This article shall hereafter be known and cited as the "Planning Board Law of the Village of Dansville."
The purpose of this article is to formalize the creation of the Village of Dansville Planning Board as previously established, in order to carry out the responsibilities and authority set forth in Article 7 of the Village Law of the State of New York.
A. 
Pursuant to the Village Law of the State of New York, the Mayor, subject to the approval of the Village Board of Trustees, shall appoint five members of a seven-member Planning Board and any alternate members as provided in this chapter; shall designate its Chairperson and provide for compensation, if any, to be paid to said members; and shall provide for such other expenses as may be necessary and proper.
B. 
A member of the Planning Board shall not at the same time be a member of the Village Board of Trustees. The Mayor shall have the power to remove any member of the Planning Board for cause and after public hearing.
C. 
Planning Board members shall be subject to the training requirements set forth in Subdivision 7-a of § 7-718 of the Village Law of the State of New York.
D. 
The Planning Board shall have jurisdiction and all the authority and the powers and duties granted by the provisions of § 7-718 of the Village Law of the State of New York and any other applicable law, including, without limiting the generality of the foregoing, those granted by, arising from and those reasonably required to carry out the provisions of this article.
The existing members of the Planning Board shall serve their terms as previously set out. Thereafter, appointments shall be made for terms of up to five years on a staggered basis such that the term of one member will expire each year. Their successors shall be appointed for terms of five years from and after the expiration of the terms of their predecessors in office, except that the alternate member shall be appointed as set forth in this chapter. If a vacancy shall occur otherwise than by expiration of a term, it shall be filled by the Mayor by appointment for the unexpired term.
A. 
Appointments. The alternate members will be appointed by the Mayor, with the approval of the Village Board of Trustees for a one-year appointment made at the annual organizational meeting.
B. 
When alternate members will serve. The alternate member would serve in the event, for whatever reason, that one or more regular members are either absent or unable to fulfill their duties.
C. 
Meeting attendance and participation. The alternate member may attend all meetings of the Planning Board, but would be voting and participating members only in the event of the absence of any regular member of such Board.
D. 
Rights and duties. Upon designation by the Chairman of the Planning Board, the alternate will also, in the event of a leave of absence, for whatever reasons, of a regular member, have all the rights and duties of that member for the period of that leave or unavailability.
E. 
When alternate members will not serve. Alternate members will not participate in an official capacity in any Board activity in which all members are in attendance, regardless as to whether a regular member disqualifies oneself for any reason.

The Planning Board may review and make recommendations on a proposed Village Comprehensive Plan or amendment thereto. In addition, the Planning Board shall have the full power and authority to make investigations, maps, reports and recommendations in connection therewith relating to the planning and development of the Village as it seems desirable, provided that the total expenditures of said Board shall not exceed the appropriation provided therefor.
The Village Planning Board shall have the specific power and authority to approve subdivision plats, approve special use permits and approve site plans and other duties as set forth in the Code of the Village of Dansville. This provision shall not be construed to limit the powers and duties of the Planning Board, and the Planning Board shall have all powers and duties as set forth in Article 7 of the Village Law of New York State.
