This Part 3 shall be known as the "Refuse Storage, Collection
and Disposal Ordinance."

No person, association, firm or corporation shall keep or suffer
to remain upon his or her premises, or any private property, any garbage,
offal, carcass, putrid matter or other offensive or unwholesome matter,
or cast the same upon any lot or piece of ground within the Borough
of Watsontown, or upon the shores or margin of any street or body
of water, or into any sewer inlet or upon any sidewalk or street in
the said Borough. Nor may any person, firm or corporation use or permit
to be used, any spot or place within the Borough as a public or private
dump for garbage refuse or rubbish.

1. As used in this Part 3, the following terms shall have the meanings
indicated:
ASHES
The residue resulting from the burning of wood, coal, coke,
or other combustible material.
DISPOSAL
Includes the storage, collection, disposal, or handling of
refuse.
GARBAGE
All animal and vegetable wastes resulting from the handling,
preparation, cooking, or consumption of foods.
PERSON
Any natural person, association, partnership, firm or corporation.
REFUSE
All solid waste except body wastes, and shall include garbage,
ashes, rubbish, household goods, bedding, furniture, appliances, rugs,
etc.
RESIDENCE
Consists of one or more rooms where one or more persons eat,
sleep, or inhabit.
RUBBISH
Glass, metal, paper, plant growth, wood, or nonputrescible
solid wastes.
2. The singular shall include the plural and the masculine shall include
the feminine and the neuter.

1. Preparation of Refuse.
A. All refuse shall be drained free of excess liquids before disposal.
B. Garbage shall be wrapped in paper or similar material.
2. Refuse Containers.
A. Refuse containers shall include any containers as approved by the
Borough for the collection of refuse.
B. Residential refuse containers shall be galvanized cans, having close
fitting lids and handles to facilitate collection and having a capacity
of not less than 10 gallons nor more than 20 gallons.
C. It shall be unlawful to permit the accumulation or residue of liquids,
solids or a combination of such materials on the bottom or sides of
containers, it being the intention of this provision that the interior
of containers shall be kept clean through thorough rinsing and draining
as often as necessary by the owner of the container.
3. Storage of Refuse.
A. Each householder, commercial establishment, or person having refuse
shall provide himself with approved refuse containers and shall place
and keep all refuse therein; as provided in this Part 3 relating to
handling of rubbish.
B. It shall be unlawful to place refuse in any street, sidewalk, alley, stream, body of water or any public place, or upon private property, whether owned or not, unless such refuse is placed in an approved container, as provided in §
20-304, Subsection
2, of this Part
3. All refuse shall be placed in containers.

1. Place of Collection. Refuse receptacles shall be placed for collection
at ground level on the property, not within the right-of-way of a
street or alley, and accessible to the side of the street or alley
from which collection is made. Receptacles may be placed for collection
at other than ground level when approved by the collector and an additional
payment for extra service is agreed upon by both parties.
2. Frequency of Collection. Refuse shall be collected twice weekly.
Hotels, restaurants, institutions, and commercial establishments may
be required to have more frequent collection, if determined by governing
body to be essential to protect the public health.
3. Hours of Collection. The Borough Council shall have the right to
regulate the hours of collection as they deem advisable.
4. Licensing of Collectors.
A. No person who charges for their collection service shall collect,
haul, or convey any refuse through or upon any of the streets or alleys
of the Borough of Watsontown or dispose of the same in any manner
or place without obtaining a license from the governing body of said
Borough.
B. The fee for such license shall be as established from time to time
by the Borough Council per annum, and all licenses shall be issued
for the calendar year, or such portion thereof. There shall be no
reduction in the fee for a license issued after the beginning of any
calendar year.
C. Every person who shall apply for a license under this section shall
state the type of refuse to be collected and the manner of collection.
D. No license shall be granted if the method of collection shall not
conform to the requirements of this Part 3.
E. No licensed collector shall make any change in the method of refuse
collection or type of equipment to be used by him without first receiving
the approval of the governing body or an authorized agent.
F. It shall be unlawful for any unlicensed collector to collect or remove
refuse from a household, institution, or commercial establishment.
5. Collection Vehicles.
A. All vehicles used for collection of garbage shall be equipped with
closed bodies and shall have enclosed cargo space.
B. It shall be unlawful to collect, haul, transport, or convey garbage
in open, unenclosed vehicles. Any garbage collector must have a proper
conveyance in which such refuse can be conveyed in a manner as not
to be a source of annoyance or to create unpleasant odors and so as
not to leak, drip or be scattered upon any of the streets or alleys
of the Borough.

