[Adopted as Ch. 1, Art. XIV, of the Municipal Code; amended in its entirety 11-28-1994 by Ord. No. 94-13]
As used in this article, the following terms shall have the meanings indicated:
PERSON IN CHARGE
The Village Administrator or his or her designee.
SMOKING
Carrying a lighted cigar, cigarette, pipe or any other lighted smoking materials.
VILLAGE-OWNED BUILDING
Includes but is not limited to any enclosed Village building, including the Library, Fire Station, Public Works Garage, Police Department portion of the Municipal Building and the Village Hall portion of the Municipal Building, excepting that area within the Village Hall portion of the Municipal Building which has been designated by the Village Board and posted as a "smoking allowed" area, upon a finding by the Village Board that smoking in such area will not require any building modification costs for necessary ventilation purposes.
VILLAGE-OWNED VEHICLE
Includes but is not limited to any Village-owned vehicle, including police marked and unmarked squad cars, fire trucks and accessory vehicles, and public works dump trucks, tractors, pickups and accessory vehicles.
A. 
In an effort to provide a safe and healthy environment, no person shall smoke or use any lighted tobacco smoking products in any Village-owned building or vehicle.
B. 
The Village Administrator or his or her designee shall post signs identifying "smoke-free workplace" and/or "no smoking" in all Village-owned buildings.
A. 
After January 1, 1995, any person who shall violate the provisions of this article shall be subject to a penalty as provided in § 1-4 of the Code of the Village of Hales Corners.
B. 
After July 1, 1995, the person in charge or any affected party may institute an action in any court with jurisdiction to enjoin repeated violations of this article.
