GENERAL REFERENCES
Vehicles and traffic — See Ch. 308.
As used in this chapter, the following terms shall have the meanings indicated:
SKATEBOARD
A narrow board of wood, plastic, fiberglass or similar material with roller skate or other type of wheels attached to each end and used for gliding or moving on any hard surfaces, without a mechanism or other device for steering while being used, operated or ridden. In-line skates-shoes, skates or footwear with a single row of roller wheels. Roller skates-shoes, skates or footwear with two or more rows of roller wheels.
A. 
Parent of child.
(1) 
The parent of any child shall not authorize or knowingly permit any such child to violate any of the provisions of this chapter.
(2) 
If a parent has been notified that his/her child has violated any provision of this chapter, that parent shall be deemed to have authorized and knowingly permitted all subsequent violations of this chapter by such child.
B. 
This chapter applies to skateboards, in-line skates and roller skates whenever such are operated upon any public streets or upon any sidewalks in the Village of Dansville.
A. 
Every person operating a skateboard, roller skates or in-line skates shall operate the same in strict observance of Article 34 of the New York State Vehicle and Traffic Law relating to the operation of bicycles and play vehicles, except as to those provisions which by their nature can have no application.
B. 
Every person operating a skateboard, in-line skates or roller skates shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a motor vehicle under Title 7 of the New York State Vehicle and Traffic Law, except as to special regulations in this chapter and except to such provisions of said Title 7 which by their nature can have no application.
C. 
No person shall use or operate either a skateboard, in-line skates or roller skates upon any public streets (including the entire paved and improved surfaces thereof, including gutter areas, from curb-to-curb, where curbs exist), sidewalks, or on any public lands within the Village of Dansville:
(1) 
In a careless manner without due caution and circumspection; or
(2) 
In any manner that endangers, or creates a risk or danger to, any person or property; or
(3) 
In any manner that impedes or interferes with pedestrian or vehicular traffic.
D. 
The operator of a skateboard, roller skates or in-line skates emerging from an alley, driveway, or building shall, upon approaching a sidewalk, yield the right-of-way to all pedestrians approaching said walk.
E. 
Whenever any person shall operate a skateboard, roller skates or in-line skates upon a sidewalk, such person shall yield the right-of-way to any pedestrian and shall give audible signal before overtaking and passing such pedestrian.
F. 
No person shall operate a skateboard, roller skates or in-line skates at nighttime unless he or she is wearing reflective clothing, which shall be visible from a distance of not less than 50 feet and a maximum of 300 feet from the front, side and rear when directly in front of the lawful beams of headlight on a motor vehicle. "Reflective clothing" shall be defined, for the purposes of this chapter, as any shirt, vest or jacket or any other readily visible piece of apparel equipped with a reflecting surface.
G. 
No person riding on any skateboard, in-line skates or roller skates shall attach the same or himself/herself to any vehicle being operated on the highway.
H. 
Riding on roadways; crossing streets; riding single file.
(1) 
Upon all roadways, any skateboard, in-line skates or roller skates shall be operated as near to the right-hand curb or edge of the roadway, or if available, then on the usable right-hand shoulder, in such a manner as to prevent undue interference with the flow of traffic except when reasonably necessary to avoid conditions that would make it unsafe to continue along near the right-hand shoulder, curb or edge of the roadway.
(2) 
All persons operating a skateboard, in-line skates or roller skates who desire to cross a public street or to turn onto another street shall only do so in the same manner as authorized for pedestrian traffic.
(3) 
All persons operating a skateboard, in-line skates or roller skates on a public street shall do so in single file and not abreast of each other.
I. 
Any person operating a skateboard, in-line skates or roller skates who is entering a public street from a private road, driveway, alley or over a curb shall come to a complete stop before entering the street.
J. 
No person shall use or operate a skateboard over the following streets or over any portion of the sidewalks adjacent thereto, or over the following public areas:

(1) 
All state highways in the Village including but not limited to:
(a) 
Main Street and all of State Route 63.
(b) 
Clara Barton Street, Ossian Street, Dock Street, Franklin Street and all of State Routes 36 and 436.
(c) 
Perine Street, Health Street and all of State Route 256.
(2) 
Old Station Road.
(3) 
Elizabeth Street between Perine and Liberty Streets.
(4) 
Spruce Street between Franklin and Liberty Streets.
(5) 
Franklin Street between Main Street and Spruce Street.
(6) 
Battle Street between Main Street and Spruce Street.
(7) 
Church Street between Clara Barton Street and Liberty Street.
(8) 
School Street between Clara Barton Street and Liberty Street.
(9) 
Liberty Street between Elizabeth Street and School Street.
(10) 
Chestnut Avenue between Main Street and Elizabeth Street.
(11) 
Paradise Alley.
(12) 
All sidewalks within Church Park.
(13) 
All municipally owned or leased land in back of the buildings on both sides of Main Street.

Each violation of this chapter shall be punishable by a fine not exceeding $250, imprisonment for not more than 15 days, or both such fine and imprisonment, for each offense.
