquired, or liability incurred, or any
cause or causes of action acquired or existing under any act or ordinance
hereby repealed; nor shall any just or legal right or remedy of any
character be lost, impaired or affected by this Part.
