Except as otherwise stated herein, the Village shall be responsible for the installation, repair, and maintenance of all water service connection pipes and equipment from the Village water main to the property line of each premises (typically within the right-of-way) and only within property on which the Village has the right to enter for the purpose of servicing water systems. This shall include, but not be limited to, tapping sleeves, corp. stopcocks, curb valves, curb valve boxes, and meters. The user shall be fully responsible for water service lines from the property line (typically the curb valve location) to the owner premises.
A. 
No connection with the water main shall be made until the aforesaid written application, along with all required fees, has been made to the Superintendent and he has issued a written permit therefor.
B. 
The Village shall have the right to reject any application for permit for just cause or stipulate such conditions as may be necessary to maintain a properly operating water system and which is and remains in compliance with all regulatory requirements. Permits for services that may not be in conformance with current applicable standards, requirements of the current codes, or in compliance with the Department of Health or EPA regulations, may be rejected or denied by the Superintendent.
C. 
Applications for permit shall be signed by the owner, or the owner's duly authorized agent, of the property for which water service is to be installed and shall then constitute a binding contract between the Village and the owner obligating the owner to pay the Village the established rates and fees accordingly and also obligating the owner to comply with rules and regulations herein.
D. 
Applications for water services requiring construction in a public right-of-way, in an easement, or on property other than the applicant's property; shall also require approval of the appropriate municipality or entity holding the property or easement and shall be approved prior to the application for a water service permit shall be approved.
E. 
Before the Superintendent shall approve an application, the applicant shall provide the appropriate contractor's insurance certifications to the Village identifying and confirming the insurance coverage. Insurance coverage shall be provided in the types and amounts as established by the Village Board, and as modified from time to time by resolution of the Village Board. Insurance policies must provide for a minimum of 15 business days' notice to the Village before cancellation and must cover all liabilities of the Village and shall be in a form approvable by the Superintendent.
A. 
Except for multiple-building apartment complexes, no more than one building, mobile home, or other structure shall be connected on the same water connection pipe with a water main, unless the only other structure shall be a garage, barn, shed or similar: residential nonbusiness storage facility associated with the primary structure. All existing and future violations of this section shall be remedied within 90 days after notice thereof has been given by the Village. Such notice shall specify that in addition to all other remedies provided by law, the Superintendent shall shut off the water supply if proper connections are not made in the time specified. The Superintendent shall shut off the water accordingly and shall keep it off until such proper connections are made.
B. 
Where more than one building is connected on the same connection pipe, when water termination is authorized by this chapter in case of default in the payment of water rent by any one customer or for any other violation which occurs with respect to any one building, the Superintendent shall shut off water at the main, and the Village shall not be liable to any other customer or owner of any other building on said connection line in any way whatsoever. Additionally, water service to each building in violation of this section shall be metered so that the meter to said building by itself and without reference to other meters shall indicate the amount of water consumed in said building.
A. 
No pipe or fixtures connected with the water mains of the Village may also be connected with the pipes or fixtures supplied with water or any other liquid from any other source.
B. 
A "cross-connection" shall refer to any unprotected connection between the Village water system and the water service or owner plumbing system in which water or substances in the service or owner plumbing system is not as equally as safe as the Village water system or public water supply. "Cross-connection" may also be defined as per the State Department of Health guidelines and standards.
C. 
Cross-connection control shall be provided by the owner to protect the public water supply and shall be provided for all commercial and industrial connections unless deemed by the Superintendent that no significant hazard exists. Cross-connection control may be required on residential services if the Superintendent determines that there is a significant hazard and cross-connection control is needed. Cross-connection control shall be provided in accordance with Chapter 154, Cross-Connection Control.
A. 
On each water service connection pipe from the water main to the first building on the premises, there shall be connected 1) a curb stopcock and box which shall be located at the right-of-way line or at the closest property line to the water main or in a location previously approved by the Superintendent, and 2) a stopcock at the water main, and 3) a stop and waste cock placed immediately before and after each meter. Each stopcock must be able to independently shut off all of the water going from the water main to the building or a portion thereof. Curb stop boxes shall be made visible and accessible at all times and shall be set at grade. The size and kind of stopcocks, waster cocks and curb boxes shall be as determined by the Superintendent. It is the responsibility of the owner(s) of each premises that all of the aforesaid necessary equipment be installed.
B. 
All service pipes, stopcocks, curb boxes, valves, taps, meters, and all other appurtenances shall be provided and installed in accordance with the latest version of the Village of Dansville Development Regulations.
