GENERAL REFERENCES
Subdivision of land — See Ch. 285.
Zoning — See Ch. 330.
For reasons of traffic and pedestrian safety, as well as to provide for possible future road widening or other improvements, all new driveways entering onto any street shall comply with these requirements and shall be subject to the approval of the Village Street Superintendent after consultation with Building Code and Zoning Enforcement Officer and Police Chief. Where such driveways are part of a subdivision application or site plan approval, they shall also be subject to Planning Board approval.
A. 
No owner, tenant or occupant of land abutting upon any public right-of-way which by statute, the state, county, town or Village is obligated to repair and maintain, shall construct any private road or driveway thereon, so as to extend into such public way, without first having obtained a written permission from the Village Street Superintendent having charge of the maintenance and repair of such public way.
B. 
The Village Street Superintendent shall issue the permit within 30 days of the recorded receipt of a completed application or shall rending in writing, specifying the reasons for denial of such permit. The decision shall be based upon consideration of public safety using the designated standard, § 160-3.
C. 
Form and content of said permit shall be determined by the Village Street Superintendent and will include but not be limited to the following information and diagrams: driveway location, design, dimensions, intended use, grade, materials, drainage provisions and any other information or documentation which the Superintendent may deem necessary in order to make a decision based on the design standards in § 160-3.
D. 
The approval or denial of application will be filed with the Code and Zoning Enforcement Officer.
A. 
Driveway location.
(1) 
Driveways should be located as not to interfere with clear visibility of the front main wall of the building. In the event that the building is located at an intersection, the front main wall will be any wall facing any street.
(2) 
A new driveway that encroaches upon the front main wall will not exceed 12 feet in width for the purpose of one car space.
B. 
Driveways/street intersection.
(1) 
Only one driveway intersection shall be permitted per single building lot.
(2) 
No driveway center line shall intersect a street line less than 70 feet from the intersection of any two street center lines.
(3) 
Driveway intersection should be located to the best advantage with regard to alignment with the public way, intersecting at as close to the right angle as feasible. The angle of intersection shall be between 60° and 120°.
(4) 
The curbline radius of the landing to the edge of public way shall be a minimum of 10 feet.
(5) 
The width of the landing shall be a minimum of 14 feet, but shall not exceed 24 feet. Unless conditions require it, a landing shall not be located within 10 feet of a side property line.
C. 
Sight distances.
(1) 
No wall or other obstruction shall be planted, constructed, or maintained at the intersection of a driveway with the public way which causes danger to traffic or pedestrians of the public way or to users of the driveway by unreasonably obscuring a view.
(2) 
No new driveway should be located where the minimum sight distance at four feet above the driveway platform in each direction along the way is less than 150 feet, and so that there is a similar view of the automobile in the driveway.
D. 
Culverts and drainage. Existing drainage ditches parallel to the public way shall not be obstructed by driveway construction. Culverts of appropriate size and durable material (such as asphalt-coated galvanized steel) shall be provided by the applicant as determined by the Street Superintendent. Culvert setbacks and minimum length will be determined by the Street Superintendent.
E. 
Driveway grade. The grade of any new driveway shall comply with Chapter 285, Subdivision of Land, § 285-13B(12).

F. 
Surfacing material.
(1) 
Driveways will be improved by a surface of gravel, asphalt or concrete or a combination thereof except as defined in Article X, § 1002B(5), of Chapter 330, Zoning.

(2) 
The applicant or owner of a driveway will insure that no material from said driveway enters the public way by driveway use or water runoff.
(3) 
The Village Street Superintendent may direct the removal of such material from the public way and the cost of such removal be levied upon the owner of the driveway.
G. 
Violations and penalties. An applicant or owner who violates this regulation shall be punished by a fine not exceeding $250, imprisonment for not more than 15 days, or both such fine and imprisonment for each offense and further be liable to the Village of Dansville for all damages caused thereby, and for the cost of the expense of removing the obstruction material and of restoring the public way to its former condition.
