It shall be unlawful for any person under 16 years of age (such
persons being defined for the purpose of this Part as children), to
be or remain in or upon any of the streets, alleys, parks or public
places in the Borough of Wellsboro at night after the hours of 11:30
p.m., prevailing time, unless a child is accompanied by his or her
parent, guardian or other person having legal custody of such child,
or with such person's permission by a responsible person of good
repute over 21 years of age.

It is hereby make unlawful for any parent, guardian or other person having legal care or custody of any child under the age of 16 years to allow or permit such child, while in such legal custody, to go or be in or upon any of the streets, alleys, parks or public places in the Borough after the time provided in §
6-601 of this Part, except as therein provided.

1. Any child as above designated found in or upon any of the streets, alleys, parks or public places within the Borough in violation of §
6-601 of this Part, may be taken into custody by any member of the Borough Police and turned over to his or her parents, guardian or the person having the legal custody of such child.
2. Any parent, guardian or other having legal custody or care of any
child under the age of 16 years who is found to be in violation of
this Part shall, for the first offense, be given written notice of
such violation, and for the second and subsequent offenses, such person
shall, upon conviction thereof, be sentenced to pay a fine not to
exceed $1,000 plus costs and, in default of payment of said fine and
costs, to imprisonment for a term not to exceed 30 days. Each day
that a violation of this Part continues shall constitute a separate
offense.