All labor and material for tapping the water main and installation of the water service connection from the water main to and including the curb stopcock and box shall be performed only by Village Water Department personnel or an authorized agent thereof. All applications for such connections to the Superintendent shall, in addition to other requirements, state the size and location of the tap and all service connection pipes desired by the applicant. The Superintendent is hereby given the authority to make the final determination of the size, type, and location of the tap and service pipes. No application for connection shall be accepted by the Superintendent until the aforesaid fees have been paid. The Village reserves the right to make service connections only during the period from April 1 to November 1 in each calendar year.
All labor, equipment and material for installation of the service connection from the curb box to and including the water meter(s) required hereunder shall be furnished and paid for by the applicant with the exception that the Village will install and provide residential meters. All such pipe to each building must be placed at least 4 1/2 feet below the ground surface. Connection of this portion of the pipe with the pipe from the main to the curb box shall not occur until the Superintendent has observed and approved all installation and material used by the applicant or his agent and the performance thereof. It shall be an additional violation of this chapter for any firm, person, corporation, organization or employee or agent thereof, to cover said pipes or fill in any portion of the excavation until written authorization therefor has been issued by the Superintendent. Said violation shall be against the owners of the property, the applications for the connection, the actual persons who filled in the trench and their employers and principals who directed same. In addition to all penalties herein for a violation, the installation will not be approved for use and no water service will be allowed until the entire length of trench and pipe is uncovered by owner at owner's sole expense and is properly re-installed and inspected. If any defects in workmanship or material are found, or if the installation fails to meet the specifications and requirements herein provided, water service will not be turned on and the pipes shall not be covered until the defects have been fully repaired or replaced to the Superintendent's satisfaction. If water service has been turned on before discovery of such defects, the service shall be turned off immediately until the defects are remedied.
A. 
For all water service, a water meter must be installed on each water connection service from the water main at a point before the first use of water therefrom. For multiple-unit buildings, as the term "unit" is defined hereinafter, one meter is required (Village meter). However, more than one meter may be installed after the Village meter, at the expense of the user, in multiunit buildings at locations approved by the Superintendent which may enable all water consumed by each unit in said buildings to be measured. All existing and future violations of this section shall be remedied within 90 days after notice thereof. Such notice shall specify that in addition to all other remedies provided by law, the Superintendent shall shut off the entire water supply to all units on said service connection if all violations are not remedied in the aforesaid time period.
B. 
Except as otherwise specified in Article IV, no fixture, connection or device of any description for the use of water shall be placed between the main and the first meter, but all water must first pass through a meter. The water supply shall be turned off without notice and will remain turned off until a) such fixtures, connections and device shall have been removed, and b) any penalty imposed for such violation has been satisfied, and c) all water rent, interest, charges and penalties for said unmetered water consumed have been paid.
C. 
All meters must be approved as to design, quantity and efficiency by the Superintendent prior to installation. On a new residential service connection (one inch or less service size), if only one meter is required, said meter shall be furnished by the Village as part of the application fee for such new connection. If more than one meter is requested for such new service connection, each meter shall be furnished by the Village and subsequent meters shall be placed after the Village meter and shall be at the cost of the user, and the application fee shall be increased accordingly. Each meter to be installed in an existing or newly formed unit on an existing service connection shall be furnished by the Village as part of the meter application fee for such unit meter. No meter shall be installed until the written application has been made to the Superintendent, all application fees have been paid and the Superintendent has issued a permit. All meters shall be installed according to the requirements set forth in this chapter at the property owner's expense and under the supervision of the Superintendent. All defects shall be remedied to the Superintendent's satisfaction before water shall be turned on. Meters for water service connection pipes that are greater than one inch in diameter shall be paid for by the property owner and then shall be given to the Village. The meter thereafter shall be the property of the Village, and it shall be the responsibility of the Village to properly maintain and/or replace the meter as deemed necessary by the Village.
D. 
All meters must be installed at locations which shall be frost free, accessible at all times to the Superintendent, and properly safeguarded.
E. 
Once a meter is installed and approved by the Superintendent, no person except the Superintendent, or an agent thereof, shall open, change, repair, tamper with or otherwise disturb said meter. In addition to all other penalties provided, violation of this subsection shall result in an immediate termination of water.
F. 
Meters may be removed for testing or tested in place by the Village at the discretion of the Superintendent.
G. 
Meter vaults and meter pits. Proper and adequate below-grade meter vaults or meter pits shall be provided at the right-of-way line or the property line for any water service line that exceeds 150 linear feet from the water main to the first serving structure at the discretion of the Superintendent. The meter vault or meter pit shall be provided in accordance with the Village of Dansville Development Regulations and shall be approved by the Superintendent. Meter vaults and meter pits shall provide for adequate means of access, protection, security, and de-watering in order to provide for a consistent and properly operating meter installation.
