A-frame signs:
A. 
Shall not exceed a maximum of 48 inches in height and 30 inches in width.
B. 
Text is limited to identification of the business, designation of business hours, special sales, daily items of interest and notices of information.

Be positioned to minimize impedance of pedestrian traffic.
D. 
Be on the sidewalk only during the hours of business operation.
E. 
Be maintained in good order.
F. 
Be aesthetically appealing.

Not use peel and stick lettering or other forms of lettering which can be easily vandalized.
H. 
Have all messages contained within the main structure.
A cafe shall:
A. 
Utilize no more than 50% of the sidewalk surface for seating and standees (including umbrellas).
B. 
Be aesthetically appealing.
C. 
Be maintained in a clean and orderly manner to assure the removal of used dishes, glasses, bottles and waste on and around the seating area.
D. 
Have appealing and appropriate trash receptacles available which shall be the responsibility of the business operator.
E. 
Be confined within the property line (unless consent is granted by the adjacent business operator).
F. 
Adhere to all ABC regulations if serving alcoholic beverages, including the consumption by only those seated. (Nothing shall prohibit the enforcement of state and local laws such as disorderly conduct; littering, open container for anyone standing while seating is available, etc.)
G. 
Adhere to all American Disabilities Act regulations.
H. 
Be on the sidewalk only during hours of business operation.

A permit must be obtained ANNUALLY (and shall be in effect from January 1 to December 30) from the Code and Zoning Enforcement Officer (located at 14 Clara Barton Street, during the normal business hours Monday to Friday) before permission to post an A-frame sign or establish a sidewalk cafe. A processing fee as set from time to time by resolution of the Board of Trustees shall accompany each request. In addition, a diagram of the cafe including the placement of tables, size of the tables, number of chairs, location of the trash receptacles and planned hours of operation must accompany each request. It should be noted that the Code and Zoning Enforcement Officer and Chief of Police (when appropriate) shall have final say in determining the feasibility of each request and shall likewise offer suggestions for the improvement of any plan and/or requirements to meet the qualifications of an acceptable request.
A. 
Failure to observe the above requirement or upon complaints of misuse, inappropriate language or behavior or becoming a public annoyance shall result in:
(1) 
First offense - written warning.
(2) 
Second offense - revocation of permit for two weeks.
(3) 
Third offense - revocation of permit for a period of six months.
(4) 
Fourth offense - refusal of renewal of permit for current owner/operator.
B. 
Each violation of this article shall be punishable by a fine not exceeding $250, imprisonment for not more than 15 days, or both such fine and imprisonment, for each offense. Each week of violation shall be considered a separate offense.