1. Limitation on Quantity.
A. It is the intent of this Part 3 that the reasonable accumulation
of refuse of each family for the collection period will be collected
for the standard charge. The collector may refuse to collect unreasonable
amount or may make an additional charge for such amounts. The standard
charge covers the removal of refuse not to exceed two twenty gallon
containers each week.
2. Contagious Disease Refuse.
A. The removal of wearing apparel, bedding or other refuse from homes
or other places where highly infectious or contagious diseases have
prevailed should be performed under the supervision and direction
of the Health Officer. Such refuse should not be placed in containers
for regular collections.
3. Inflammable or Explosive Refuse. Highly inflammable or explosive
materials shall not be placed in containers for regular collection
but shall be disposed of by the owner or possessor thereof.

The Borough Council of Watsontown shall have the power to promulgate
and adopt, from time to time, rules and regulations implementing,
but not in contradiction of, the provisions of this Part 3, and to
establish fees for refuse collection.

The Borough Council of the Borough of Watsontown shall have
the power to enter into a contract or contracts with one or more licensed
refuse collectors for the collection of refuse within the Borough
limits, at such rates of compensation and under such terms and conditions
as shall be mutually acceptable to the contracting parties.

The collection and disposal of refuse in the Borough of Watsontown
shall be under the supervision of the Borough Manager who shall be
charged with the duty of enforcing the provisions of this Part 3 and
such regulations as shall be promulgated and adopted by the Borough
Council as herein provided.

Any person, firm or corporation, whether as principal, agent,
or employee, violating or assisting in the violation of any of the
provisions of this Part 3 or of any regulations made by Council under
the provisions hereof shall upon conviction thereof, pay a fine of
not less than $5 or more than $600 and in default of the payment of
such fine and costs of prosecution, shall be imprisoned in the County
Jail for period of not more than 30 days. After notice, each day's
neglect to comply with the provisions of this Part 3 or any such regulation
shall be deemed a separate offense and be subject in all respects
to the same penalty as the first offense, and separate proceedings
may be instituted and separate penalties imposed for each day's
offense after the first conviction.

1. Definitions.
As used in this Part, the following terms shall have the meanings
indicated:
TRASH DUMPSTER
Any container used to store solid waste and debris on a property
during special circumstances such as renovation, construction, cleaning,
moving or any similar activity. Trash dumpster does not include the
standard twenty-gallon container that is utilized for refuse pickup.
2. Use in
Residential District. A trash dumpster may be utilized within a residential
district upon the following terms and conditions:
A. The property
owner must obtain a permit from the Borough of Watsontown prior to
the placement of the trash dumpster on the property.
B. Only
one trash dumpster shall be allowed on any property at any time.
C. A trash
dumpster must be removed by the expiration of the permit.
D. A trash
dumpster may not interfere with the line of sight at any traffic intersection,
including streets and alleys.
E. A trash
dumpster may not be located on or overhanging any public sidewalk.
F. A trash
dumpster may not interfere with any pedestrian or vehicular traffic.
G. A trash
dumpster may not be located on any public street or alley without
the prior written consent from the Watsontown Police Department or
the Codes Officer.
3. Use in
Nonresidential Districts. A trash dumpster may be utilized in a nonresidential
district upon the following terms and conditions:
A. The property
owner must obtain a permit from the Borough of Watsontown prior to
the placement of the trash dumpster on the property.
B. A trash
dumpster must have a lid that can be completely closed. The only exception
to this requirement is if the dumpster is being utilized solely for
construction debris purposes.
C. A trash
dumpster must be emptied at least once every 30 days or when it becomes
full.
D. A trash
dumpster may not interfere with the line of sight at any traffic intersection,
including streets and alleys.
E. A trash
dumpster may not be located on or overhang any public sidewalk.
F. A trash
dumpster may not interfere with any pedestrian or vehicular traffic.
G. A trash
dumpster may not be located on any public street or alley without
the prior written consent from the Watsontown Police Department or
the Codes Officer.
4. Permit.
A property owner must obtain a permit from the Borough prior to the
placement of a trash dumpster on any property. The cost of the permit
shall be $5. The permit shall entitle the property owner to place
a trash dumpster on the property for up to 30 days. The permit shall
automatically expire 30 days from the day it is approved. A property
owner may apply for an additional permit to keep the trash dumpster
on the property for an additional 30 days. An additional permit shall
be permitted in a residential district upon a showing of good cause.
An additional trash dumpster shall be permitted in a nonresidential
district unless it is shown that the trash dumpster is not being maintained
in accordance with the ordinances of the Borough of Watsontown. The
granting of an additional permit for a trash dumpster, in either a
residential or nonresidential district, is conditioned upon the trash
dumpster being emptied on the final day of the prior permit.
5. Penalty
for Violation. Any property owner or other person who violates any
provision of this section shall be guilty of an offense; and for each
such offense, upon conviction, shall be sentenced to pay a fine of
not less than $100 nor more than $1,000 and costs of prosecution;
and in default of payment of fine and costs, to undergo imprisonment
for not more than 30 days. Each violation of this section shall be
considered a separate offense. Each day of the violation is deemed
a separate offense.