A. 
The Village shall make repairs due to normal wear and tear and defective parts to the service connection from the main to and including the curb stop and box, and also to Village meters. Otherwise, the owners of each premises are liable for and shall maintain in good repair and operating condition, including, but not limited to, the prevention of frost or freezing or vandalism, all service connection pipes from the curb valve to and within the premises and all fixtures and other equipment thereon at their own expense. The Village shall not be liable for and the owner shall indemnify and hold harmless the Village and its agents from all personal injury and property damage resulting from or connected in any way with all of the aforesaid items and/or the condition or repair thereof.
B. 
The owners of the premises shall notify the Superintendent forthwith of all leaks, defects, and other damages of all said service connection pipes, meters and other aforesaid equipment and appurtenances thereon. In addition to all other rents, charges and penalties provided by this or other law, the Superintendent shall add to the water bill for said premises a daily charge, per the Village Water Rate Schedule, for each day after the first day that the owners or occupants of the premises knew or should have known by diligent inspection that any such leak, defect or damage existed or was imminent and failed to notify the Superintendent thereof.
C. 
All repairs between the main and the curb stop shall be done by the Village or an authorized agent thereof.
D. 
All repairs from the curb stop inward to and including each meter shall be done by the owner at the owner's expense after an application has been approved. All such repairs must be completed within seven days from the date that the leak, defect, or damage or the resulting water or lack of water therefrom was first observed. Upon learning of a leak, defect or damage, the Superintendent shall cause a notice to the owner, which notice shall also contain a statement that failure to comply shall cause the water supply to be discontinued immediately. The Superintendent shall immediately terminate the water supply if the repairs are not made within said seven days. The water supply shall not be continued again until the repairs have been made.
E. 
If the leak, defect or other damage to the water service connecting pipes, wherever located, creates, in the Superintendent's opinion, an emergency endangering the Village water system or the property of one or more other owners, the Superintendent may shut off the water supply immediately after giving as much notice as may be practical under the circumstances.
F. 
If the owner fails to comply with either notice, the Superintendent, with the approval of the Village Board, and all in addition to all other remedies for such violation, may make all said necessary repairs, and the actual expense thereof, including all labor and material in completing same, and including all fees set forth herein, shall be assessed upon such piece of property opposite or upon which the same shall be done and completed, and shall be a lien and liens on said premises, and shall be collected along with all legal fees and costs incurred to collect the same, in accordance with this chapter and other local laws.
G. 
The Village reserves the right to remove, change, or otherwise alter at any time at the Village's expense, all connection pipes and equipment from the water main to each property line or the curb stop and curb box thereon. If said pipes and equipment are not otherwise in need of repair, said removal, change, or alteration shall be at the sole expense of the Village.
H. 
In the event that a change in ground elevation results in a water service with inadequate ground coverage and protection from frost or is raised and requires adjustment to the curb box or service depth; the owner shall promptly lower or raise his service pipe, valves, boxes, and appurtenances accordingly. In the event the owner does not promptly modify the water service, the Superintendent may terminate the supply of water in accordance with this chapter.
I. 
In the event that a structure has become closed or vacant or if water shutoff is needed for other purposes; the owner shall adequately notify the Village in order that the meter may be read, the meter may be properly drained and protected from freezing, and the curb stop closed. In the event that water pipe leaks (due to freezing or any other issue), the value of the water shall be paid for by the owner. The owner of the property shall be responsible for all costs associated with the repair and/or replacement of any water system components due to freezing or any other pipe leaks that may occur on the premises.
J. 
A building plumbing drain shall be provided within every building located so that all water piping may be properly drained on the owner side of the meter, if required.
No new unit shall be created, used, or occupied on real property until the owner of said real property has first made an application and paid the fees, including the meter fee, for and has received a permit from the Superintendent for the creation of such new unit. Noncompliance with this section, in addition to liability for water rent, shall be a violation for which the Superintendent shall, in addition to other penalties set forth hereinafter, immediately shut off all water supply to the real property where the unit is located until the owner is in consistent compliance.
Once the water supply to any unit has been terminated, whether voluntarily or otherwise, the Superintendent shall seal the shutoff valve to said unit until a new application for service has been made to and accepted by the Superintendent to unseal or otherwise make contact with said shutoff valve, whether sealed or not, or to allow water to be supplied through said service pipes to said unit or to consume said water so supplied while service to said unit is terminated.
